No ground to declare polygamous candidate's election null and void: Bombay HC; upholds BJP MLA's victory

Noting that polygamy cannot be a ground to unseat a legislator, the
Bombay High Court
dismissed a petition demanding to declare
BJP MLA Rajendra Gavit
's victory in the 2024 polls void, saying "honest" disclosure about his marital status doesn't violate election rules.
A bench of
Justice Sandeep Marne
observed that Gavit, a member of the
tribal Bhil community
, where polygamy is not prohibited by custom, disclosed details of both his spouses in the election affidavit, including their PAN numbers and Income Tax return status.
"There may be cases where a candidate belonging to a particular religion, in which polygamy is permitted, has contracted multiple marriages.

"If the contention raised in the petition about impermissibility to add a column in the nomination form is accepted, then such candidates would never be able to contest any election," the bench noted in its order passed on Monday.
The petition, filed by social activist and Palghar voter Sudhir Jain, argued that Gavit's second marriage was invalid under the Hindu Marriage Act and that listing his second wife,
Rupali Gavit
, amounted to a false declaration.

However, Gavit contended that his disclosure was voluntary and truthful.
He asserted that there is no legal bar on a candidate providing such voluntary information, particularly when rooted in a tribal custom that allows polygamy.
The
high court
stated that Gavit has two spouses and accordingly disclosed related details, including their PAN cards and the status of filing
income tax returns
.
"The respondent (Gavit) has made true and honest disclosure about details of PAN and status of filing of Income Tax Returns of both his spouses in the form.
"Mere addition of a column to make a true and honest disclosure of information would not attract a ground for challenging the election," the court said.
Gavit contended that there is no prohibition or restriction on a candidate from making any voluntary disclosure of information.
The declaration of Rupali Gavit being his second wife, in fact, depicts his honesty, he stated.
Gavit claimed polygamy is permitted in the Bhil community where there is no restriction on second marriage.
The bench stated there was no averment in the petition as to how such disclosure violates the Election Rules.
"The act of the candidate of adding a column in the form to make a true and honest disclosure of the information would neither render the nomination form defective nor would amount to a violation of provisions of the Election Rules," Justice Marne said.
The bench said it was not necessary to delve into the validity of the second marriage at this stage.

Communist Party of India (CPI) State secretary R. Mutharasan said on Tuesday that the Bharatiya Janata Party (BJP) could not gain ground in Tamil Nadu by invoking Lord Murugan. Speaking at the launch of the logo for the CPI's 26th State Conference, to be held in Salem from August 15 to 18, Mr. Mutharasan said a special seminar, Velga Jananayagam, Veelga Fascism, would take place on the evening of August 16. INDIA bloc leaders, including DMK president and Chief Minister M.K. Stalin, are expected to take part in it. CPI national secretary D. Raja and other senior leaders are to take part at the conference that will discuss national and international political developments and pass political resolutions. Asked about BJP leaders claiming that parties in the DMK-led alliance would switch sides, Mr. Mutharasan said the DMK-led coalition was based on ideology and not on electoral considerations. 'The alliance has successfully contested in two Lok Sabha and other elections. It will remain a strong ideological front,' he said. Criticising the BJP's recent strategies, he said, 'The BJP, which has failed to win over the Tamil Nadu electors on various issues, is now trying to capitalise on Lord Murugan. Chief Minister Pinarayi Vijayan has accused the right-wing media of routinely stereotyping unionised labour as a millstone around the neck of industrial development while lionising predatory corporates as symbols of progress and social good. Inaugurating the 15th State conference of the Kerala State Headload and General Workers (CITU), Mr. Vijayan urged workers to give no chance to the anti-proletarian media to demonise them as villains and lionise exploitative employers as heroes and hapless victims of so-called labour militancy. Mr. Vijayan said neoliberalism and globalisation ushered in by the Congress and aggressively pursued by the Bharatiya Janata Party (BJP) had worsened inequality and weakened social welfare. 'It has pushed millions into poverty while concentrating the country's wealth among a small elite. Unemployment has reached its highest level, and the physical quality of life index has fallen sharply. India ranks 105th in the global poverty index. Labour rights were increasingly at risk under the Central government,' Mr. Vijayan said. Mr. Vijayan accused the BJP and Sangh Parivar of stoking communalism and sectarian rife in the secular polity to divert public attention from pressing livelihood issues and working-class woes. He said the BJP has single-mindedly targeted Kerala for its successful development and social welfare approach. Bid to strangulate Kerala 'The Centre has hauled down Kerala's borrowing limit to hamper infrastructure development. It has attempted to strangulate Kerala financially by slashing down its due from the divisible pool of taxes, reducing or delaying Central allocation for joint Union-State government projects, denying natural disaster relief and preventing Kerala from seeking disaster aid from foreign donor nations,' he said. Mr. Vijayan said Kerala's development model starkly contrasts with the BJP-ruled States. 'The very idea of a secular, liberal, progressive and social-welfare oriented State as epitomised by Kerala was an anathema to the Sangh Parivar and its notion of a Hindu majoritarian State where minorities are ranked as subaltern citizens. Hence, it is in the BJP's interest to retard Kerala's progress', he added. Attacks on minorities Mr Vijayan stated that, under the BJP's watch, the Sangh Parivar has increasingly targeted Muslims and Christians, including lynching them for their dietary habits and othering the minorities as fifth columnists. He said the international spirit of proletarianism and working-class unity were the sole bulwarks against the ascendancy of schismatic Sangh Parivar ideology and identity politics, including minority communalism.
