Blake Lively lands major court win in legal fight over Justin Baldoni's alleged harassment
The 37-year-old Gossip Girl star is suing Baldoni for alleged sexual harassment on set and for later allegedly orchestrating a 'smear campaign' intended to destroy her reputation in the months following the film's release. Baldoni, who denies the allegations, has filed a $400 million countersuit against Lively and her husband, Ryan Reynolds.
Lively recently submitted a request that certain discoveries made in the case be available for their 'attorneys' eyes only' to protect against any leaks of sensitive information.
'There is an insatiable appetite for any information about this case, no matter how benign it is,' Lively's attorney, Meryl Governski, told New York Judge Lewis Liman during a telephone conference earlier this month. 'The defendants have bragged in text messages about being able to publish information without fingerprints.'
Governski said one category of information that needs to be kept between lawyers related to medical information, including mental health, and that 'personal and intimate conversations with unrelated third parties' must be kept out of the public eye because — while the public relations value would be high — the evidentiary value would be 'virtually nonexistent.'
Liman went ahead and ruled in favor of Lively's request on Thursday, agreeing that 'highly personal and intimate information about third parties' will only be seen by lawyers. Not even Lively nor Baldoni will have access to the information, which includes details about the actors, such as medical records, trade secrets and security measures taken by each.
'The risk of disclosure is great,' Liman said of the potential for 'gossip and innuendo' to spread if the sensitive information was somehow leaked.
While Baldoni's lawyers did not object to certain material being kept from the press and public, they argued that being unable to share the findings with their clients would make it difficult to litigate the case and potentially lead both sides to raise additional legal arguments.
Liman limited the 'attorneys' eyes only' material to information that was 'highly likely to cause a significant business, commercial, financial or privacy injury.' He noted that the confidentiality will speed up the discovery process.
Early last month, Baldoni's legal team launched a website containing documents and text messages linked to the case. Lively later requested that certain material be categorized as 'attorneys' eyes only' after she said she received 'violent, profane, sexist, and threatening communications' after speaking out.
Baldoni's legal team then accused Lively of trying 'to shield, from public view, documents and information exchanged herein' for the sake of her reputation.
'Given how actively the Lively Parties have publicized and litigated Ms. Lively's claims in the media, we are surprised to now learn how vehemently she wants to prevent the public from accessing material and relevant evidence,' Baldoni's legal team wrote in a letter to the judge.
A trial date is set for May 29, 2026.

In response to a prior subpoena from Blake's legal team — which Isabela has since cooperated with — Justin's legal team is also asking the court to issue an order that both his and Blake's legal teams not use "any communication to, from or concerning Ms. Ferrer, or any testimony from her, in any manner in this action" to "satisfy Ms. Ferrer's apparent desire to avoid involvement in the litigation and trial." Justin Baldoni's legal troubles have escalated as he is facing fresh claims from another actress. Isabela Ferrer, who appeared in It Ends With Us, has alleged that Baldoni and his legal team are using court proceedings to intimidate her. Ferrer's lawyers have asked the court not only to reject Baldoni's motion but also to impose sanctions on him. They noted that delayed negotiations about indemnification and repeated legal pressure appeared to be a strategy to create financial pressure. Meanwhile, the larger case continues to escalate. Lively has claimed Baldoni sexually harassed her during the filming of It Ends With Us and later tried to damage her reputation. After the It Ends With Us actress accused the director of "harassing" her and drawing "her deeper into litigation and disputes that she has done her best to avoid," following his attempts to subpoena Ferrer, Baldoni's team slammed the Aug. 17 filing. "We write in response to Isabela Ferrer's opposition to the Wayfarer Parties' motion to serve her by alternative means," Baldoni's counsel wrote in the Aug. 18 letter to Judge Lewis J. Liman obtained by E! News. "The opposition is primarily an inappropriate attack upon Mr. Baldoni and his counsel … and irrelevant to whether Ms. Ferrer should be served via alternative means." The filing alleged that Ferrer—who played the younger version of Blake Lively's character Lily Bloom in the Colleen Hoover adaptation—had her attorney Sanford Michelman accept "service of the Subpoena" on her behalf when Lively had issued one in February 2025 amid her and Baldoni's ongoing legal battle. "Instead, Mr. Michelman prepared and filed a robust 'opposition' to the motion for alternative service … without explaining why he refused to accept service of the Wayfarer Parties' Subpoena or why his client is so reticent to testify." Baldoni's attorneys alleged that Ferrer's counsel told them that they should have reached out to her talent agent. Although the letter argued, "Naturally, we deemed Ms. Ferrer's counsel (and not her talent agent) as the appropriate person with whom to communicate concerning the Subpoena." After his team emphasized that it was Lively's team who "first subpoenaed" the 24-year-old, they argued that the Gossip Girl alum "should not be permitted to obtain discovery from Ms. Ferrer, while Ms. Ferrer and her counsel frustrate all effort by the Wayfarer Parties to obtain the discovery critical to the preparation of their defense." Baldoni's attorneys requested that "given the circumstances," they are "willing to stipulate that none of the parties will use any communication to, from or concerning Ms. Ferrer, or any testimony from her, in any manner." E! News has reached out to reps for Lively and Ferrer for comment and has not yet heard back. In Ferrer's opposition to being served by alternative service, which E! News obtained, her attorney accused Baldoni—whom Lively is suing for sexual harassment—and his associates of acting "inappropriately" towards her after she received her subpoena from Lively. Her counsel argued that Baldoni's Aug. 12 motion should be denied because it was brought "without conducting the diligence necessary to support a motion for leave to serve a discovery subpoena on Ms. Ferrer by means other than personal service." The filing alleged that Baldoni's team did not make efforts to "determine Ms. Ferrer's actual residential or business address." Ferrer's counsel stated that after Ferrer reached out to Baldoni's Wayfarer Studios production company to have her legal fees covered per her film contract, she was asked by the company to "relinquish control of her response to the Lively subpoena to Wayfarer before being granted compensation."
