Defence in cop's murder trial gets 6 weeks to file new submissions

(Bernama pic) PETALING JAYA: The defence in the murder trial of senior police officer Nazri Abdul Razak, who is accused of killing 17-year-old Zaharif Affendi Zamrie two years ago, has been given a new date to file its submissions. Counsel M Athimulan told the Ipoh High Court that the defence needed to review its previous submissions to focus on another section under the Penal Code that the prosecution is focusing on, Bernama reported.
Advertisement 'Our submissions comprised both Section 300(c) and (d) of the Penal Code, but were more focused on Section 300(c). However, the prosecution's stand now is that they are relying on Section 300(d). 'This creates a need to revise our submissions. In view of that, we are seeking an adjournment to file this new submission, with the court's indulgence, in about six weeks,' he was quoted as saying. Section 300(c) states that culpable homicide is deemed murder if 'done with the intention of causing bodily injury' and if that injury could cause a person's death 'in the ordinary cause of nature'. Meanwhile, Section 300(d) states that it is murder if someone commits an act knowing that it is likely to cause death, even if there was no intention to kill. Judge GSP Bhupindar Singh gave the defence six weeks to file the new submissions, with the prosecution allocated four weeks after that to respond. He fixed Oct 1 and 2 for the full hearing of submissions. The prosecution was conducted by deputy public prosecutors Afzainizam Abdul Aziz and Nasrul Hadi Abdul Ghani, while the accused was represented by lawyers Athimulan, Mior Faridalathrash Wahid, and Aiman Hakim Kamaruzzaman. Nazri is accused of causing the death of Zaharif, a student, at Jalan Taman Jati 1, near Meru, between 12.05pm and 12.40pm on Dec 15, 2023. PUTRAJAYA: The Enforcement Agency Integrity Commission (EAIC) has recommended that criminal charges be filed against an Immigration Department officer for alleged abuse of power involving the issuance of medical visas to foreign nationals. In a statement, the EAIC said its Special Task Force, led by Commissioner Datuk Seri Dr Razali Ab Malik, had conducted a thorough investigation under Section 17 of the Enforcement Agency Integrity Commission Act 2009 (Act 700). The investigation revealed that the officer had approved medical visit visas for foreign nationals from several countries despite being aware that the supporting documents were incomplete and failed to comply with Immigration Department Circular No. 10/2001. Razali said the task force had examined breaches in the visa approval process, including reviewing compliance with standard operating procedures, interviewing relevant witnesses, seizing documents and compiling recommendations for further action by the relevant authorities. "The EAIC found clear elements of abuse of power in the approval of these visas, which did not meet the basic procedural and documentary requirements," he said. As a result, the commission has referred its investigation findings to the Attorney-General's Chambers with a recommendation to prosecute the officer under the Penal Code (Act 574), the Immigration Act 1959/63 (Act 155), and the Passport Act 1966 (Act 150), in accordance with Paragraph 30(1)(c) of Act 700.

KUALA TERENGGANU, July 28 — A bank officer was left devastated after losing his savings, including in the Employees Provident Fund (EPF), totalling RM241,700 to an online vehicle purchase scam. Kuala Terengganu police chief ACP Azli Mohd Noor said the incident began last July 4 when the 52-year-old victim came across an advertisement for a used four-wheel-drive vehicle on Facebook. Intrigued by the offer, he said, the victim clicked on the link and began communicating with the alleged seller via the WhatsApp application and was then instructed to give a copy of his identity card and a sum of money as an advance payment to a representative of the suspect's company, claimed to be based in Port Klang, Selangor. 'Between July 9 to 21, the victim made 40 payments to eight different accounts totalling RM241,700. The victim began to feel cheated when asked to make an additional payment of RM31,000 supposedly for fingerprinting costs at the Royal Malaysian Customs Department (JKDM),' he said in a statement today. Azli said the victim lodged a police report at 9.37am yesterday, and the case was being investigated under Section 420 of the Penal Code. — Bernama

KUALA LUMPUR, July 28 (Bernama) -- Police have received four reports in connection with the rally at Dataran Merdeka on Saturday, including one case involving an effigy resembling Prime Minister Datuk Seri Anwar Ibrahim being caned near the National Mosque. Acting Kuala Lumpur police chief Datuk Mohamed Usuf Jan Mohamad said the remaining three reports were related to the use of drones. He said that the effigy case has been referred to the Classified Crime Investigation Unit in Bukit Aman for investigation under Section 41 of the Sedition Act 1948, Section 504 of the Penal Code, and Section 233 of the Communications and Multimedia Act 1998.
