US to investigate use of AI to personalise airline ticket prices

WASHINGTON - Transportation Secretary Sean Duffy said on Aug 5 the department has concerns about the use of AI to set personalised airline ticket prices and will investigate if anyone does so.
Last week, Delta Air Lines told lawmakers it will not and has not used AI to set prices for individual consumers.
'To try to individualise pricing on seats based on how much you make or don't make or who you are, I can guarantee you that we will investigate if anyone does that,' Mr Duffy said. 'We would engage very strongly if any company tries to use AI to individually price their seating.'
Mr Duffy noted Delta clarified that it would not use AI for pricing individual tickets, 'and I'll take them at face value.'
Late in July, Democratic Senators Ruben Gallego, Mark Warner and Richard Blumenthal said they believed the Atlanta-based airline would
use AI to set individual prices , which would 'likely mean fare price increases up to each individual consumer's personal 'pain point.''
Delta previously said it plans to deploy AI-based revenue management technology across 20 per cent of its domestic network by the end of 2025 in partnership with Fetcherr, an AI pricing company.
Fetcherr on its website says its technology is 'trusted by the world's leading airlines,' and lists Delta, Westjet, Virgin Atlantic, Viva and Azul.
American Airlines CEO Robert Isom said last month using AI to set ticket prices could hurt consumer trust.
Democratic lawmakers Greg Casar and Rashida Tlaib have introduced legislation to bar companies from using AI to set prices or wages based on Americans' personal data and would specifically ban airlines raising individual prices after seeing a search for a family obituary.
Delta said airlines have used dynamic pricing for more than three decades, in which pricing fluctuates based on a variety of factors like overall customer demand, fuel prices and competition, but not a specific consumer's personal information. REUTERS

Seoul - A North Korean defector who swam across a sea border with South Korea while reportedly tied to floating plastic has been rescued and taken into custody, Seoul authorities said on Aug 7. The North Korean managed to swim across the de facto maritime border off the western coast of the Korean peninsula on the night of July 30, South Korea's Joint Chiefs of Staff said. The border is known as the Northern Limit Line and has occasionally served as a route for North Korean defectors swimming to South Korea's Ganghwa Island. 'The military identified the individual near the north of the mid-river boundary,' a military official told reporters. The individual, who local media reported was tied to Styrofoam when he was found, waved for help and said he wanted to defect to South Korea when asked by a South Korean naval officer, the official said. The operation took about 10 hours, according to Seoul, and the individual was rescued at around 4am on July 31. Tens of thousands of North Koreans have fled to the South since the peninsula was divided by war in the 1950s, with most going overland to neighbouring China first, then entering a third country such as Thailand before finally making it to the South. Defections across the land border that divides the peninsula are relatively rare, as the area is densely forested, heavily mined and monitored by soldiers on both sides. But a North Korean man defected in July to the South by crossing the Military Demarcation Line. The number of successful escapes dropped significantly from 2020 after the North sealed its borders – purportedly with shoot-on-sight orders along the frontier with China – to prevent the spread of Covid-19. Private credit fuels ‘buy now, pay later' lending boom in Asia
In the developing world, lenders may charge eye-popping interest rates to cash-strapped borrowers for "buy now, pay later" loans. Hong Kong – Maria Hazel Regalado, a 48-year-old mother of four in the Philippines, needed a computer in 2024 so she could work from home. Ms Regalado didn't have the cash or a credit card. A friend suggested she get a 'buy now, pay later' (BNPL) loan from Billease, an online lender. The computer cost 37,999 Philippine pesos (S$852), almost as much as she earns in a month. Still, Billease approved her application within minutes. She agreed to make 12 monthly payments of 4,493 pesos each, including principal and interest. The effective annual rate: 42 per cent. 'At first I was hesitant, but I didn't have much choice,' says Mr Regalado. 'I really needed that laptop.' Globally, BNPL loans in 2024 soared five times in value to US$334 billion (S$429 billion) from five years ago, according to technology analysis and consulting firm Juniper Research. In the United States, merchants typically pay any fees, so customers get no-interest loans as long as they keep current. But the developing world has a different model: charging eye-popping interest rates to cash-strapped borrowers. While Indonesia, Malaysia and Thailand have been tightening regulation and warning consumers about the cost and risk of BNPL loans, companies such as Manila-based First Digital Finance Corp., which operates as Billease, say they're opening up consumer finance in underserved markets. These lenders, which make loans outside both traditional banking and the world of publicly traded bonds, initially catered primarily to small and medium-size companies but have been expanding into consumer finance. So have two of its biggest competitors, both based in Singapore: Kredivo Group has borrowed from money manager Janus Henderson Group's Victory Park Capital Advisors, and Apaylater Financials, which does business as Atome, has looked to the growing private credit operations of BlackRock the world's largest money manager. The private credit companies typically lend out money to South-east Asian BNPL outfits at annual rates of 10 per cent to 15 per cent, making the deals attractive to the companies' investors. In Jakarta, Indonesia's capital, ads for the BNPL companies are almost inescapable both online and on billboards, city buses and commuter trains. One for Kredivo encourages customers to use BNPL loans for smaller daily purchases, even for train fares and items at convenience stores. 'It's that flexible!' the tagline reads. Huy Pham, a senior finance lecturer at the Royal Melbourne Institute of Technology Vietnam who specialises in financial technology, says BNPL loans can lead to splurges from consumers with unstable incomes, exposing both them and their lenders to growing risks. 'At the end of the day, if customers are not able to pay back the loans, then the platforms will be in trouble,' Mr Pham says. Indonesia's BNPL-related debt in May reached almost US$1.9 billion, up 40 per cent from a year earlier. According to the country's Financial Services Authority, 3.74 per cent was nonperforming – meaning borrowers were more than 90 days behind on their payments – up from 3.22 per cent a year earlier. BNPL lenders say they obey debt collection rules and the rates they charge reflect the risks of the population they're serving. They say they don't purport to be compliant with Muslim law and most banks in the country also collect interest on loans. Andy Tan, Atome's chief commercial officer, says his company must contend with customers who disappear and erase their online presence, among other kinds of fraud. 'Credit risk is something we monitor day in and day out,' he says. But if customers can keep paying back their loans, the profit for lenders like Billease will be enormous. The company typically charges 3.5 per cent a month on its loans, but it also turns the money it lends over many times a year. The estimated expected annual return on this cash: 90 per cent. Park Hotel Management director breached fiduciary duty by selling assets to himself under value Source: Straits Times Article Date: 07 Aug 2025 Author: Grace Leong The court has ruled that Allen Law transferred the viable assets and businesses of his company, Park Hotel Management, effectively to himself 'at a gross undervalue'. Mr Allen Law, the scion of Hong Kong-based billionaire Law Kar Po, was found to have breached his fiduciary duties and prejudiced the interests of creditors, while navigating his company Park Hotel Management (PHMPL) through financial challenges resulting from the Covid-19 pandemic. According to a 165-page High Court judgment released on Aug 6, Mr Law, the sole director and shareholder of PHMPL, sold assets to himself at 'gross undervalue' and diverted more than $32 million in cash and receivables for his benefit. 'When (Mr Law's) company was in financial peril, he transferred its viable assets and businesses (effectively) to himself at a gross undervalue and manipulated the books of the company to eliminate receivables owed by him and his entities, leaving the creditors with nothing,' High Court Judge Hri Kumar Nair noted. 'Far from demonstrating selflessness, Mr Law showed contempt for his fiduciary obligations... While PHMPL may have failed because of events beyond his control, his response was entirely regrettable. 'He appropriated PHMPL's assets for himself and manipulated PHMPL's books to hide his subterfuge. His conduct, both in relation to the 'restructuring' and his defence of these proceedings, was dishonest and dishonourable. His first and only thought was to benefit himself,' the judge said. Mr Law and three other companies were sued by PHMPL and its liquidators over matters relating to assets sold to entities related to him before the company was placed in liquidation in July 2021 in the wake of the pandemic, which had devastated the hospitality industry globally. The three defendant companies are Park Hotel Group Management (PHG), British Virgin Islands-incorporated Good Movement Holdings and Singapore Institute of Hospitality (SIOH). PHG and SIOH are owned by Good Movement, which in turn is owned by Mr Law, who is married to Ms Tan Shin Hui, granddaughter of former UOB chairman, the late Mr Wee Cho Yaw. She is the executive director of PHG. PHMPL was also the sole shareholder of hotel management company Park Hotel Management (Maldives), restaurant operator Yan and Park Hotel Affiliates (PHA). Due to plummeting occupancy rates and pandemic-related restrictions, Park Hotel CQ, operator of the former Park Hotel Clarke Quay property in Unity Street; and Grand Park OR, operator of the former Grand Park Orchard hotel, were unable to meet their lease obligations. Despite efforts to negotiate with landlords and seek relief under the Covid-19 (Temporary Measures) Act, PHMPL's financial position became increasingly precarious. A sale of PHMPL's assets was done in March 2021. But the liquidators said that PHMPL did not receive any consideration for the substantial assets it disposed of. This included a sum of $2.7 million for assets sold to PHG under an asset share and transfer agreement (ASTA) in March 2021. The assets included 12 hotel management agreements, licence agreements, business names, and PHMPL trademarks. The shareholdings in Park Hotel Maldives were purchased by PHG and Good Movement for US$40,000 (S$51,490), while the shareholding in Yan was purchased by Good Movement for $500,000, and the assets of the Singapore Institute of Hospitality were sold by PHMPL for $200,000. 'The effect of the agreements was that PHMPL's assets... were transferred to the defendant companies for a total sum of $3.4 million and US$40,000,' according to the judgment. 'But Mr Law... arranged it such that PHMPL did not even receive these sums,' Justice Nair said. Furthermore, the judge found that the market value of these assets amounted to $26.4 million and US$2.42 million. 'The transfer of assets and businesses from PHMPL to the defendant companies was only one part of Mr Law's plan. In the period when Park Hotel CQ and Grand Park OR were failing to meet their obligations under their respective leases, Mr Law extracted substantial amounts of cash from all three companies,' according to the ruling. In addition, Mr Law also breached the no-profit rule of the Companies Act when he diverted an opportunity to manage Park Hotel Kyoto to PHG, to the detriment of PHMPL. The second part of the plan, the judge found, 'was to cause PHMPL to declare and backdate substantial dividends in Mr Law's favour and to effect a series of transfers and set-offs in PHMPL's books, most of which were also backdated, to eliminate his and his entities' liabilities to PHMPL.' Mr Law received cash payments from PHMPL and also diverted receivables of $22.3 million due from his related companies to PHMPL. These amounts were set off against dividend declarations of $22 million and $5.9 million, and an accounting entry of $6.75 million in his favour. But the judge found that the dividend declarations were invalid as PHMPL was insolvent at the time they were made. As a result, Mr Law must repay $10.1 million in cash payments and $22.3 million in receivables. 'Given my findings that PHMPL was at the very least financially parlous by 31 December 2020 and Mr Law knew this, the cash payments were not in the interests of PHMPL and amount to breaches of Mr Law's fiduciary duties to PHMPL,' Justice Nair said. A representative from the defendants said: 'This remains a legacy matter arising from the exceptional circumstances of Covid lockdowns in 2020 and their unprecedented impact on the hospitality sector. The judgment is being reviewed and appropriate next steps are being considered.'
