'Back To Medieval Times': Rahul Gandhi On Bill To Sack Arrested Ministers

NDTV4 hours ago
New Delhi:
Rahul Gandhi has ripped into three new bills that allow senior members of the government - including the Prime Minister and chief ministers of states and union territories - to be sacked if they have been jailed (but not necessarily convicted) on 'serious criminal charges' for 30 consecutive days.
The bills - presented by Amit Shah in the Lok Sabha Wednesday, while opposition MPs threw pieces of paper at him - have been sent to a joint parliamentary committee for scrutiny.
But the opposition has been severely critical of the "draconian" and "unconstitutional" proposals, and has accused the BJP of conspiring to illegally remove non-allied governments by filing 'false' cases, jailing rival chief ministers for a month, and forcing them to resign.
"We are going back to medieval times... when a king could remove anybody at will. There is no concept of what an elected person is. If the king (referring to Prime Minister Modi) doesn't like your face, he tells the Enforcement Directorate to file a case. Then a democratically elected person is wiped out within 30 days," Mr Gandhi, the Leader of the Opposition in the Lok Sabha, said.
"Let us not forget why we are electing a new Vice President," the Congress MP continued, referring to the surprise resignation of Jagdeep Dhankhar last month. Mr Dhankhar quit citing ill heath, but sources later told NDTV the ruling Bharatiya Janata Party engineered his removal.

Mr Gandhi also hinted darkly at pressure on Mr Dhankhar.
"The day he resigned. (KC) Venugopal ji called me and said, 'Vice President has gone'. Now there is a big story about why he resigned. Some of you might know... some might not. And there is a story about why he is in hiding. The person who used to burst forth in the Rajya Sabha has gone silent... completely silent. So, this is the time we're living in," he declared.

Mr Gandhi - in a black t-shirt in place of the traditional white, a switch seen as a mark of protest - also spoke of a "war" between "those attacking the Constitution and those defending it".
Multiple opposition leaders have criticised the 'criminal politicians' bill, including Mr Gandhi's party colleagues, Priyanka Gandhi Vadra and Abhishek Manu Singhvi.
Both highlighted fears the BJP can use the bill to target non-aligned or allied governments.
"Tomorrow, you can file any case against a chief minister, have him/her arrested for 30 days without conviction... and he ceases to be a chief minister?" Priyanka Gandhi Vadra asked.
"... (they can) unleash biased central agencies to arrest opposition chief ministers and then, despite being unable to defeat them electorally, remove them by arbitrary arrests," Mr Singhvi said, "And no ruling party chief minister will ever be touched!"
Opposition leaders pointed to the case of former Delhi Chief Minister Arvind Kejriwal, who was arrested on corruption charges linked to an alleged liquor excise policy scam. The AAP boss - who led his party to successive wins over the BJP in Delhi - was arrested and jailed for over five months, without a trial.

Thackeray alliance gets zero in Mumbai BEST Credit Society election, BJP leader's panel wins seven of 21 seats

The Mumbai BEST Credit society elections, perceived to be politically significant on the background of the upcoming local body elections, saw the victory of Shashank Rao panel which won 14 of the 21 seats. Significantly, the Thackeray cousins, who had fought the election together as a single panel, could not secure a single seat. Another panel, led by BJP leaders Prasad Lad and Pravin Darekar, secured seven seats. The ruling alliance claimed that the Thackerays has failed the litmus test before the upcoming elections. The elections to the Mumbai BEST Credit Society, which has a membership of over 17,000, was held after a period of nine years. It was controlled by the Shiv Sena (UBT) till before the elections. 'It was the Thackerays who had made this political. We were looking at it as a credit society's election. Now, it seems like the people have rejected the Thackeray brand,' Chief Minister Devendra Fadnavis said. 'Those who raise doubts about EVMs have received a befitting answer. The people of Maharashtra have decided that those who work should be given the opportunity to work, and those who sit at home should be made to sit at home,' Deputy Chief Minister Eknath Shinde taunted the Thackerays after the result on Wednesday (August 20, 2025). The Thackeray cousins had contested under 'Utkarsh' panel, which had fielded 21 candidates. The 'Sahakar Samruddhi' panel was fielded by BJP leaders Prasad Lad and Praveen Darekar. Shashank Rao, a union leader, had fielded his candidates under the Shashank Rao panel. 'It is wrong to consider this a litmus test. This cannot be compared to the BMC elections,' Sandeep Deshpande, MNS leaders, said. He had earlier claimed that money was distributed during the campaign. Shiv Sena UBT leader Suhas Samant too claimed that his party could not stand against the money power. Shashank Rao, after winning the election, slammed Uddhav Thackeray and claimed that the result was a reply by the BEST workers against the Shiv Sena UBT's policy of privatisation, against playing with the future of the employees and diverting the gratuity funds to fill the coffers of the favourite contractors. 'It is not just about this election. Basically, the whole focus is always on what you do. Credit society was not the issue. This time, we got into the campaign very late. But the workers were really agitated with the condition which was created. The recruitments were pending for years, employees had not received the benefits of the Seventh Pay Commission. Several retired employees had not received their gratuity for three years,' he told The Hindu. He said that of the 17,000 members, 15,093 employees were enrolled as voters. 'Each winning panelist got more than 4000 votes,' he said.

Punishing process: On gender identity recognition

The Manipur High Court's order to the State to issue fresh academic certificates to Beoncy Laishram is at once a matter of individual justice and a larger commentary on the state of transgender rights. What should have been a simple administrative correction became a legal battle, not because the law lacks provisions but because its implementation remains frustrated by inertia and bureaucratic rigidity. In NALSA vs Union of India, the Supreme Court recognised the right to self-identify gender and ordered the state to treat transpersons as socially and educationally backward classes entitled to welfare measures. The principle was codified in the Transgender Persons (Protection of Rights) Act 2019, which also obligated authorities to recognise a person's self-identified gender and issue official documents. Together with Articles 14 and 21 of the Constitution, transpersons are thus entitled to having their affirmed identity seamlessly recognised in all institutional records. Yet, their lived reality is very different. Despite the law being clear on self-identification, bureaucratic setups often do not act unless compelled by higher authorities. In Dr. Laishram's case, her university refused to update her educational records citing procedural hurdles — symptomatic of a systemic malaise. Administrators routinely defer to the most restrictive reading of procedure rather than the spirit of the law. In the present matter, the university and education boards insisted that corrections must begin with the earliest certificate, qualifying recognition on a cascading set of bureaucratic approvals. Where the law envisages gender as a matter of self-determination for transgender individuals, many officials remain wedded to the binary markers assigned at birth, and the mismatch translates into a stunted application of a simple idea. The insistence on sequential corrections or elaborate justifications is essentially a refusal to accept that gender identity is not derived from paperwork. Dr. Laishram's struggle also shows how institutional reluctance to operationalise this principle forces transpersons into prolonged legal contests over what should be routine matters. Such episodes reveal a troubling truth: transpersons, navigating stigma and discrimination, are forced to expend disproportionate time and resources to access rights that are legally theirs. The High Court judgment is undoubtedly positive: it also sets a precedent that may help other transpersons and signals to administrators that procedural rigidity cannot override constitutional and statutory guarantees. Bridging the gap between legal rights and their application will require both institutional reform and cultural change within the bureaucracy that draw from an understanding of gender as lived reality.
