
Constitution drafter: Impeachment complaints vs. VP Sara did not violate rules
In a post on his Facebook account, former Supreme Court Justice and 1987 Constitution drafter Adolfo Azcuna said the Constitution indicates that impeachment complaints are limited to 'not more than once a year,' and not 'more than one a year.'
Citing the Civil Code definition of a year as 365 days, this would mean that more than once a year would be equivalent to more than one day a year, as a day is the smallest unit of a year.
'Initiation proceedings all occurring WITHIN ONE DAY IN THE SPAN OF A YEAR DO NOT VIOLATE SEC 3, SUBSEC 5, ART XI OF THE CONSTITUTION,' Azcuna said in his post.
'The reason for this is the purpose of the once a year rule… It is to limit the amount of TIME taken away from official duties of both the official and the House of Representatives,' he added.
Azcuna also noted that even with the new definition of initiating, the four complaints initiated on one session day—February 5, 2025—did not violate the 'more than once a year' rule.
Integrated Bar of the Philippines (IBP) national president Allan Panolong, meanwhile, said that the group is of the view that the provision means not more than one a year.
'Our position is that of the prevailing interpretation that not more than one a year. This is so to avoid unnecessary or harassment complaints against the impeachable officers,' he said in a statement aired in Ian Cruz's report on GMA's '24 Oras Weekend' on Sunday.
Three impeachment complaints were filed against Duterte in December 2024, all of which were connected with the alleged misuse of confidential funds. The fourth impeachment complaint, endorsed by over one-third of lawmakers from the House of Representatives, was later on transmitted to the Senate.
The Supreme Court then ruled unanimously to declare that the Articles of Impeachment against Duterte as unconstitutional and imposed a one-year ban, as it said these violate the right to due process.
SC spokesperson Camille Ting noted, however, that the SC is not absolving Duterte from any of the charges against her, but any subsequent impeachment complaint may only be filed starting February 6, 2026.
The decision is in relation to the petition filed by Duterte and lawyer Israelito Torreon, among others, seeking to declare the Articles of Impeachment against her null and void.
The House of Representatives has since filed a motion for the SC to reverse its decision, saying it should be allowed to perform its exclusive duty to prosecute an impeachable official, and the Senate's to try to the case.
Duterte, for her part, entered a 'not guilty' plea in the verified impeachment complaint filed against her, which she called merely a 'scrap of paper.'

Flood control deals proposed to get P274.9 billion in 2026

The budget allocation for addressing the perennial flooding problem in the country has been trimmed in the proposed P6.793-trillion national budget for 2026 amid President Ferdinand 'Bongbong' Marcos Jr.'s scrutiny of flood control projects. 'For the flood control projects, what we have for the 2026 National Expenditure Program… the total is P274.926 billion,' Budget Secretary Amenah Pangandaman said at a press conference following the turnover of the 2026 NEP to the House of Representatives on Wednesday. The amount was divided between the Department of Public Works (DPWH, which will receive the bulk of the allocation at P272.333 billion, and the Metro Manila Development Authority (MMDA) with P2.593 billion. The proposed P274.9-billion allocation for flood control projects was lower compared with the about P350-billion earmarked in the 2025 General Appropriations Act (GAA). Pangandaman said the approved amount for flood control projects was proposed by the two agencies. The Budget chief further added that the flood control projects proposed by the DPWH and MMA had "proper planning and corresponding FS (feasibility studies) and studies." Pangandaman said the flood control projects may be expected to be completed and put up in the proper places. Marcos flagged a total of 6,021 projects amounting to more than P350 billion that did "not specify the exact type of flood control structures built, repaired, or rehabilitated.' 4Ps get P129.9 billion in proposed 2026 budget; AKAP, zero

The Pantawid Pamilyang Pilipino Program (4Ps), the government's flagship conditional cash transfer program for the poorest of the poor, has been allocated almost P113 billion under the P6.793-trillion National Expenditure Program for 2026, President Ferdinand "Bongbong" Marcos, Jr. said. The Ayuda para sa Kapos ang Kita Program (AKAP), the assistance program for minimum-wage earners that stirred some controversy over its P26-billion allocation in the 2025 General Appropriations Act, has been left out of the NEP for 2026, Budget Secretary Amenah Pangandaman said. According to Marcos' budget message, the Tulong Panghanapbuhay sa Ating Disadvantaged Workers (TUPAD) Program has been allocated P11 billion, while the Department of Labor and Employment's Integrated Livelihood Program has been proposed to receive P2.2 billion. Marcos said the allocation for 4Ps would provide various financial and social assistance that would improve the quality of life of 4,400,000 marginalized household beneficiaries. The said amount shall cover cash grants, rice subsidy, Enhanced Support Services Intervention (ESSI) grants, and cash grants for the first 1,000-day health monitoring during pregnancy until the child has turned two years old. The beneficiaries who comply with program conditions shall continue to receive educational and health grants, including the ESSI grants, as well as other social protection programs, such as, but not limited to, livelihood assistance and health services through PhilHealth. TUPAD is meant to provide emergency short-term employment for workers affected by economic displacement, disasters, and seasonality. The DILP, on the other hand, is seen to provide start-up capital, training, and equipment to individuals and groups who would like to establish microenterprises. The Department of Social Welfare and Development defines AKAP as a financial assistance program designed for minimum-wage and low-income earners. The program provides various forms of aid, including food, medical, funeral, cash relief, and rice assistance. 'Wala po 'yung AKAP sa budget ng DSWD,' Pangandaman said at a press briefing following the turnover of next year's proposed NEP to the House of Representatives. 'May natitira pa pong pondo from 2025, and like I mentioned a while ago, we received a total of P10 trillion proposal from agencies and given our limited fiscal space hindi muna natin siya sinama,' Pangandaman said. Senate adopts reso on open budget process
The Senate adopted in the plenary Wednesday a concurrent resolution seeking to establish transparency and accountability in the passage of the national budget. Senate President Francis 'Chiz' Escudero approved the motion to adopt Senate Concurrent Resolution No. 4, subject to style, after a series of interpellation of senators, with some proposing amendments. All 24 senators previously signed the concurrent resolution, which mandates budget documents, including all annexes and attachments, as may be applicable, be uploaded on both the websites of the Senate and the House of Representatives. In his sponsorship speech on Tuesday, Senate finance committee chairman Sherwin Gatchalian emphasized that the concurrent resolution reflects the Senate's commitment to accountability and earning the public's trust. 'Our vision for the 2026 budget is to create a budget that is effective, efficient, and lean, which will usher in a golden age of transparency and accountability that will open up the budget process and empower the public to understand the budget, increase their participation, and root the system of accountability in the people themselves,' Gatchalian said. He also said that granting public access to such documents would help ensure that the projects of each government agency are held to public account. 'Creating a culture of transparency and accountability for the benefit of the public is nothing extraordinary. It is our duty as servants of the people,' the senator added. The Department of Budget and Management (DBM) earlier on Wednesday submitted the P6.793-trillion 2026 National Expenditure Program (NEP) to both the Senate and the House of Representatives.
