Calcutta HC seeks affidavits from Centre, Bengal and Delhi govts on deportation of Bengali migrant family

The Calcutta High Court on Wednesday sought affidavits from the Union government, the West Bengal government and the Delhi government in connection with the arrest and alleged deportation of a Bengali-speaking migrant family from Birbhum district. The court move came on a habeas corpus petition filed by the relatives of the family.
The matter will be heard next on August 6.
A division bench of Justices Tapabrata Chakraborty and Reetobroto Kumar Mitra issued the directions after being informed that parallel proceedings on the same matter were pending before the Delhi High Court — details that had not been disclosed in the current plea.
Appearing for the petitioner, advocate Raghunath Chakraborty submitted that the whereabouts of the detained family remain unknown.
Delhi Police counsel Dhiraj Trivedi told the court that a writ petition had been filed in Delhi High Court challenging the deportation, but was dismissed after the deportation was carried out. 'They were deported in June, that is in the Delhi High Court order. The matter is pending in that High Court. They have suppressed the facts in this court,' he said.
Additional Solicitor General Ashok Chakraborty, appearing for the Union government, submitted: 'If the order of deportation is executed, how is there a habeas corpus?'
Senior advocate Kalyan Banerjee, representing the West Bengal government, said, 'Let them (the Centre) file how many Bengalis have been detained and how many Bengalis have been pushed back (into Bangladesh).'
The court expressed displeasure over the petitioners not disclosing that they had already approached the Delhi High Court.
After the order was dictated, Banerjee told the bench: 'Who will decide (who is to be detained)? The appropriate authority is not the police or constable. You cannot pick up someone just because they are speaking Bengali. There are procedures. These three or four cases are very alarming.'
The bench also orally asked during the hearing whether there was any basis to allegations that Bengali-speaking people were being picked up and deported from various states 'suddenly' in June, though no formal order was passed on this point.
The ASG submitted that under the Foreigners Act, individuals without valid passports or visas can be deported.
Responding to that, the Deputy Solicitor General told the court, 'After the Pahalgam attack, people in Kashmir were also rounded up, and everyone was released. People speaking Bengali were not picked up and deported. Hundreds were rounded up, but most were released.'
According to Bhodu Sheikh of Birbhum, his daughter Sunali Khatun, son-in-law Danish Sheikh, and their minor son were deported by officers of the K N Katju Marg police station under Delhi's Rohini police district on June 26.
He claimed the family had travelled to Delhi on May 5 and were detained on June 18. Anjela Bibi, a relative from Murarai in Birbhum, also alleged that the family — who worked as waste pickers — were picked up from Bengali Basti in Rohini's Sector 26, along with three others from Birbhum.
As per entries in a Delhi Police general diary, the detained persons allegedly told police they were from Bagerhat, Bangladesh. They were subsequently handed over to the Foreigners Regional Registration Office (FRRO), and later to the Border Security Force (BSF), before being deported.

A narrow lane towards the dargah of Hazrat Nizamuddin Auliya first leads to a tall nondescript white building before twisting towards the tomb of the famous Sufi saint. On Thursday evening, as scores of tourists and visitors flocked to the dargah for its famous Qawwali performance, a smaller, more somber group of men assembled in front of the tall white building, awaiting the time for the evening prayers. This is the Nizamuddin Markaz, also known as the Banglewali Masjid Markaz. Five years ago, the building was at the centre of a storm after the Tablighi Jamaat was accused of spreading Covid by organising an international congregation in Delhi. On Thursday, the Delhi High Court quashed charges in 16 FIRs and chargesheets filed in related cases involving 70 Indian citizens. The atmosphere at the Markaz remained almost nonchalant after the verdict. 'We are God's people. We don't bother with what happens on this earthly plane, we only care about what happens before life and after death,' said one person who wished to remain unidentified. In March 2020, a series of gatherings had been organised at the Markaz by the Jamaat. Over 3,000-odd people gathered at the mosque for the month-long events, with people coming from across the country and the world. However, on March 13, the Delhi government passed an order saying that gatherings of over 200 people for sports events, conferences and seminars will not be allowed due to the growing fears of the Covid-19 pandemic. By then, hundreds of people had already reached the Markaz and were accommodated inside. By the time the Janata Curfew was declared on March 22, the Markaz was in utter chaos over where to move the hundreds of people stuck inside. However, a day prior to the Janata Curfew being declared, the Ministry of Home Affairs (MHA) had already drawn up a list of 800 foreigners associated with Tablighi activities across the country. According to the MHA, it had received information of a Tablighi-associated Covid patient in Telangana by March 18. What followed was a rush to track all those who had congregated at Nizamuddin and spread out into the country. Medical screening of those at the Markaz started only on March 26, after the death of a Tablighi-associated Covid patient in Telangana. When the Delhi government eventually released its Covid health bulletin, it made a separate section indicating how many participants of the Tablighi gathering had tested positive. By March 30, the then Delhi CM Arvind Kejriwal had ordered an FIR against the organisers. The 70 named as accused across 16 FIRs were charged primarily under sections of the IPC, including criminal conspiracy, for allegedly accommodating foreign nationals in mosques and their homes during the pandemic from March 24-30, 2020. The FIRs had also listed 195 foreign nationals but they were not named as accused in most chargesheets — the magistrate court did not take cognizance of the remaining chargesheets on the principle of double jeopardy. Fuzail Ayyubi, who represented 44 attendants of the Tablighi in the Supreme Court, said, 'When amidst a pandemic that no one understood, an entire body of individuals was criminalised as being 'super-spreaders' and prosecuted criminally, we were able to see through the facade and know that no criminality could be attached at all. Today's judgment is a vindication of that belief in law and courts' adjudicatory role…'

The Calcutta High Court on Thursday allowed the main Opposition party, the BJP, to hold a rally and a public meeting in Siliguri on July 21, coinciding with the ruling TMC's annual mega Martyrs' Day rally in Kolkata. The bench of Justice Tirthankar Ghosh, however, also imposed conditions — the rally can be held between 11 am to 5 pm; a total of 10,000 people will be allowed to attend the event; the program has to be within the jurisdiction of Tin Bati Mor and Chunbhati Football Ground; and not more than 100 people should take part in the rally. Last week, the BJP had approached the Jalpaiguri Circuit Bench of the Calcutta High Court, challenging the decision of the Siliguri Police Commissionerate denying permission for a rally by the party in Siliguri town on July 21 to protest 'rising incidents of crime against women' in different parts of the state. The BJP had planned a rally to Uttarkanya, the state's north Bengal secretariat in Siliguri, but the court directed that it be held at a ground at Chunabhatti in the north Bengal city. The state government had argued that possible congestion could occur as large numbers of people would be travelling to Kolkata for the TMC's programme. 1 2 3 Bengaluru: The cabinet has rejected three proposed sites for a new nuclear power plant in the state and directed National Thermal Power Corporation (NTPC) to conduct a statewide study to identify a suitable location. NTPC had shortlisted a site each in Koppal, Raichur, and Vijayapura districts for the project but these have been shot down. Despite the rejection of sites, the cabinet agreed on the need for a nuclear power plant in the state, aligning with the Centre's renewed push for nuclear energy. Law and parliamentary affairs minister HK Patil said there were "several reasons" for the cabinet's decision but did not elaborate. "They [NTPC] must study all possible alternatives," he said. "We have decided to let them study the whole state and submit a report with a viable alternative." It set an ambitious target of achieving 100 gigawatts of nuclear power capacity by 2047, aiming to significantly reduce reliance on fossil fuels. NTPC is now expected to conduct a comprehensive study of potential locations across Karnataka and submit a fresh proposal to the state govt. The cabinet formally received the report of the Justice John Michael D'Cunha one-man inquiry commission investigating the June 4 stampede at Bengaluru's Chinnaswamy Stadium, which claimed 11 lives. However, a decision on the report was put off to the next cabinet meeting. The two-volume report was handed over to chief minister Siddaramaiah on July 11, following a detailed probe into the incident during Royal Challengers Bengaluru's IPL victory celebrations. The event saw a massive public turnout which led to a tragic stampede.
