Man receives 1-year prison sentence for biting guard while in detention

A man was sentenced to a one-year jail term for biting the thigh of a guard at a local detention center and taking drugs while on probation.
The 30-year-old defendant surnamed Cheon was found guilty of charges including drug use, interference with the public officials' duties, and bodily injury to another by the Seoul Western District Court in the recent ruling, court officials said Wednesday.
Cheon reportedly attacked the guard on June 28 last year, while under custody at the Southern Detention Center of Seoul. He shouted profanities at the guard, resisted orders to clean his cell, and protested the procedure to isolate him, biting the victim in the process. He had been in custody for drug use charges, for which he received a suspended jail term.
"(The defendant) bit the thigh of a guard and induced a risk of (the victim) being infected with HIV. He also took drugs while under probation," the court said in its ruling.
According to the US Centers for Disease Control and Prevention, transmission through biting is "rare" and "has only occurred through contact between broken skin, wounds, or mucous membranes and blood or body fluids from a person who has HIV."
Both the defendant and the prosecution have appealed the sentence.

A Seoul court on Friday found 49 people guilty for their participation in a January courthouse riot related to former President Yoon Suk Yeol, with one of them receiving a five-year prison term. The Seoul Western District Court handed down the sentences to the individuals indicted en masse for their involvement in the riot at the same court building on Jan. 19, prompted by the court's decision to extend Yoon's detention over his Dec. 3 declaration of martial law. The guilty sentences ranged from a 2 million-won ($1,423) fine to a prison term of up to five years. A 19-year-old, surnamed Shim, received the heaviest sentence of five years for trespassing at the court building through a broken window, assaulting a police officer and attempting to commit arson. "A heavy sentence is inevitable as (the defendant) also attempted arson by buying a lighter from a nearby convenience store, posing serious harm to the judiciary and endangering public safety," the court said. The court also sentenced a 48-year-old surnamed Lee to three years in prison on charges of damaging a judge's office door after entering the courthouse during the riot. Another defendant surnamed Yoo was sentenced to a four-year term for assaulting a police officer and breaking a glass door. "(These acts) not only damage the legitimacy of the judiciary as given by the Constitution, but they also discourage independent judgment by justices and greatly set back the rule of law in our society," the court said.

Kim Dong-hwan, president of South Korean food conglomerate Binggrae, was fined 5 million won ($3,600) by an appeals court for assaulting a police officer who attempted to stop his drunken outburst, the court said Thursday. The Seoul Western District Court upheld the original verdict, handing Kim the same fine for obstructing law enforcement. Kim, 42, is the eldest son of Binggrae Chair Kim Ho-yeon and the grandson of the late Kim Chong-hee, founder of Hanwha Group. He was indicted for assaulting a police officer who was dispatched to the scene after a report was made to the 112 emergency line. The incident occurred in June last year at an apartment complex in Yongsan, central Seoul, where Kim caused a disturbance while intoxicated. The lower court initially fined Kim 5 million won, citing the seriousness of assaulting a police officer on duty. However, it also acknowledged the officers' pleas for leniency. Prosecutors had appealed the ruling, arguing the punishment was too lenient, but the higher court dismissed the appeal.
