Man sentenced to 10-year RI for sexual assault of minor girl in Thane

Thane: A 28-year-old man was sentenced to 10 years of rigorous imprisonment (RI) and fined Rs 20,000 for sexually assaulting a 13-year-old girl in 2018. The verdict was delivered by Additional Sessions Judge and Special Pocso Judge D.S.
Deshmukh.
The crime occurred when the convicted man, then 23, befriended the victim near her school and persuaded her to accompany him and a friend to the friend's house. While the friend was in the kitchen, he forcibly kissed the victim, removed her clothing, and committed penetrative sexual assault despite her resistance. The frightened girl managed to push him away and returned home, where she confided in her mother after a neighbour alerted the family about her departure with two boys, prosecutor Rekha Hiwrale informed.
The case was filed at Shrinagar police station, Thane, on Nov 2, 2018, leading to the arrest of both accused. The main accused was in judicial custody since January 2020, while his co-accused was released on bail.

The main accused was convicted under the Pocso Act, Indian Penal Code sections for kidnapping and sexual assault, and the SC/ST Prevention of Atrocities Act, as the victim belonged to a Scheduled Caste community. However, the co-accused was acquitted after the court found no evidence of his knowledge or involvement in the crime.
During sentencing, the judge pointed out the serious nature of crimes against children and noted that the accused exploited his friendship with the victim. The Rs 20,000 fine will be paid to the victim as compensation, with the case referred to the District Legal Services Authority for additional compensation consideration.

New Delhi: A woman's petition for a large alimony -- a house in Mumbai and Rs 12 crore as maintenance -- in a marital dispute case prompted Chief Justice of India BR Gavai to note that she is highly qualified and must earn her livelihood. When the Chief Justice asked what she wanted, the woman replied that she wanted a house in Mumbai, Rs 12 crore as maintenance and a high-end BMW car. "But that house is in Kalpataru... one of the good builders. You are an IT person. You have done your MBA. You are in demand in Bengaluru, Hyderabad... Why don't you work?" the Chief Justice replied. "You had a marriage for just 18 months. And you also want a BMW?" he added, noting that the woman was practically asking for an alimony of Rs 1 crore for every month of her 18-month marriage. To this, the woman replied, "But he is very rich. And he sought the nullity of the marriage, claiming that I am schizophrenic." Senior Advocate Madhavi Divan, appearing for the husband, told the court, "She has to work also. Everything cannot be demanded like this." "Do I look schizophrenic, my lords?" the woman asked. The Chief Justice then reminded the petitioner that she cannot claim properties belonging to her estranged husband's father. The woman, who was representing herself, told the bench that her husband worked as a Citibank manager and also runs two businesses. "I wanted a child, but he didn't give me a child. He filed for divorce, saying that I am schizophrenic," she said. She also alleged that her husband forced her to quit her previous job. The court then went through the husband's tax returns as his lawyers pointed out that his income had declined after he quit the job. The Chief Justice then told the woman to "be satisfied" with the flat and take up a "good job". "Or you better take those 4 crore, find a good job in Pune, Hyderabad, Bangalore... there is a demand in IT centres," he said. "Aap itni padi likhi hai. Aapko khudko mangna nahi chahiye aur khudko kama ke khana chahiye (You are so educated, you must not ask and earn your livelihood)," the Chief Justice said. The order in the case has been reserved.

An Indian man in his 40s was violently attacked and partially stripped in a suspected racist assault in Tallaght, a suburb of Dublin following which the police launched an investigation into the incident. The man, who arrived in Ireland just three weeks ago, was reportedly beaten by a group of individuals on Parkhill Road. He sustained serious injuries to his face, arms and legs and was taken to Tallaght University Hospital for treatment. The police said that they were alerted to the assault and have since opened a criminal investigation although no arrests have been made yet. According to The Irish Times, the man was allegedly falsely accused by his attackers of acting inappropriately around children. The police, however, said that there is no evidence supporting these claims. Ambassador, Lawmakers Condemn Attack India's Ambassador to Ireland Akhilesh Mishra condemned the incident on social media platform X (formerly Twitter), questioning the severity of the injuries in what had initially been described as an 'alleged" assault. 'How can an 'ALLEGED' assault cause such horrible injury & bleeding?" he wrote, thanking the Irish police for their support to the victim and urging that the perpetrators be brought to justice. Local Fine Gael councillor for Tallaght South Baby Pereppadan met the victim in hospital and said he was too traumatised to speak, adding, 'He only arrived in Ireland three weeks ago. He is not taking any visitors at the moment." Such attacks are becoming more frequent in Tallaght, he said, noting, 'People need to understand that many Indian people moving to Ireland are here on work permits, to study and work in the healthcare sector or in IT and so on, providing critical skill." Paul Murphy, a People Before Profit TD for the area, criticised the assault, warning that misinformation and xenophobia were contributing factors. He said, 'Responsibility lies not just with those who perpetrated the violence but also with those who have been spreading racist lies. The community is really shocked and outraged and will stand together against violence, hate and division." Minister for Justice Jim O'Callaghan highlighted the dangers of racial profiling and false accusations against immigrants, saying, 'Increasingly, you hear of people blaming immigrants for crimes. All I can say to you is: I have asked for the statistics and when you look at the prison population of people convicted of offences, the percentage of immigrants in prison is lower than the percentage of immigrants in society. A 15-year-old female hockey trainee from Odisha's Jajpur was allegedly abducted and raped by her coach earlier this month, news agency PTI said in a report. Police officers on Tuesday said that two of her former coaches also acted as accomplices. The survivor filed the complaint on Monday, almost 20 days after the incident. The victim alleged that her coach and his associates forced her into a vehicle while she was returning home and took her to a lodge and sexually assaulted her. They then threatened to kill her if she disclosed the incident to anyone or tried to file a complaint with the police. Police officers immediately detained four people for their alleged involvement in the incident, acting on the complaint. 'We have arrested one hockey coach and two former coaches. One of them has raped the girl, and the two others assisted him in the crime," Jajpur Superintendent of Police Yashpratap Shrimal was quoted as saying by news agency PTI. Police have registered a case under sections of the Bharatiya Nyaya Sanhita and the POCSO Act, including rape charges. One of the detained suspects was released as no evidence has been found against him so far, officials said, adding that the investigation is ongoing.
