Reasonable restrictions on freedom of speech are ‘elastic', must evolve: Centre tells Karnataka HC
The statement came in response to a petition filed by social media platform X, which has challenged the legality of takedown notices issued under Section 79(3)(b) of the Information Technology Act, 2000.
This provision states that online intermediaries, such as social media platforms, can lose their safe harbour status if they fail to remove or disable access to content that is used to commit an 'unlawful act' despite being told to do so by government authorities. Removing this status would mean that the platforms would be liable for the content in question.
The company has argued that the Centre is misusing this section to bypass the requirements of Section 69A of the Information Technology Act to censor online content.
Section 69A states that online content can be blocked on grounds such as national sovereignty, security of the state, friendly relations with foreign countries or public order. In contrast, Section 79(3)(b) does not define an 'unlawful act' and does not contain any review mechanism.
X has also argued that the takedown orders create a 'chilling effect' on its users, Live Law reported.
On Friday, Solicitor General Tushar Mehta, appearing for the Centre, told the court that the argument cannot be used as a defence to justify spreading content that is 'not in the interest of society'.
Mehta added that X cannot claim the orders had created a 'chilling effect' on behalf of its users.
'Twitter [former name of X] says they offer a platform where others post and express their opinion,' Live Law quoted the solicitor general as saying. 'If they are only a notice board then how is their right to freedom of speech violated.'
Fake 'Supreme Court of Karnataka' account
Opposing X's petition, Mehta also showed the bench an account with the name 'Supreme Court of Karnataka', Live Law reported.
'Now I can post anything in that and lakhs and lakhs of people who view that and will say that Supreme Court of Karnataka has said this…and I can remain anonymous,' said Mehta.
Mehta said that fake accounts and deepfake videos infringe on the right to privacy and the right not to be abused. To curb such threats, the 'safe harbour' protection for intermediaries cannot be absolute, the legal news outlet quoted Mehta as saying.

Naidu urges party MPs to prioritise state issues and secure central funds
Vijayawada: Chief minister N Chandrababu Naidu advised TDP MPs to raise issues such as support prices for farmers, water concerns, and the necessary funds needed for the state. He emphasised explaining the initiatives of the state government for industrialisation, creating job opportunities, and technological adoption. Naidu asked the MPs to focus on bringing more funds to the state from the Centre under various schemes. Naidu held a Telugu Desam Parliamentary Party (TDPP) meeting with all MPs at his residence on Friday. The meeting, also attended by TDP national general secretary Nara Lokesh, saw Naidu express satisfaction over the performance of MPs. He said that TDP MPs regularly attended Parliament sessions, which was reflected in the attendance rate of 86.2%, compared to the average MPs' attendance of 85%. He also expressed satisfaction over the questions raised and participation in debates in Parliament. Naidu urged MPs to raise issues pertaining to Andhra Pradesh whenever an opportunity arises. He also suggested highlighting the good work done by Prime Minister Modi. Naidu said that the MPs should participate in discussions on topics like Operation Sindoor and the 50th anniversary of the Emergency and support the central government's stance. The chief minister further advised MPs to maintain continuous coordination with the departments allocated to them. Parliament members should have first-hand information on what is happening in their respective departments and should immediately take advantage of bringing funds and projects to the state. He asked them to focus on schemes like Jal Jeevan Mission and Health Mission to secure additional funds. Naidu warned MPs to stay away from unnecessary controversies and to work closely with people. He asked them to address people's issues like the mango price crisis, required assistance from the Centre, and issues like the reduction of GST on mango pulp. He also suggested explaining the progress happening in the state and innovative programmes like Quantum Valley, Green Hydrogen Valley, population management, and P4 in Parliament. He said that the criminal political issues of the opposition should also be mentioned. "It is unfortunate that we have to do politics with people having a criminal mindset. They should be exposed at the national level as to how the opposition is behaving like a spoilsport in Andhra Pradesh," said Naidu.

All in one: on the Prime Minister Dhan-Dhaanya Krishi Yojana scheme
The Prime Minister Dhan-Dhaanya Krishi Yojana (PMDDKY), a scheme approved by the Union Cabinet, is to be implemented through the convergence of 36 existing schemes across 11 Departments. According to Union Agriculture Minister Shivraj Singh Chouhan, the scheme seeks to address the 'disparities in productivity' between States, and even among districts within a State. The Centre's pet schemes such as the Pradhan Mantri Kisan Samman Nidhi (PM-KISAN) and the PM Fasal Bima Yojana (PMFBY) as well as relevant State schemes, to be identified by the District Dhan Dhaanya Samitis, will be subsumed in the PMDDKY. Local partnerships with the private sector will also be promoted under the proposed scheme, which will begin in October during the rabi crop season. The scheme is to get an annual outlay of ₹24,000 crore for six years. Modelled on NITI Aayog's Aspirational Districts Programme, the Centre will identify 100 districts based on low productivity and cropping intensity and less credit disbursement. The hope is that the scheme will result in higher productivity, value addition in agriculture and allied sectors, local livelihood creation, leading to increased domestic production and self-reliance. This convergence of schemes must be viewed in the background of decreasing public spending on agriculture. The Parliamentary Standing Committee on Agriculture, in the latest report on Demands for Grants, had observed a continuous decline, from 3.53% in 2021-22 to 3.14% (2022-23), 2.57% (2023-24), 2.54% (2024-25) and 2.51% (2025-26), of the allocations for agriculture as a percentage of total Central Plan outlay. This aggregation of all schemes under one umbrella suggests that the Government wants uniformity in running the welfare, financial and technical schemes in the agriculture sector. It is keen to add States' measures too in the new scheme. It remains to be seen how effective such uniformity will be on the ground as further decrease in public investment in agriculture could be disastrous. Private-public partnerships should be for the larger good of self-reliance, particularly in the production of foodgrains, edible oil and pulses. The progress of area coverage under kharif crops, released last week, points to a decrease in the sowing of oil seeds and popular pulses. Though it promotes national uniformity, it is welcome that the new scheme will function based on 'District Plans' that will be aligned to the national goals of crop diversification, conservation of water and soil health, self-sufficiency in agriculture and allied sectors. For the PMDDKY, the Centre will monitor 117 key indicators of progress on a monthly basis. But to make it more participatory, States, local self governments, primary agriculture cooperative societies, agriculture universities and organisations of farmers and traders must be involved in this process.
