7/11 train bomb blasts case: Acquitted man demands re-investigation through SIT

Abdul Wahid Shaikh, the sole person to be acquitted by the special court in 2015 in the Mumbai train bomb blasts case, on Tuesday demanded the formation of an SIT headed by a High Court judge to re-investigate the case.
Shaikh raised this demand a day after the Bombay High Court acquitted all 12 accused in the case, noting that the prosecution had utterly failed to prove the case.
Nine years after he was arrested by the Maharashtra Anti-Terrorism Squad (ATS), the special court in 2015 cleared him of all charges related to the serial blasts case. The court had sentenced five of the 12 men to death and seven to life imprisonment. One of the death row convicts died in 2021.
On Monday, the high court released all 12, noting the prosecution utterly failed to prove the case and it was 'hard to believe the accused committed the crime' Shaikh, who works as a teacher, has been vocal about the torture inflicted by the ATS on 12 persons. He had penned a book- 'Begunah Qaidi'- while he was behind bars.
The special bench of the HC also stated that the accused had been tortured to extort confessional statements.
'The government should re-investigate the case by setting up a Special Investigation Team to be headed by a High Court judge to ensure that the real perpetrators behind the train bomb blasts are arrested,' Shaikh told PTI.
His other demands include an apology from the ATS for the botched investigation, Rs 19 crore in compensation to the 12 men who spent 19 years behind bars despite being innocent and government jobs and houses for them.
'Though very late, these people finally got justice. The HC verdict exposed the falsehood of ATS', he said.
Shaikh expressed sympathy and demanded justice for the family members of the victims killed and maimed in the synchronised blasts that ripped through Mumbai local trains at various locations on the western line on July 11, 2006, killing more than 180 persons and injuring several others.
He remembered the late Assistant Commissioner of Police Vinod Bhat, one of the investigating officers in the train bomb blast case.
In his book, Shaikh had claimed that Bhat was being forced to fabricate evidence and create false witnesses against the accused persons.
'Today, the soul of ACP Bhat must be happy. He ended his life in August 2006 due to pressure to frame innocent persons on the same railway track where bomb blasts had occurred,' he claimed, adding that the suicide was recorded as accidental death at Dadar railway police station.

The Enforcement Directorate (ED) Tuesday initiated searches at 12 places, including the residence and official premises of former Vasai-Virar Municipal Corporation (VVMC) commissioner Anil Pawar, in connection with a money laundering probe into the unauthorised construction of 41 buildings on 60 acres of civic land reserved for sewage treatment and as dumping grounds. The agency's action came a day after Pawar, whose transfer order was issued around a week ago, handed over the charge on Monday and was accorded a farewell. ED sources said multiple places in Vasai Virar, Mumbai, and Nashik are being searched. This is the third round of searches conducted by the central agency in the VVMC region in nearly two months in connection with a money laundering probe into the illegal building construction case. Officers suspect that a well-organised syndicate is operating behind it. In the first round, the agency searched the premises of VVMC officials, builders and their associates. In the second round, which also covered some premises in Juhu (belonging to a known architect) and Kandivali areas of Mumbai, officers focused on the premises of liaison officers, architects, and middlemen who allegedly coordinated between builders and VVMC officials. Builders routed the bribe paid to VVMC officials through middlemen to regularise illegal constructions, agency sources said. Incriminating documents seized during the last two raids indicated gross forgery and fabrication of documents to bypass rules and regularise unauthorised projects. Certain architects and liaisoning officials are suspected to have played an important role, another ED source said. In May, the agency raided 13 locations in Nalasopara, Vasai, Virar and Hyderabad as well. It seized approximately Rs 8.6 crore in cash and Rs 23.25 crore worth of diamond-studded jewellery and bullion from the house of Y S Reddy, deputy director of town planning, VVMC. Large-scale scam suspected The central agency's money laundering investigation is based on multiple First Information Reports (FIRs) registered by the Mira-Bhayandar, Vasai-Virar police commissionerate against builders, local henchmen, and others for 'illegal construction of residential/commercial buildings on government and private land' in VVMC limits since 2009. ED suspects a large-scale scam involving illegal construction in the Vasai-Virar area and said the key perpetrators have been identified as Sitaram Gupta and Arun Gupta, among others. Further investigation is on. According to the agency, 41 illegal buildings were constructed on land reserved for 'sewage treatment plant' and 'dumping ground' as per the approved development plan of Vasai-Virar city. 'The accused builders deceived the public at large by constructing illegal buildings on such land and subsequently developers sell flats to people by fabricating approval documents,' the ED said. 'Even with prior knowledge that these buildings were unauthorised and would eventually be demolished, the developers misled the people by selling rooms in these buildings, thereby committing serious fraud.' The 41 buildings were demolished on February 20 this year following the Bombay High Court's order, which the Supreme Court upheld later. The action, however, left the residents of these buildings homeless.

Last Updated: Thane, Jul 29 (PTI) A Thane court has sentenced an auto-rickshaw driver to five years' rigorous imprisonment after convicting him for culpable homicide not amounting to murder in connection with the death of his brother in 2021. Principal district and sessions court judge S B Agrawal also imposed a fine of Rs 1 lakh on the accused, Mahendra Sadashiv Kardak (59) in the order on July 25, a copy of which was made available on Monday. According to the prosecution, the accused stabbed his brother Anand Kardak and also injured the wife of his another brother with a kitchen knife following a property-related dispute at Wagle Estate in Maharashtra's Thane city on January 6, 2021. During the trial, the accused's counsel argued that he acted in self-defense. The court noted the victims had come to claim the property and apart from pushing, the accused had not attributed anything else to them. 'It is borne out from the material that the accused himself got a knife and assaulted both the victims," the judge observed. The accused 'can certainly be said to have been deprived of the power of self control by the sudden provocation, resulting him to proceed with the assault", the court said. There was no pre-meditation on the part of accused and certainly it was a sudden fight in the heat of passion upon a sudden quarrel," it said. 'There was no intention on the part of the accused of causing death or of causing such bodily injury as is likely to cause death. But certainly he had a knowledge at the time of assault about the same," the court said. In such circumstances, instead of offence under section 302 (murder) of the Indian Penal Code, the accused shall be liable to be convicted under IPC section 304 part II (culpable homicide not not amounting to murder), it said. The court acquitted the accused of the charge under IPC section 307 for attempt to murder his sister-in-law, the informant in the case. Although the doctor mentions that the informant was admitted in hospital for five days, neither the discharge papers nor treatment papers are produced on record, it said. 'Considering the overall history of the matter, an attempt to over implicate the accused cannot be ruled out. In such circumstances, it cannot be said that an offence under Section 307 (attempt to murder) of IPC has been made out beyond reasonable doubt," it said. The court directed that the fine amount of Rs 1 lakh imposed on the accused be paid to the immediate legal heir of the deceased upon due verification. MUMBAI: It pays to follow rules. A traffic cop's gentle advice to a woman in a car to wear the seat belt paid off as the vehicle was involved in a crash minutes after she had fastened the seat belt. Goregaon resident Gautam Rohra and his wife, both in their early forties, were headed home in their car late Saturday evening amid pouring rain. Rohra, who was at at the wheel, had fastened his seat belt while his wife, seated next to him, had not. At Kalanagar, Bandra (east), a traffic cop, Pravin Kshirsagar, flagged them down. The cop politely pointed out that the woman was not wearing the seat belt, and reminded the Rohra couple that the penalty for this violation is Rs 1,000. Let's not get angry when they point out our mistakes... Those who help selflessly are real angels. I'm truly grateful to the policeman for this second chance at life. A little caution saved our home and that is the greatest blessing.'
