Supreme Court To Hear Plea On J&K Statehood Restoration On August 14
The Supreme Court would on Thursday hear a plea for the restoration of statehood to Jammu and Kashmir.
A bench of Chief Justice of India B R Gavai and Justice K Vinod Chandran is likely to hear the matter, according to the causelist.
On December 11, 2023, the Supreme Court unanimously upheld the revocation of Article 370, even as it ordered that assembly elections be held in Jammu and Kashmir by September 2024 and its statehood be restored "at the earliest".
Last year, a plea was filed in the top court seeking directions to the Centre for the restoration of statehood to Jammu and Kashmir within two months.
The application was filed by Zahoor Ahmad Bhat, an academician, and Khurshaid Ahmad Malik, a socio-political activist.
"It is submitted that the delay in the restoration of statehood would cause serious reduction of democratically elected government in Jammu and Kashmir, causing a grave violation of the idea of federalism which forms part of the basic structure of the Constitution of India," the application said.
The assembly elections and the Lok Sabha polls were conducted peacefully in Jammu and Kashmir without any incident of violence, disturbance or any security concerns being reported, it said.
"Therefore, there is no impediment of security concerns, violence or any other disturbances which would hinder or prevent the grant/restoration of the status of statehood to Jammu and Kashmir as had been assured by the Union of India in the present proceedings," the plea said.
The non-restoration of the status of statehood of Jammu and Kashmir, the plea said, would result in a lesser form of elected democratic government to the state, particularly given legislative assembly results were declared on October 8, 2024.
Despite the supreme court's directions for the restoration of statehood to Jammu and Kashmir "at the earliest and as soon as possible", no steps have been taken by the Centre to provide any timeline for the implementation of such directions, it claimed.
"Jammu and Kashmir is being operated as a Union Territory for a period of almost five years now, which has caused many impediments and grave losses to the development of Jammu and Kashmir and has affected the democratic rights of its citizens," the plea added.
In its December 2023 verdict, the supreme court held that Article 370, which was incorporated in the Indian Constitution in 1949 to grant special status to Jammu and Kashmir, was a temporary provision. The President of India was empowered to revoke the measure in the absence of the Constituent Assembly of the erstwhile state whose term expired in 1957, the court said.

Narayan Chandra Maiti: I went underground to evade arrest, hid in jute fields
Today, the nation marks its Independence Day. But 101-year-old Narayan Chandra Maiti, a resident of Chakdurgadas, a remote village in West Bengal's East Midnapore district, is still fighting a legal battle in the Calcutta high court to get a pension under the Swatantrata Sainik Samman Pension Scheme.'I had to go underground to evade arrest. I used to hide in jute fields. But one day when I was hiding in an abandoned village house, a villager recognised me and informed the police. I was arrested. Later I got bail,' he participated in the Quit India Movement of 1942 under the leadership of Sushil Kumar Dhara, freedom fighter who was later elected as an MLA in the West Bengal assembly and a Lok Sabha MP. A certificate given to Maiti by Dhara in 1981, states that between 1942 and 1944, Maiti was a worker of the government styled Tamralipta Jatiya Sarkar and a soldier of its militia.'Several decades have passed since we gained independence. But there are many freedom fighters who are yet to get their due respect. There are many like me who are still fighting to get a freedom fighters' pension,' said Maiti. Rahul Gandhi accused of making false statements in Savarkar defamation proceedings
A perjury application has been filed in the Special MP/MLA Court in Pune against Congress MP and Leader of Opposition in the Lok Sabha Rahul Gandhi, accusing him of misleading the court in a defamation case over his remarks on Vinayak Damodar 'Veer' Savarkar, made in London. The application has been filed by Satyaki Savarkar, the grandnephew of Veer Savarkar, through advocate Sangram Kolhatkar. It alleges that Mr. Gandhi falsely claimed in a 15-page pursis, or statement to the court, on July 29 that he had not received the defamatory video which forms the crux of the complaint. The plea states that Mr. Gandhi's advocate had acknowledged receipt of the documents, including a CD containing the speech, on May 9. Pen drives and CDs According to the application, Mr. Gandhi also admitted in his reply to having received a pen drive containing the video uploaded on YouTube but claimed that it was non-functional. A new pen drive was later provided and operated in court in the presence of his advocate. The application says that Mr. Gandhi still alleged non-receipt and filed a 'false pursis.' It further points to another application filed by Mr. Gandhi's advocate on May 28, admitting receipt of the pen drive but refusing to operate it, citing possible malware. The pen drive is currently in Court custody. The plea terms these actions a 'deliberate and malicious attempt to deceive, mislead, and make false statements before the court', arguing that such conduct from a constitutional office-holder is 'serious and unbecoming'. Unnecessary delays Speaking to The Hindu, the advocate Mr. Kolhatkar said, 'Multiple times we have handed him over the speech document, we even provided him the link, transcript of the entire speech that was around 17 minutes long. We have also submitted news reports of the speech. We believe they must have misplaced them again and again because they keep saying they cannot access the CD, then when we gave them the file in a new pen drive, they said it was corrupt, then another fresh pen drive was provided to them and this time they said the pen drive might contain malware and may damage their computer system.' He added, 'For so long, we have ignored each and every criticism but now enough is enough. We are compelled to file the perjury because we are fed up with their excuses. We want a fair trial. The case is going on since 2023 and the trial has not even started. So much time and money has been wasted, including the court's time.' Milind Dattatraya Pawar, the advocate representing Rahul Gandhi, countered, 'None of the files in the form of CD and pen drives provided by Satyaki Savarkar works. They provided us the copy of the London speech in a CD which has never worked. The pen drives too do not work. We will file our reply on September 10.' The court is scheduled to hear the matter on September 10, 2025.
