Bombay high court seeks police reply after five mosques file petition against action on loudspeakers

Mumbai: The Bombay high court on Tuesday issued notice to the state and Maharashtra Pollution Control Board on a petition filed by five mosques against police crackdown on loudspeakers.
Justices Ravindra Ghuge and Milind Sathaye directed that the police authorities file a reply along with relevant records and posted the next hearing for July 9. Senior advocate Yusuf Muchhala and advocate Mubin Solkar, representing the petitioners, argued that action was being taken only against mosques.
The petitions, filed through authorised representatives, expressed concern that worshippers were being affected by the police, who were allegedly targeting masjids, dargahs, and other places of worship within the Muslim community across Mumbai.
Notices regarding alleged violations of the Noise Pollution Rules, 2000, were issued without providing specifics of the date and time of the alleged violations or the measurement of decibels at the time.

These notices were used as a basis for follow-up actions, such as imposing arbitrary fines, terminating existing licences, refusing to renew licences, and forcibly seizing or removing loudspeakers. The petition claimed that the police department was acting under the influence of vested political interests by issuing such arbitrary notices.

The Bombay High Court on Tuesday issued notices to the Mumbai Police and the Maharashtra Pollution Control Board (MPCB) after five mosques in the city's eastern suburb of Vikhroli filed a petition challenging what they described as arbitrary police action in removing loudspeakers and not renewing their petitioners claimed that due procedure was not followed and that the authorities were acting in a biased manner, targeting only Muslim places of for the petitioners, Senior Advocate Yusuf Moochala and Advocate Mubin Solkar submitted that the police failed to adhere to established legal procedures and did not follow the guidelines laid down by the Supreme Court and the Bombay High Court regarding the regulation of public address systems. They argued that the police action specifically targeted Muslim religious institutions without sufficient justification. The bench comprising Justices Ravindra V Ghuge and M M Sathaye directed the Mumbai Police to file an affidavit along with relevant records by the next hearing scheduled for July court action comes in the backdrop of growing concerns among sections of the Muslim community following a series of loudspeaker removals from mosques. Last week, a delegation of Muslim leaders met with Maharashtra Deputy Chief Minister Ajit Pawar, raising concerns that mosque committees were being harassed despite complying with court-mandated noise leaders pointed out that loudspeakers were being removed on the basis of complaints allegedly instigated by a BJP leader's campaign. Pawar is reported to have assured the delegation that no wrongful actions would be taken by the these developments, Mumbai Police Commissioner Vivek Phansalkar on June 28 stated that the city police had completed a comprehensive crackdown on loudspeakers installed at all religious places. He declared that Mumbai was now "loudspeaker-free from all religious structures" and rejected allegations of selective targeting of any one to existing regulations, the permissible noise level for loudspeakers is capped at 55 decibels during the day and 45 decibels at night, with a complete ban between 10 pm and 6 am. HYDERABAD: The Telangana high court on Tuesday pulled up the police for "settling" civil disputes despite court injunctions. It orally directed the DGP to ensure the SOPs on duties of cops are displayed at police stations and uploaded on the website for people's benefit. Justice Tadakamalla Vinod Kumar gave the direction while hearing a petition of Pamu Sudharshanam accusing Nagole police of forcing him to settle a civil dispute through registration of criminal cases. He said the police were asking him to pay 55 lakh to real estate agents for settling a dispute over his plot in Bandlaguda. Rachakonda commissioner G Sudheer Babu appeared via virtual mode and Nagole SHO appeared physically to explain their stand on allegations. The court, which prima facie concluded that the plot owner was detained in Nagole police station to settle the matter, directed cops to produce CCTV footage of the day.
