Husband's Extramarital Affair Not Cruelty, Abetment Of Suicide: Delhi High Court

The Delhi High Court on Tuesday said a man's extramarital affair does not amount to cruelty or abetment of suicide unless shown it harassed or tormented the wife.
Justice Sanjeev Narula said an extramarital relationship was not a ground to implicate the husband for dowry death in the absence of a nexus between the alleged relationship and dowry demand.
The court, as a result, granted bail to a man, who was arrested in a case under Sections 498A (cruelty)/304-B (dowry death) aside from Section 306 (abetment of suicide) of IPC, following the unnatural death of his wife in her matrimonial home on March 18, 2024, within nearly five years of marriage.
"The prosecution relies on materials to suggest that the applicant was involved in an extramarital relationship with a woman. Certain videos and chat records have been cited in support. However, even assuming such a relationship existed, the law is settled that an extramarital affair, per se, does not amount to not, cruelty under Section 498A IPC or abetment under Section 306 IPC, unless it is shown that the relationship was pursued in a manner calculated to harass or torment the deceased," the court held.
The verdict went on, "An extramarital relationship cannot be a ground to implicate the accused under Section 304B IPC. The Court held that harassment or cruelty should be linked to dowry demands or sustained mental cruelty that occurred 'soon before the death'." The man had been in custody since March 2024, and the court noted his continued incarceration would serve no purpose. The court further observed a chargesheet was filed after conclusion of investigation and the trial was not likely to conclude in near future.
There was no risk of tampering with evidence or fleeing from justice and it was well-established that the object of granting bail was neither punitive nor preventative, it added.
The court directed his release on a personal bond of Rs 50,000 with two sureties of the like amount.
The woman's family alleged the husband had an affair with his colleague and when confronted, he physically abused her.
The man was further accused of regularly subjecting his wife to domestic violence and pressurising her to secure EMI payments from her family for a car he had purchased.
The court observed no such complaint was made by the woman or her family when she alive and therefore prima facie diluting the immediacy and plausibility of the dowry-related harassment claim.

HYDERABAD: Anti-Corruption Bureau (ACB) officials reportedly recovered Rs 5 crore in cash from bank lockers belonging to Nune Sridhar, Executive Engineer of the Kaleshwaram Lift Irrigation Scheme (KLIS). The recovery was made on Monday during the fourth day of his custodial interrogation. Sridhar is currently in ACB custody as part of a five-day remand that began on June 20. Sources said the ACB is probing allegations that the engineer amassed disproportionate assets to the tune of `200 crore through illegal means. As part of the investigation, the ACB officials have scrutinised his bank records and opened multiple lockers in his name. The ongoing inquiry also focuses on Sridhar's suspected purchase of high-value immovable properties and his alleged financial dealings through benami accounts. Officials said further questioning is underway to identify the source of the funds and potential collaborators. Sridhar was arrested by ACB on June 11 following searches at 14 places in the state linked to him and unearthed disproportionate assets allegedly worth over `200 crore. It is to be noted that the state government transferred Irrigation Engineer-in-Chief (General) G Anil Kumar the same day Sridhar was taken into custody. It is alleged that Anil Kumar played a role in shielding Sridhar by allowing him to remain in his post even after he was transferred out. The ACB is now looking into whether administrative support enabled Sridhar to remain in a key position and accumulate illicit wealth. Further action and additional recoveries are expected as the investigation progresses. However, ACB officials were not available for their comments.

BERHAMPUR: Two dalit men were brutally tortured, half tonsured, forced to eat grass and drink drain water after being falsely accused of cattle smuggling in Ganjam district. The shocking incident took place in broad daylight at Kharigumma village under Dharakote block on Sunday. Sources said the victims, Bulu Nayak (52) and Babul Nayak (43) of Singipur, purchased a cow and two calves from Haripur as part of dowry arrangement of a family's marriage ceremony and were bringing the cattle to their village on a cargo auto-rickshaw. A group of locals intercepted them at Kharigumma, accusing them of transporting cattle illegally. The group snatched their mobile phones and cash and demanded Rs 30,000 to release the animals. When the duo refused, the miscreants tied their limbs, thrashed them, partially shaved their heads at a local salon, forced them to crawl for nearly two km to Jahada village. The victims were then allegedly forced to consume grass and drain water at Jahada village chowk. Subsequently, a villager informed a local leader who reached the spot to release them but demanded `30,000 for the purpose. Despite suffering injuries on head and other parts of the body due to the assault, the two victims managed to escape from the spot and reached their village. After receiving preliminary treatment at the local hospital, they lodged a complaint with Dharakote police. However, as the police were reportedly busy with VVIP duty on Sunday, the FIR was accepted late in the night. As the news of the inhuman incident spread, leaders of Ganjam unit of Dalit Mahasabha reached Singipur and held a protest meeting on Monday. Expressing concern over rise in atrocities against dalits during the one-year rule of BJP in the state, they accused the government of failing to curb the rising lawlessness in Ganjam.
