No ITR waiver for small taxpayers
The new I-T Bill kept section 433 intact, which required that 'every claim for refund under this part shall be made by furnishing a return as per section 263'. So, effectively, the law still requires a return of income to claim a refund, with no alternative methods allowed.
Taxpayers who file late or revised returns after the due date will still be eligible for refunds, the new bill suggested. Small taxpayers, including senior citizens, must file returns solely to claim a refund for excess taxes deducted at source (TDS), even if their income is below the basic exemption threshold.
The committee had recommended that taxpayers should not be required to file a return just to avoid penalties.
'The current mandatory requirement solely to claim a refund could inadvertently lead to prosecution, particularly for small taxpayers whose income falls below the taxable threshold but from whom tax has been deducted at source. In such scenarios, the law should not compel a return merely to avoid penal provisions for non-filing,' the parliamentary panel had earlier suggested. Preeti Sharma, Partner, Global Employer Services, Tax and Regulatory Services, BDO India, said: 'The biggest advantage of the new law is that the common man may easily understand it with lesser efforts as compared to the old law. The revised bill has incorporated most of the changes recommended by the Select Committee. Taxpayers still have to undergo the process of assessing the right regime to follow while filing a tax return. Similarly, no changes are proposed in tax rates as introduced in Budget 2025.'
The new Bill was passed, incorporating the recommendations of a 31-member parliamentary panel led by BJP MP Baijayant Panda.

Kolkata: Trinamool Congress General Secretary and the leader of the party in the Lok Sabha, Abhishek Banerjee, has dared the BJP-led Central government to immediately dissolve the Lok Sabha and conduct Special Intensive Revision (SIR) by the Election Commission of India (ECI) across the country and not selectively in poll-bound states. Using his social media handle, Banerjee said people of the country have been betrayed after the Election Commission claimed the voters' list in various states is filled with irregularities. "The EC has stated that the voter lists across various states on the basis of which the GENERAL ELECTIONS were held barely a year ago in 2024 are FAULTY and riddled with IRREGULARITIES," he said. "If that is indeed the case, and if the GoI agrees with the EC's assessment, then the first step towards conducting a genuine SIR and STANDING ON MORAL HIGH GROUND is the IMMEDIATE DISSOLUTION OF LOK SABHA. If one truly supports the idea of SIR, then as per the EC's own statement - THE PEOPLE OF THIS COUNTRY HAVE BEEN BETRAYED," said the Trinamool Congress leader. He also urged the Election Commission to conduct SIR across the country. "Also, If the new CEC is truly as competent as claimed, then the SIR should be implemented across the country, not selectively in poll-bound states," he said. Banerjee on Tuesday said the SIR proposed by the ECI was acceptable only if the current Parliament is dissolved. He said that if he agreed that SIR was necessary since there were manipulations in the voters' list, then it should also be accepted that the last Lok Sabha elections were conducted with that manipulated voters' list. "So the current Parliament should be dismantled. Since the Prime Minister and the Union Home Minister were elected by that manipulated voters' list, they should also resign. In the meantime, there were Assembly elections in some states, with a manipulated voters' list. So the Assemblies in those states should also be dismantled,' Banerjee told media persons outside the Kolkata Airport. He said that legal action should be initiated against former Chief Election Commissioner Rajiv Kumar since, under his leadership, such elections with a 'manipulated voters' list were conducted. The ECI on Monday issued a fact-check dismissing as 'incorrect' statements issued by agitating Opposition leaders over alleged "voter list manipulation".

Officials aware of the procedure to appoint and remove Supreme Court and high court judges pointed out that while defending his case before lawmakers in any of the House, Justice Varma can announce that he is quitting and his verbal statement will be considered as his resignation. Live Events Should he decide to resign, he will get pension and other benefits entitled to a retired high court judge. But if he is removed by Parliament, he will be deprived of pension and other benefits, they noted. According to Article 217 of the Constitution, a high court judge "may, by writing under his hand addressed to the President, resign his office". A judge's resignation does not require any approval. A simple resignation letter is sufficient. A judge may give a prospective date to step down. In such cases, the judge can withdraw the resignation before the date he or she has mentioned as the last day in office. Removal by Parliament is the other way a judge can vacate office. Then Chief Justice of India Sanjiv Khanna had written to the president and the prime minister to remove Justice Varma, mired in the cash discovery row. Justice Khanna's report was based on the findings of a three-judge in-house panel which investigated the case. Justice Khanna had prodded Varma to resign but he had refused, sources had earlier said. According to the Judges (Inquiry) Act of 1968, once a motion to remove a judge is admitted in any of the Houses, the speaker or the chairman, as the case may be, will constitute a three-member committee to investigate the grounds on which the removal (or, in popular term, impeachment) has been sought. The committee consists of the chief justice of India (CJI) or a Supreme Court judge, the chief justice of one of the 25 high courts and a " distinguished jurist". According to the rule, a committee has to be constituted and then the committee has to submit a report and the report will be tabled in the House and discussions will start to impeach. A fire incident at Justice Varma's residence in the national capital in March, when he was a judge at the Delhi High Court , had led to the discovery of several burnt sacks of cash at the outhouse. Though the judge claimed ignorance about the cash, the Supreme Court-appointed committee indicted him after speaking to a number of witnesses and recording his statement. The apex court has since repatriated him to his parent high court, the Allahabad High Court, where he has not been assigned any judicial work. Supreme Court judge V Ramaswami and Calcutta High Court judge Soumitra Sen had earlier faced impeachment proceedings but they resigned. Justice Varma's will be the first ever impeachment proceeding to be taken up in the new Parliament building.
