Former lecturer sentenced to 10 years for culpable homicide of husband

SEREMBAN: A former lecturer was sentenced to serve 10 years in jail by the High Court here after she pleaded guilty to a charge of causing the death of her husband.
Lau Seck Yan, 58, did not contest the charge under Section 304(a) of the Penal Code for culpable homicide not amounting to murder after it was read to her before judge Rohani Ismail on Monday (May 26).
Earlier, her counsel, Kitson Foong, told the court that the Attorney General's Chambers had accepted the defence's representation to review the original charge.
Lau was initially charged under Section 302 of the Penal Code for murdering her 55-year-old husband, Poh Seng Hiap.
Offenders can be sentenced to death or jailed between 30 and 40 years and whipped upon conviction.
She had claimed trial when charged on Jan 28, 2022.
Lau, who contested as an Independent candidate in the Port Dickson by-election in 2018, allegedly committed the offence at their home at the Rasah Kemayan Golf and Country Township near here between 3.30pm and 4.30pm on Jan 23, 2022.
Poh, an accountant, was reportedly stabbed in the chest and abdomen.
The amended charge under Section 304(a) carries a penalty of up to 30 years' imprisonment and a fine upon conviction.
Foong told the court that Lau was remorseful and regretted the incident.
"It was a tragedy which unfolded from a disagreement between a husband and wife and escalated into a fight.
"My client has had a chance to reflect on this while she was in prison for the past three years.
"All she wants is to be able to go home to her four daughters and an 88-year-old father," he said.
Foong said Lau had also been active in social work as a Buddhist association's president.
This was also the first time she had run afoul of the law.

'The statement also threatens the safety and dignity of the victim's family and the slandered individuals,' he said. Jinori said he identified the post on a Facebook account on July 30, which alleged Mohd Arifin's child was involved in the incident. 'Mohd Arifin's child never attended the school in question. This accusation is completely untrue and could create negative public perception,' he explained. He urged authorities to investigate the Facebook account, which also claimed the student was the granddaughter of the Sabah Head of State and the child of Mohd Arifin. Both Banjimin and Jinori requested legal action under Section 233 of the Communications and Multimedia Act 1998, Sections 499–500 of the Penal Code (defamation) and Section 504 of the Penal Code (intentional insult to provoke breach of peace). They further called on the Malaysian Communications and Multimedia Commission (MCMC) to act against the account owner and those spreading the defamatory content. Besides the named account, they identified several others uploading identical content and have submitted details to relevant parties. The leaders hope all state and federal authorities, including cyber law enforcement agencies, will take appropriate measures to protect the reputation and safety of the slandered parties, especially concerning the dignity of state leaders and the institution of the Sabah Head of State.

KUALA LUMPUR: Fear of missing her flight led a Chinese national to injure an immigration officer during a departure inspection at Kuala Lumpur International Airport (KLIA) on Wednesday. A source said that at the time of the incident, the woman was with family members, including her two children, at the immigration counter. "The woman and her family arrived late at the immigration counter as they were rushing to catch their flight home to Pudong, China, at 7.25pm. "At the counter, the woman was asked to step aside for further checks as there was no record of her entry into Malaysia," the source said. According to the source, anger and fear of missing the flight caused the woman to suddenly create a commotion by raising her voice, pulling the headscarf of the officer on duty, and forcefully pushing the officer's head against a pole in front of the counter. "The woman was detained after the officer sought assistance from other officers on duty," the source added. Meanwhile, Selangor police chief Datuk Shazeli Kahar, when contacted, confirmed this. "Yes… the delay was due to the need for further checks, which angered the woman. "She and her family were in a hurry as they feared missing their flight," he said. Yesterday, the Chinese national was arrested for acting aggressively and injuring an immigration counter officer during a departure inspection at KLIA. The incident occurred at about 7.40pm at the KLIA Terminal 1 Departure Hall when four Chinese nationals — two adults and two children — were undergoing immigration departure checks. The Chinese national is being investigated under Section 186 of the Penal Code (obstructing a public servant), Section 332 (causing hurt to a public servant), and Section 353 (using criminal force against a public servant).

Penang police chief Datuk Azizee Ismail stated that the video included statements that could incite public alarm and disrupt order. A report was filed in Bukit Mertajam on Aug 12 regarding the video, prompting an investigation under the Sedition Act 1948 and Penal Code. Azizee confirmed that Bukit Aman's Special Crime Investigation Unit has taken over the case. Two police reports have been lodged so far in connection with the viral video. The Facebook account in question is believed to belong to UMNO Youth Chief Datuk Dr Muhamad Akmal Saleh.
