High Court orders rapper Caprice to archive 31 defamatory Instagram posts on entrepreneur
Lawyer Abdul Hakeem Aiman, who represented Muhammad Asyraf, said Judge Datuk Anand Ponnudurai made the decision after allowing an application for an ex-parte ad-interim injunction in a suit filed by the stepson of Biduanita Negara, Datuk Seri Siti Nurhaliza Tarudin against Caprice, whose real name is Ariz Ramli, 39.
'All publications issued by the defendant (Caprice) relating to or referring to the plaintiff (Asyraf) must be archived starting today until the disposal of the inter-parte injunction application which will be heard on Sept 2,' the lawyer told the media after the ex-parte injunction hearing proceedings which took place in chambers.
Meanwhile, Abdul Hakeem said that so far the defendant has not filed a statement of defence to respond to the suit.
Muhammad Asyraf, 33, filed the suit on August 4, claiming that Caprice had published 31 allegedly defamatory posts against the plaintiff on his Instagram from July 30 to August 2.
The plaintiff claimed that the defamatory posts, among other things, meant that the plaintiff was a disgrace for inviting Murad Zaidi, who was his personal trainer, on an Audio Siar (Podcast), simply to give the man a chance to defend himself via social media, while ignoring the injuries suffered by the victim due to the man's actions.
'I invited Murad so that he could share his experience running a gym and the challenges he faced, as well as provide an explanation for Murad's statement via Instagram which denied all the allegations against him and his family,' said Muhammad Asyraf in the suit.
Muhammad Asyraf said the posting also meant that the plaintiff was the son of Datuk Seri Khalid Mohammad Jiwa or Dato K who is the husband of Siti Nurhaliza and in that capacity the plaintiff had abused money, power, influence and family ties to supposedly trap the defendant.
According to him, although he had decided not to broadcast the full episode of Murad Zaidi as Caprice wanted, Caprice still continued to attack him.
He said Caprice's reckless and irresponsible actions had caused the plaintiff to be insulted and hated by the public in addition to dragging Muhammad Asyraf's father into the dispute and giving an untrue and shameful image.
In this regard, he sought an injunction to prevent Caprice, its employees, representatives or agents from publishing, distributing, spreading or repeating defamatory postings whether oral or written against him on any social media platform and to delete the postings on any social media platform within 24 hours from the date of judgment.
The plaintiff also requested the defendant to make a public apology via video and publish it on all of the defendant's social media accounts, in addition to claiming general damages, aggravated damages, costs and other relief deemed appropriate by the court. — Bernama

SINGAPORE, Aug 20 — As vaping gains ground despite being illegal, companies here are grappling with how to enforce workplace bans. Some have opted for zero tolerance while others rely on warnings or internal whistleblowing, CNA reported today, adding that enforcement remains uneven. International education group EtonHouse is among those that have codified their stance, spelling out disciplinary action including termination in its employee handbook. 'Vaping is illegal in Singapore, and EtonHouse takes compliance with local laws seriously,' a spokesman told the Singapore-based news agency. Other firms such as Busy Bees, Red Crowns Senior Living and several food and beverage outlets said vaping is banned on their premises, with staff reminded to use designated smoking areas if they wish to smoke. A logistics worker recalled her manager vaping during video calls, while another communications professional said her 'biggest boss' frequently vaped indoors. 'If the top guy is already doing it, then everyone else who vapes would also just do it without any fear of consequence,' one employee who asked to be named only as Lim was quoted as saying. The Ministry of Manpower said vaping is an offence under the Tobacco Act and encouraged companies to set human resource policies to deal with offenders, including disciplinary measures. Industry groups such as the Association of Small and Medium Enterprises and the Singapore National Employers Federation have urged members to review handbooks and align workplace rules with national efforts. Both organisations said they had received queries from firms struggling with staff who continued vaping despite counselling. Public agencies have also drawn a line. The Public Service Division said officers found vaping will face internal disciplinary action on top of penalties imposed by the Health Sciences Authority or the courts. Banks such as OCBC similarly warned that staff risk disciplinary consequences if caught. Lawyer Jennifer Chih said workers can report offenders to the HSA anonymously, though many still fear retaliation.

Unemployed man who torched MBJB lorry faces five years of prison, RM6,000 fine
JOHOR BAHRU, Aug 20 — The unemployed 31-year-old man, who torched a MBJB tow lorry in anger last week, was handed down a prison term and fine at the Sessions Court here today. The accused, Wan Muhammad Nasrul W Ahmad, was handed down five years and a fine of RM6,000 by Sessions Court Judge Thalha Bachok @ Embok Mok, in addition to a jail term of six months if he fails to pay the fine. Wan Muhammad Nasrul, who pleaded guilty during yesterday's proceedings, was today brought back to the same court for the viewing of the closed-circuit television (CCTV) footage of the incident. After the charge was read out again today, the accused maintained his guilty plea of using petrol with intent to cause destruction by burning a tow truck belonging to MBJB, causing a loss of RM24,000 at the council's vehicle storage depot at Lot 1, Johor Bahru Waterfront here at 11.07am last Friday. In an appeal before the sentence was handed down, Wan Muhammad Nasrul, told the court that he had no money because he was just still looking for a job and had many financial commitments. Deputy Public Prosecutor Siti Fatimah Mamu, in her argument, said that although the accused gave the excuse of being angered as he was unable to pay, the act of burning a tow truck in a public area could clearly affect safety.
