External Affairs Minister S Jaishankar on Friday said Indian fishermen continue to be arrested by Sri Lankan authorities because of an agreement signed during the Emergency period, which stripped them of fishing rights in certain sea areas, news agency PTI reported.
Speaking at an event organised by the BJP Yuva Morcha to mark 50 years of the Emergency, Jaishankar said the agreement would not have happened if Parliament had been working properly back then.
'No debate, no consensus'
'Big decisions were sometimes taken without any parliamentary debate during the time,' he said, highlighting the lack of democratic processes under the Emergency.
Referring to the ongoing issue of fishermen being detained by Sri Lankan Navy, Jaishankar said, 'We hear about our fishermen arrested by Sri Lanka. The reason is that an agreement was entered into during the Emergency under which the rights of the fishermen for fishing in some sea waters of Sri Lanka was abandoned.'
He said, if the Parliament had functioned genuinely, the matter would have been debated and such a decision would not have been accepted. 'The consequences of this decision are still visible in Tamil Nadu,' he said.
India's image suffered, says Jaishankar
Reflecting on the broader implications of the Emergency, Jaishankar said the world's perception of India as a vibrant democracy took a hit. 'I heard from my seniors in the foreign service how difficult it was to defend India after the murder of the Constitution and democracy by the imposition of Emergency,' he said.
He also shared personal memories from that period, mentioning police raids at Jawaharlal Nehru University hostels and his family's connection with anti-Emergency leaders such as George Fernandes.
Criticism of dynastic politics
In a veiled attack on the Congress leadership, Jaishankar said the roots of the Emergency lay in prioritising familial power over national interest. 'An Emergency situation arises when the 'family' is kept ahead of the country,' he said. 'Some people keep the copy of the Constitution in their pockets but have other feelings in their hearts,' he added, in an apparent reference to Congress leader Rahul Gandhi.
The minister stressed on the need for an informed and empowered citizenry to prevent any repeat of such an authoritarian phase. 'An empowered public would never let it happen,' he said.

Union Minister Kiren Rijiju said on Thursday that the Union Cabinet has decided to observe June 25 as 'Samvidhan Hatya Divas' (Constitution Killing Day). The decision marks the 50th anniversary of the Emergency and aims to remind the nation of the excesses committed during that period.
He also criticised the Congress party, accusing it of hypocrisy. 'Those who 'murdered' the Constitution are flaunting a copy of it,' he said, taking a dig at the opposition.
Recalling the imposition of the Emergency on the night of June 25, 1975, the minister said that during that period, opposition leaders were jailed, media was silenced, and civil liberties were severely restricted.

Assam to tighten Aadhaar rules to curb illegal immigrants: CM Sarma
Guwahati: To bar illegal immigrants from acquiring Aadhaar cards, the BJP led government in Assam is planning to make the rules for issuing Adhar cards and birth and death registration stricter. Aadhaar cards to adults (above 18 years) will now be issued by Deputy Commissioner only. Assam chief minister Himanta Biswa Sarma while talking in Guwahati, 'Very soon, we will implement a decision where Aadhar cards to adult citizens will be issued only by DCs. This will ensure that no illegal immigrant can get an Aadhar made, and we can track and push them back easily.' He added, 'Last night we pushed back 20 more Bangladeshis as part of our ongoing efforts to detect and push back illegal infiltrators. The decision to toughen Aadhaar issuance rules will only aid our efforts in this direction'. Sarma said that the government is contemplating to make the rules regarding issuance of Aadhar card stricter to ensure that only genuine citizens can acquire the vital document, categorized as national identity card. 'We have discussed the issue of making the rules for Aadhaar card stricter in today's cabinet. We are going to discuss it further in the next cabinet.' 'In Assam, we are going to stop issuing Aadhaar cards for the adults (Those above 18 years) now. It has been two years, and we have given Aadhaar cards to the adults already. Now the government will continue issuing Aadhaar cards to the newborns and children only. In case of adults who are yet to get an Aadhaar card, he or she must approach the District Commissioner, who will have the authority to issue the Adhar card to the adult population,' Sarma said. As we are going to stop issuing Aadhaar cards to adults, no foreigners who enter the state afresh, would not be able to get an Aadhaar card,' he said. Last year Assam government has observed that at least four districts of Assam having Aadhaar enrolment more than the population. Sarma had said in at least four districts, the number of Aadhaar cardholders has surpassed the population. "In Barpeta, 103.74% of the population have Aadhaar cards, in Dhubri 103.48%, in Morigaon 101.76%, and in Nagaon about 100.86% have obtained Aadhaar cards. This raises concerns, as it suggests that suspected foreign nationals may have managed to procure the cards."

The shooting of the film, which also stars Diljit in a key role, is currently underway at the National Defence Academy in Pune. 'We write to you with deep concern regarding the shooting permission reportedly granted to the production team of the film 'Border 2' at the National Defence Academy (NDA) premises in Pune," the FWICE letter to the ministers said. The film body mentioned that it has decided to officially boycott Diljit Dosanjh, who is collaborating with Pakistani actress Hania Aamir in his upcoming movie, Sardaar Ji 3. 'It is important to bring to your notice that the said film (Border 2) features actor Diljit Dosanjh, who has been officially boycotted by FWICE owing to his involvement with individuals and content that have deeply disrespected Indian sentiments, especially by associating with Pakistani artists known for their anti-lndia views, and participating in projects filmed in sensitive border locations like Pahalgam immediately following terror incidents targeting our armed forces," the letter added. 'The NDA, being a national symbol of military training and sacrifice, must not be used as a backdrop for a film involving an actor who is currently under public and professional boycott due to acts that undermine the spirit of national unity and hurt the sentiments of our defence community," it continued. In this regard, FWICE asked the Union Ministers to withdraw shooting permission of Border 2 to 'ensure that the integrity of sensitive defence installations is not compromised or associated with individuals facing legitimate public outrage." Previously, FWICE also wrote a letter to the makers of Border 2, expressing disappointment with the casting of Diljit Dosanjh in the movie. In its letter, addressed to Bhushan Kumar, Chairman & Managing Director, T-Series, JP Dutta, and Nidhi Dutta Producers, JP Films, and director Anurag Singh, FWICE mentioned that it is 'deeply disappointed" with the casting of Diljit Dosanjh in Border 2. Diljit Dosanjh has been accused of hurting national sentiments for casting Pakistani actress Hania Aamir in Sardaar Ji 3, especially after the shocking terror attack in Pahalgam earlier this year. Recently, the Punjabi singer-actor also broke his silence on the controversy and told BBC Asian Network that the project was completed before any of the current political tensions surfaced. The RSS on Thursday called for reviewing the words 'socialist' and 'secular' in the preamble of the Constitution, saying they were included during the Emergency and were never part of the Constitution drafted by B R Ambedkar. Addressing an event organised at New Delhi on 50 years of the Emergency, RSS general secretary Dattatreya Hosabale said, 'The preamble of the Constitution Baba Saheb Ambedkar made never had these words. During the Emergency, when fundamental rights were suspended, Parliament did not work, the judiciary became lame, then these words were added.' Talking to reporters, Singh said, 'I think any right-thinking citizen will endorse it because everybody knows that it was not part of the original Constitution written by Dr Ambedkar and the team.' It is a question of preserving democratic and constitutional values,' Singh said, adding that those who are raising the Constitution book are the biggest violators of it. Replying to another question on whether the BJP is going to bring a bill in Parliament regarding this, he said, 'I did not say that. I am not accredited to say that.' He further said just yesterday, Dattatreya ji raised a demand for the removal of these words. 'These were not part of Dr Ambedkar's original Constitution. These words are not the legacy of Dr Ambedkar. 'Ambedkar gave us the best Constitution in the world. If these terms were not his idea, then whose ideology was it that inserted them?' Taking a dig at the Congress, he said the term of the Lok Sabha and state assemblies was extended under these clauses from five to six years during the Emergency. 'This provision was misused in Jammu and Kashmir as well. Sheikh Abdullah extended the term of the Jammu and Kashmir Assembly to six years. 'When Morarji Desai became prime minister after three years, he reversed this provision at the national level. However, using Article 370, this change was never implemented in Jammu and Kashmir,' he said. The Union minister further said while all other assemblies in the country reverted to a five-year term, the J-K Assembly continued with a six-year term until August 5, 2019, when abrogation took place. 'The Jammu and Kashmir government not only misused the Emergency provisions, they misused them twice by invoking Article 370,' he said. Hosabale said discussions were held on this issue later, but no effort was made to remove them from the Preamble. So whether they should remain in the Preamble should be considered, he added. The suggestion from the RSS' second senior-most functionary to consider removing the two terms came as he hit out at the Congress for its Emergency-era excesses and demanded an apology from the party. Lambasting the Congress for showcasing itself as the champion of Independence, he said, 'I can say this with full confidence that no matter how many times the Congress beats the drum about the Constitution or how loudly it calls itself the party of freedom fighters, the truth is that the Congress never demanded independence. I am saying this with all the confidence at my command.' He further said until 1930, there was no document or record in which the Congress had demanded that India be given independence or had raised the slogan of complete independence. 'Even post-1930, the Congress was only demanding home state, home rule or dominion status. When Bhagat Singh was demanding complete independence, the Congress was still only talking about home rule. It was only in 1931, at the Lahore session of the Congress, after the hanging of Bhagat Singh, that the first resolution was passed demanding complete independence,' he said. It was also done in the wake of high emotions running among youth after the hanging of Bhagat Singh, he said. Singh said the resolution included the demand for independence, which means Congress only truly demanded freedom 17 years before it was achieved. 'So, if we go by that, Congress fought for India's independence only for 17 years,' he said. Lashing out at the Congress for the imposition of the Emergency, he said Indira Gandhi, in the darkness of night, woke up then president Fakhruddin Ali Ahmed from sleep to impose the Emergency. 'A specific 38th constitutional provision was used at that time so that no one could approach the court.' He said subsequently, a series of amendments were passed, among which the most notorious were the 42nd and 43rd Amendments. 'It was under these amendments that the words 'secular' and 'socialist' were inserted into the Constitution,' he said, adding that just on Thursday, Hosabale raised a demand for the removal of these words.
