Najib: Apex Court Dismisses AG's Appeal On Additional Document, Remits Matter To KL High Court
The decision was delivered by a three-member bench comprising Chief Judge of Malaya Tan Sri Hasnah Mohammed Hashim and Federal Court Judges Datuk Zabariah Mohd Yusof and Datuk Hanipah Farikullah.
Justice Zabariah, while reading the judgment, directed that the matter be remitted to the High Court to be heard on its merits before a new judge.
On April 28, the Federal Court granted the AG leave to appeal against the Court of Appeal's ruling concerning the alleged additional document related to Najib.
Najib, 72, is seeking a mandamus order compelling the respondents to confirm and disclose the existence of the purported document dated Jan 29, 2024.
He named the Home Minister, Commissioner-General of Prisons, Attorney-General, Pardons Board for the Federal Territories of Kuala Lumpur, Labuan and Putrajaya, Minister in the Prime Minister's Department (Law and Institutional Reform), Director-General of the Legal Affairs Division in the Prime Minister's Department, and the Government of Malaysia as respondents.
The former Pekan MP also sought an order that, if the additional document is proven to exist, all or any of the respondents be compelled to enforce it immediately and transfer him from Kajang Prison to his residence in Kuala Lumpur to serve the remainder of his sentence.
On July 3 last year, High Court Judge Datuk Amarjeet Singh dismissed Najib's application for leave to commence judicial review proceedings, ruling that the four supporting affidavits submitted, including statements from UMNO president Datuk Seri Dr Ahmad Zahid Hamidi and vice president Datuk Seri Wan Rosdy Wan Ismail, constituted hearsay and were inadmissible as evidence.
Najib has been serving his sentence at Kajang Prison since Aug 23, 2022, following his conviction for misappropriating RM42 million from SRC International Sdn Bhd.

PUTRAJAYA, Aug 14 (Bernama) -- The Federal Court has fixed three days from Nov 10 to hear the prosecution's appeal against the acquittal of Samirah Muzaffar and two teenagers who were charged with the murder of former Cradle Fund chief executive officer (CEO) Nazrin Hassan. Wan Mohammad Arfan Wan Othman, one of the lawyers representing Samirah and the two teenagers, confirmed the hearing dates when contacted by Bernama. The hearing dates - Nov 10, 11 and 12 - were fixed during case management before Federal Court deputy registrars Wan Fatimah Zaharah Wan Yussof and Mahyun Yusof today. On Feb 8, 2024, the Court of Appeal upheld the Shah Alam High Court's decision to acquit and discharge Samirah and the two teenagers on the murder charge. The High Court, on June 21, 2022, freed the trio without asking them to enter their defence, after the prosecution failed to prove a prima facie case against them. Samirah, 50, who is Nazrin's widow, the teenagers (now 22 and 19), and an Indonesian woman, Eka Wahyu Lestari, who is still at large, were charged with killing Nazrin, 45, at his house in Mutiara Damansara between 11.30 pm on June 13, 2018, and 4 am the following day. In upholding their acquittal, the Court of Appeal held that there was insufficient evidence to determine the guilt of the accused. The Court of Appeal also ruled that there was insufficient evidence to prove that the fire was deliberately started, as there was contradicting evidence from the Chemical Department of Malaysia and the Fire and Rescue Department's investigators. The Court of Appeal held that the testimony surrounding the petrol and the analysis done on it did not use certified methods, and the investigators had skipped crucial steps needed for the analysis of the petrol.

Johor King awards DMIJ to 21SSG commander and regent ADC
JOHOR BAHRU: His Majesty Sultan Ibrahim, King of Malaysia, honoured the Commander of the 21st Special Service Group (21SSG), Major General Ahmad Shuhaimi Mat Wajab, with the Darjah Sultan Ibrahim Johor Yang Amat Disanjungi Pangkat Yang Kedua (DMIJ). Govt, opposition close ranks over assault on Rafizi's son
KUALA LUMPUR: Members of parliament from both sides of the divide today expressed solidarity in condemning the attack on the son of former economy minister Datuk Seri Rafizi Ramli at a shopping mall in Putrajaya yesterday. Datuk Seri Aminuddin Harun (PH–Port Dickson), speaking at a press conference in Parliament, described the incident as an act of violence that went beyond the bounds of humanity. The Negri Sembilan menteri besar said that, in a democratic country, differences of opinion should never be resolved through threats or violence, especially when children are involved. "We fully support Prime Minister Datuk Seri Anwar Ibrahim's statement that the law must be upheld without compromise. "No one should escape firm action if proven to be involved," he said. Present were other government MPs, including Subang MP Wong Chen, P. Prabakaran (Batu), Tan Kar Hing (Gopeng), Syed Ibrahim Syed Noh (Ledang), Dr Taufiq Johari (Sungai Petani), Datuk Muhammad Bakhtiar Wan Chik (Balik Pulau) and Hassan Abdul Karim (Pasir Gudang).
