
Delhi HC allows minor sexual assault survivor to terminate pregnancy

Justice Manoj Jain, therefore, directed the medical superintendent of AIIMS to terminate the over 26 weeks pregnancy of the girl, observing she was subjected to two sexual assaults.
The survivor, 16, and her mother moved court with their plea for abortion citing serious mental trauma.
The court directed AIIMS and its team of doctors to perform the procedure on the survivor on July 1 under the Medical Termination of Pregnancy (MTP) Act.
It came on record that the medical board was not in favour of allowing the termination of pregnancy in view of the advanced gestational age requiring most likely a cesarean section procedure which could adversely affect the girl's future reproductive health.
The medical board opined that the girl was otherwise physically fit.
The girl and her mother, however, insisted on not continuing with the pregnancy.
She moved the court after the doctors expressed their inability to proceed due to the statutory restrictions provided under the MTP Act, limiting such procedures to 20 weeks in ordinary cases and 24 weeks in certain categories such as rape survivors.
According to the girl's lawyer, the minor was sexually assaulted by a man during Diwali in 2024 but she did not disclose the incident to anyone.
The second incident took place in March when she was sexually assaulted by another person and the pregnancy was the result of this incident, the lawyer said.
She learnt about the pregnancy only when she went to a doctor with her sister and when her family members got to know, she confided in them about the sexual assault, leading to the filing of the FIR.
At the time of the FIR in June, the gestational age exceeded the prescribed 24-week limit.
The police arrested the accused of the March sexual assault incident whereas the man who assaulted her last year is yet to be nabbed, the court was informed.
The high court in its order recorded judgments, including that of the Supreme Court, in which pregnancy was allowed to be terminated in cases where gestational period exceeded 27 weeks and even of 33 weeks.
"The situation in this case is unfortunate. The girl was subjected to sexual assault for the first time on Diwali but she did not divulge about this to anyone and she was again subjected to sexual assault in March by another person," the court said.
The order continued, "It is not difficult for this court to comprehend and understand the grave mental injury inflicted upon the minor."
The AIIMS doctors, as a result, were ordered to maintain a complete record of the procedure aside from preserving the fetus tissue, which could be required for DNA identification and investigation purposes.
The court further directed the state authorities to bear all the expenses of the medical procedure, the girl's stay at the hospital and the expenditure of post-operative care.
"If the child is born alive, the medical superintendent of AIIMS along with state authorities shall ensure that every assistance is offered to such child and intimation will be given to the Child Welfare Committee," the court said.
Since the minor's mother wants to get the pregnancy terminated, she has no objection if the child is born alive and given up for adoption, the order added.

Before the establishment of this university, various regulatory bodies separately oversaw the disciplines of Ayurveda, Unani, Homeopathy, Naturopathy, Yoga, and Siddha (Ayush). Now, all 98 government and private Ayush colleges across Uttar Pradesh will come under the jurisdiction of Mahayogi Guru Gorakhnath Ayush University. Located in Pipri, Gorakhpur, the Ayush University has been constructed on 52 acres at an approved cost of ₹ 267.50 crore. It is envisioned as a premier centre for traditional medical education and treatment across Ayurveda, Unani, and Homeopathy. Once fully functional, it is expected to significantly boost medical tourism and the commercial cultivation of medicinal plants in eastern Uttar Pradesh. Chief minister Yogi Adityanath, who played a pivotal role in bringing the project to fruition, aims to promote Ayush systems of medicine and create new employment avenues for the youth and farmers. The university is expected to enhance local incomes by encouraging herb collection and medicinal plant farming. The foundation stone for the university was laid by former President Ram Nath Kovind on August 28, 2021. Chief minister Yogi Adityanath inaugurated the Ayush OPD on February 15, 2023. Recently, evening OPD sessions have also commenced, serving around 300 patients daily. Following the official inauguration, IPD (In-Patient Department) and Operation Theatre (OT) services will be made available. A 28-cottage Panchakarma unit is also ready to offer specialised therapy services. Meanwhile, plans are underway for a fifth university in Gorakhpur — a Forestry University, as announced by chief minister Yogi Adityanath. Land identification, syllabus design, and construction processes for the same are currently in progress.

Pocso: Nearly 50% arrested in Kochi aged below 25 yrs
Kochi: Data from Kochi city shows that nearly 50% of those arrested under child protection laws in the first half of 2025 are aged under 25 years, with experts suggesting consensual relationships between adolescents and young adults. Of the remaining 50%, a significant majority, mostly aged between 30 and 60 years, are alleged child predators accused of sexual exploitation. As per arrest records, out of the 19 accused who were arrested under the provisions of Protection of Children from Sexual Offences (Pocso) Act till May 2025, almost 10 were aged under 25 years. Of these, four were aged 23 years, two were 24 years and one each were 15, 18 and 20 years. The remaining accused were much older. Three of them were over 55, two over 45 and four were over 30 years. Experts say the rising number of young adults being booked under child protection laws is an emerging concern that warrants closer scrutiny, both in terms of legal interpretation and public awareness. He noted that in countries like the UK, sexual intercourse with anyone under the age of 16 was illegal, regardless of consent, and was classified as statutory rape. "Lowering the age of consent through legislation may open the door for actual predators to exploit minors," Varma said. "At the same time, lawmakers could consider allowing a scientific investigation in cases where the age gap between the accused and the victim is minimal. A thorough background check can determine whether the accused is a repeat offender or was in a genuine relationship with someone just a few years younger. Such a report, prepared by an expert, could help courts identify mild offenders and ensure punishment is proportionate," he added. In many cases where the FIR involves a consensual relationship, the charges often do not result in convictions. Advocate Sarun Mankara, who has appeared for the prosecution in several Pocso cases, said that when young adults were involved, there was a high likelihood of witnesses turning hostile. "When such cases come to court, if the complainant denies that any offence took place, it usually leads to an acquittal," said Mankara, adding, "This is quite common in cases involving mutual relationships." Varma said that the threat posed by actual predators remains a serious challenge in child protection efforts. "We need to ensure pre-emptive action in such cases," he said. "In Europe, there's a crime reference check system, which mandates that everyone — from teachers to school cleaners — undergo background screening before being allowed into a school campus. This helps prevent individuals with a history of paedophilia from gaining access to children. In addition, police forces are increasingly proactive online, posing as minors — sometimes as young as 10 or 12years — to bait and apprehend potential predators who target children through social media," Varma added. Experts suggest that the data calls for both legal nuance and stronger preventive frameworks to protect minors without criminalizing youth.
