Why did CPM not protest Pinarayi's detention during Emergency, asks Goa governor
THIRUVANANTHAPURAM: Goa Governor P S Sreedharan Pillai severely criticised the CPM for not protesting against the arrest and detention of Pinarayi Vijayan during Emergency. 'Pinarayi Vijayan was beaten up and detained in his innerwear. I wonder why was there no protest by the CPM in its stronghold Kannur against this. It was fear,' he said.
Pillai was speaking at the release of his two books here on Tuesday. The function was attended by Kerala Governor Rajendra Arlekar and Andhra Pradesh Governor Syed Abdul Nazeer. Pillai said his book on Emergency gives due credit to Pinarayi's fight because justice should be done. 'My publisher has uploaded 10 pages of my book on Rediff. In that Pinarayi is featured in his innerwear and it reached the world over. The biggest beneficiary of my book is Pinarayi,' he said. Pillai said the only organisation which took to the streets against Emergency was the 'Lok Sangharsh Samiti' which had the backing of RSS. 'Around 8,000 people under the Samiti's banner protested without fearing arrest or jail. Still, it is not mentioned in Emergency-related articles by mainstream media,' he said.
All media succumbed to the pressure of Indira Gandhi fearing arrest. Only Ramnath Goenka was an exception. He was a fighter, Pillai said. Pillai criticised Pinarayi for misinterpreting facts in his media address recently.
Constitutional supremacy is a cornerstone of modern democratic governance, said Syed Abdul Nazeer. 'Constitutional supremacy ensures that the Constitution remains the highest source of law and that all other laws and governmental decisions are subject to its authority,' he said.

High Court Asks Telangana To Hold Local Body Polls In 3 Months
Hyderabad: The Telangana High Court on Wednesday directed the state government to conduct local body elections in three months. Justice T. Madhavi Devi pronounced the orders on a batch of petitions over the delay in conducting the gram panchayat polls. The court directed the state government and the State Election Commission (SEC) to hold the polls by September 30. It did not agree with the arguments that they needed more time to start the election process. The judge told them to complete divisions of wards in 30 days and the process of elections by September 30. Former sarpanches had filed petitions, seeking the conduct of elections without delay. They pointed out that the terms of the panchayats expired on January 31, 2024, and the elections were already delayed by 18 months. On Monday, Justice Madhavi Devi had reserved orders on six petitions filed by former sarpanches and the same were pronounced on Wednesday. While reserving the orders, the single-judge bench reminded the state government that it had earlier assured the High Court that it would convene elections to local bodies by February 2025. Additional Advocate General Imran Khan had submitted to the court that the state government would require a month to declare reservations for backward classes in local bodies. The court was informed that authorities were ensuring that the reservations to be announced for BCs would strictly be in compliance with the directions of the Supreme Court. Appearing for the State Election Commission, senior counsel Vidyasagar had informed the bench that the Commission would hold elections to local bodies within 60 days of the government announcing reservations. The petitioners requested that the bench extend their terms or conduct elections to the village panchayats immediately. They contended that the government appointed special officers in their places following the expiry of their terms. They argued that the appointment of special officers was against Articles 243E and 243K of the Constitution, they argued. This also contravenes the Telangana Panchayat Raj Act-2018. The petitioners contended that local body elections must be held within six months of the expiry of the elected body's term, as mandated by the Constitution. They submitted to the court that the state government in October last year had given an undertaking that the elections would be conducted by February 25, but it failed to fulfil it. The former sarpanches also told the bench that they had spent money from their pockets for developmental works in their respective villages and sought reimbursement of their amount. Meanwhile, former sarpanches have welcomed the court order. They said the governance in rural areas has come to a halt due to a lack of public representatives like ward members and sarpanches.

‘Undeclared Emergency@11': Congress hits back with ‘five-fold assault' charge against BJP
In a counter-attack, the Congress, taking a jibe at the Modi-led government Wednesday, alleged that over the past 11 years (since 2014) — the Indian democracy has been under 'systematic and dangerous' five-fold assault over the past 11 years (since 2014) — a period it described as an 'Undeclared Emergency@11'. This comes after the Bhartiya Janata Party (BJP) went all-out on the grand old party (Congress) on the 50th anniversary of the imposition of the Emergency by the then Indira Gandhi-led government. 'No Indian will ever forget the manner in which the spirit of the Constitution was violated during the Emergency,' Prime Minister Narendra Modi wrote on X. In a statement, Congress general secretary in charge of communications Jairam Ramesh alleged that the Modi government is 'weakening Parliament' and has consistently shredded parliamentary norms. The MPs, who have raised mere issues of public concern, have been arbitrarily suspended. 'Key legislations are bulldozed through. Parliamentary committees have been by-passed,' he added. Congress leader further accused the government of spreading 'unbridled hate speech' and 'a crackdown on civil liberties'. 'The office of the Governor has been misused to block bills in opposition-ruled states and to interfere in university appointments. The Centre has bypassed constitutional fiscal arrangements by overusing cesses to deprive states of their rightful revenue share,' he said. In another series of attacks, the Congress general secretary claimed the 'Election Commission of India's integrity has been compromised severely.' He said, 'Poll timings and phases are tailored to benefit the ruling party. The Commission has remained silent in the face of divisive rhetoric from the Prime Minister and senior BJP leaders,' he alleged.' Ramesh also accused the BJP-led government of 'damaging the judiciary' and said there has been a definite policy of quiet threats to the judiciary, primarily through delayed elevations, punitive transfers, post-retirement sinecures for pliant judges, and selective implementation of collegium recommendations. He added that investigative agencies — including the ED, CBI, and Income Tax Department — have been 'rampantly misused' to harass and defame Opposition leaders. 'Those who switch parties and join the BJP automatically become ED-mukt and CBI-mukt,' he alleged.

50 years of Emergency: When a prisoner was made to ‘run like a horse' at Madras Central Jail
In his autobiography Ungalil Oruvan, Tamil Nadu Chief Minister M.K. Stalin described the Madras Central Prison during the Emergency as a 'torture camp' that echoed with wails. Accounts presented to the Justice M. M. Ismail Commission in 1977 appear to validate that grim depiction. According to testimonies, prison staff seemed to take pleasure in humiliating detainees. 'When one of them returned after a visit to Bangalore, he was made to run like a horse while being beaten,' recounted K. Vezhavendan, a former DMK Minister who later founded the Makkal DMK. He also alleged that the staff used 'disrespectful language.' 'Even refused water' 'Mr. Vezhavendan said they were not even given a bedsheet or mat. They were not given water to drink when they wanted. They were in the lock-up for 24 hours for nine days after their imprisonment till the DIG visited them. On February 2, 1976 night, he was shocked to hear shrieks and cries from other cells and the prisoners asking the staff not to beat next day, the doctor, on his routine check-up, saw his condition, but he (Vezhavendan) was afraid of complaining. He was warned not to, lest more cruelty be unleashed on them. The inmates did not have a change of clothes for about eight days,' reported The Hindu on the Commission proceedings. Vezhavendan said one prisoner was so desperate he contemplated suicide. After his release, Jail Superintendent K. Vidyasagar and his father K. Kolandaivelu, a former Deputy Commissioner of Police, met him in May 1977, asking him to 'forget the incidents and forgive them.' [Vidyasagar, however, told the Commission it was Vezhavendan who had visited him at his home.] Dravidar Kazhagam general secretary (now president) K. Veeramani, in his deposition, told the Commission that the jail warders ignored his plea not to assault V.S. Sambandam, who had recently undergone spinal surgery. 'I warned them it might kill him,' Mr Veeramani said. Sambandam confirmed he collapsed after being struck. But the warders showed no sympathy, allegedly telling him to 'stop pretending' and get up. Senior DMK leader Arcot N. Veeraswami, arrested on February 1, 1976 — a day after the DMK government was dismissed — said detainees were subjected to 'indecent and demeaning' language by staff. Seven inmates were packed into one cell, beaten, and denied drinking water or basic amenities for days. 'New arrivals were beaten... were allowed to bathe and change clothes only on February 9,' he deposed. According to The Hindu Archives, Mr. Veeraswami added that on one occasion, a large amount of salt was deliberately mixed in the soup. 'On another occasion, sand was sprinkled on the food. Once the orderlies who used to help them in the kitchen were suddenly removed and replaced by four others, one of whom used to do scavenging work. Another had scabies and eczema on his hand, and the third suffered from a skin disease. The detenus protested and did not take tea in the morning. After representations, the original batch of orderlies was sent to the work. The Superintendent warned them that it was an offence to refuse food and they were liable to be punished.' Allegations denied However, the jail staff's counsel denied the allegations, calling the salt-in-soup claim 'imaginary.' He accused the prisoners of spreading propaganda for political purposes. The counsel also alleged that it was Mr. Veeraswami who had shared 'valuable information' to the superintendent to secure favourable treatment and release — a charge echoed by Vidyasagar.
