Nainital (U'khand), May 2 (PTI) The Uttarakhand High Court pulled up the local municipal authorities here on Friday for issuing notices for the demolition of the residence of an elderly man from the minority community accused in the alleged rape of a minor.
The matter was mentioned in the court on behalf of the rape accused's wife, describing the demolition notices as instances of 'bulldozer justice' that went against the orders of the Supreme Court.
The petitioner's lawyer also complained before the court against harassment for filing a case in favour of the accused.
The Nagar Palika, Nainital tendered an unconditional apology before the court for issuing such notices to 62 people, including the accused, and said those will be withdrawn.
The matter will now be heard on Tuesday.
The court said the Nagar Palika executive officer's action amounted to contempt of an order of the Supreme Court.
It also said that police should not be pushed to their limits.
Quoting the wife of a naval officer killed in the recent Pahalgam terror attack, who has said anger should not be vented on Muslims or Kashmiris in reaction to the incident, the court said the citizens of Nainital must follow her example.
They should not vent their anger on the community or the accused, it said.
Nainital's Senior Superintendent of Police (SSP) Prahlad Meena joined the hearing via video-conferencing, while both the executive officers of the Nagar Palika appeared in the court in person.
The alleged rape of the 12-year-old girl by the 75-year-old accused, Osman, sparked communal tension in the town on Wednesday, with Hindu outfits taking to the streets and vandalising shops owned by members of the minority community.
The protesters raised anti-Pakistan slogans and damaged vehicles parked outside the shops. They also hurled stones towards a mosque.
The situation was brought partially under control with the arrest of the accused but tension persists in the town, with a massive police deployment to prevent further escalation.
The high court also asked how so much damage could be inflicted during communal tension in an area that was so close to the Kotwali.
On angry lawyers trying to assault the accused as he was being taken to a court dealing with cases lodged under the Protection of Children from Sexual Offences (POCSO) Act in Haldwani on Thursday, the bench also asked why the area was not cordoned off in anticipation. PTI COR ALM RC

In a broad synopsis of the country's security scenario, the Press Information Bureau (PIB) on Wednesday shared some data and a summary of various defence-related developments in the past 11 years, titled 'Transformation of India's Defence and Internal Security Posture'. "Unlike in the past, India under the present government has become a global force to reckon with, a nation that speaks on issues from a position of strength," it says. The government said India has adopted a "firm and clear approach towards cross-border terrorism", adding that the pattern of action over the last decade reflects this policy. The most recent and defining operation came in May 2025 with Operation Sindoor. In response to the killing of civilians in Pahalgam, "India gave its armed forces full freedom of action", the synopsis says. Using drones and precision munitions, they struck nine terrorist camps in Pakistan and Pakistan-occupied-Kashmir. More than 100 terrorists were eliminated, including individuals linked to the IC814 hijacking and the Pulwama attack. Pakistan attempted retaliatory strikes through drones and missiles, but Indian counter-drone systems neutralised them, it adds. In his 79th Independence Day address, Prime Minister Narendra Modi described Operation Sindoor as "a new normal", making it clear that "India will respond with full force whenever terrorism threatens its citizens," the synopsis says. The shift has been marked by "greater clarity of purpose, stronger deterrence, and a sustained drive for self-reliance," the synopsis says. This government has consistently underlined that "national security is non-negotiable", and to ensure this security, India will build its own capacity and preparedness. This has resulted in a "more confident, modern, and proactive approach to challenges, both external and internal". it adds. Firm responses to terrorism, the clear articulation of new normal with Pakistan and futuristic initiatives like the Sudarshan Chakra Mission underscore a "forward-looking security doctrine," the government asserted. India's defence and internal security posture under the Modi government reflects a "decisive shift towards strength, clarity, and self-reliance". With record investments in defence, rapid growth in indigenous production, bold reforms, and the adoption of emerging technologies, India has transitioned from being a major importer to a rising global exporter of defence equipment, it added. "India's defence expenditure has steadily increased under the present government, rising from Rs 2.53 lakh crore in 2013-14 to Rs 6.81 lakh crore in 2025-26," the PIB synopsis says. "The focus is no longer only on acquiring weapons but also on building domestic capacity. In 2024-25, defence production touched a record Rs 1.50 lakh crore, more than triple the 2014-15 level," it adds. Fighter jets, missile systems, artillery systems, warships, naval vessels, aircraft carriers and a lot more are now being made in India, underlining how strongly "self-reliance and deterrence have become the cornerstone of national security," the government said. Defence exports grew thirty-four times over the last decade, reaching Rs 23,622 crore in 2024-25. Indian equipment is now exported to over 100 nations, including the United States, France, and Armenia, it said. The synopsis also shared data related to indigenisation efforts. The Supreme Court on Wednesday said that the power of the governor to permanently withhold assent to bills would leave the state government, which is elected with majority, at his 'whims and fancies'. 'Would we not be giving total powers to the governor to sit in over an appeal. The government elected with the majority will be at (the) whims and fancies of (the) governor,' Chief Justice of India(CJI), Justice B R Gavai, said. The court was hearing the maintainability of the reference made by President Droupadi Murmu under Article 143. The reference was concerning the April 8 ruling of the top court that set timelines for governors and the President to grant assent to bills passed by the legislature. In the April 8 judgment, a bench of Justice J B Pardiwala and Justice R Mahadevan invoked its special powers under Article 142 of the Constitution to fix deadlines for the President and governors to act on state bills. Replying to the query of the CJI, Solicitor General Tushar Mehta, appearing for the Centre, told the Constitution Bench of CJI B R Gavai, Justice Surya Kant, Justice Vikram Nath, Justice P S Narasimha, and Justice Atul S Chandurkar that everyone derives power from the Constitution. On the powers of the governor under Article 200, Mehta said the governor has four options- assent to the bill, withhold assent, reserve the bill for consideration of the President or send it back to the legislature. He said that when the governor withholds assent, the bill falls through. Article 200 of the Indian Constitution outlines the governor's powers regarding assent to bills passed by the state legislature. If a bill is returned, the legislature can pass it again with or without amendments, and the governor is then bound to give assent. The bench, however, remarked that the governor has to communicate his or her decision and that the focal point of the debate would be whether withholding is temporary or permanent. Mehta said the power to withhold is to be used rarely and only in the first instance, as it leads to the death of the bill. 'The governor is not just a postman. He represents the Union of India, appointed by the President. The President is elected by the entire nation by way of the entire election and that is also a way of democratic expression,' Mehta said. After the April 8 judgment, the President invoked Article 143(1) of the Constitution of India to consult the Supreme Court. This Article, commonly referred to as the power of 'Presidential Reference', empowers the President of India to seek the Supreme Court's opinion on questions of law or fact of public importance. President Murmu, on May 13, posed 14 questions to the Supreme Court of India on several aspects of law, including the ambit of the powers under Article 142. In response, the states of Kerala and Tamil Nadu filed an application questioning the maintainability of the reference. It urged the Supreme Court to return the reference unanswered and said it was an attempt by the Centre to indirectly overrule binding judgments without disclosure. Meanwhile, the central government supported the reference, arguing that the power of governors and the President to act on bills cannot be bound by judicial timelines. The hearing will continue on Thursday.

Dhaka's foreign ministry alleged that offices of the outlawed Awami League, led by former Prime Minister Sheikh Hasina, had been 'reportedly established' in New Delhi and Kolkata. 'This development also risks upholding the good-neighbourly relations with India driven by mutual trust and mutual respect, and lends serious implications for the political transformation underway in Bangladesh,' the ministry said. It further claimed that several senior Awami League leaders 'absconding in criminal cases in Bangladesh on account of grievous crimes' were residing in India, and that a 'public outreach' event was planned at the Press Club of India in New Delhi on July 21. 'Such political activity against the interests of Bangladesh, particularly by absconding leaders of a banned political party, is an affront to the people and the State of Bangladesh,' the statement added, urging India to take 'immediate steps to prevent any anti-Bangladesh activity.' In response, External Affairs Ministry spokesperson Randhir Jaiswal said: 'The Indian government is not aware of any anti-Bangladesh activities by purported members of the Awami League in India or of any action that is contrary to Indian law.' He added that India does not permit political activity against foreign nations on its soil. 'The press statement by the interim government of Bangladesh is thus misplaced,' he said, reiterating India's call for 'free, fair and inclusive elections' in Bangladesh 'to ascertain the will and mandate of the people.' The escalating exchange comes amid already strained ties between the two neighbours. India has imposed trade restrictions on Bangladeshi exports through land ports, citing Dhaka's non-tariff barriers. Delhi has also repeatedly raised concerns over attacks on Hindu minorities in Bangladesh. Tensions have been further complicated by Dhaka's request for the extradition of Hasina, who fled to India in August 2024 and has since lived in self-imposed exile.
