
Malaysia's climate obligations can no longer wait — Sheila Ramalingam
These obligations include preventing significant environmental harm, co-operating internationally, and upholding fundamental human rights, including the right to life, health, and a clean, healthy, and sustainable environment not just for current, but also for future generations.
This Advisory Opinion builds upon existing commitments under the United Nations Framework Convention on Climate Change ('UNFCCC') and the Paris Agreement, making it clear that these are not just moral aspirations but legally binding standards that require States to act with due diligence and ambition.
The ICJ also noted that climate change disproportionately affects the poor, indigenous communities, women, and youth, and reaffirmed that States cannot ignore these risks without legal consequence.
In this context, Malaysia's efforts to date reflect progress but remain insufficient.
While we have adopted policy-level frameworks such as the National Policy on Climate Change 2.0 (NPCC 2.0) and the National Energy Policy 2022-2040, these important documents do not carry legal force and lack binding targets or enforcement mechanisms.
Their success ultimately depends on complementary legislation that ensures coherence, accountability, and implementation across sectors.

Meanwhile, our existing environmental laws such as the Environmental Quality Act 1974 and the Renewable Energy Act 2011 are outdated and insufficient, lacking any explicit integration of climate change mitigation or adaptation obligations.
There have been recent legislative developments worth noting. The Energy Efficiency and Conservation Act 2024 introduces important requirements for large energy consumers and the public sector to optimise energy use, while the proposed Carbon Capture, Utilisation and Storage (CCUS) Bill 2025 signals an encouraging step towards industrial decarbonisation.
However, these laws are sector-specific and operate in silos. The ICJ has made it clear that States must take domestic action sufficient to realise their Nationally Determined Contributions ('NDCs') under the Paris Agreement, and do so with transparency, urgency, and long-term planning.
At present, Malaysia has no legal mechanism to monitor, verify, or enforce its NDCs. Without such a mechanism, we risk falling short of our international obligations and delaying the structural transformations urgently needed.
That said, Malaysia has the policy foundation, technical expertise, and institutional capacity to lead.
The next logical and necessary step is to translate this intent into enforceable law.
A comprehensive Climate Change Act would not only enhance policy coherence and accountability but also reinforce investor confidence, enable just transitions, and protect vulnerable communities from the adverse impacts of climate change.
In this regard, there was a proposed framework for a Climate Change Act. However, there is limited public information about its scope, timeline, or current status.
In light of the ICJ's Advisory Opinion, it is imperative that this proposal be reviewed, finalised, and prioritised.
What is urgently needed is an overarching Climate Change Act, a legislative framework that integrates adaptation and mitigation strategies, mandates periodic carbon budgeting, ensures independent oversight, and holds all sectors to account for emission reduction goals through climate accountability mechanisms.
Such an Act would harmonise Malaysia's international commitments with domestic action, in line with global best practices and recent judicial pronouncements.
A strong, science-based and legally enforceable framework is not just timely, but necessary, to ensure Malaysia's compliance with its duties under international law and to avoid future liability.
The government is respectfully urged to prioritise this critical legislation. Climate action is now a matter of legal obligation, and Malaysia cannot afford to wait.

Speaking at the International Connectivity Conference 2025 here today, Fahmi said the 13MP, to be tabled by the prime minister tomorrow, will shape Malaysia's response to emerging challenges, particularly in the digital and connectivity sectors. 'The 13MP is built on the Madani economic framework, guided by the principle of raising the ceiling and raising the floor. 'The aim is to grow both national income and the people's income, with a focus on high value-added industries and strengthening downstream sectors. 'You can't talk about planning the future without thinking about connectivity. We are living in a time and an age where connectivity is ubiquitous, and you have an entire new generation born into what we now call the digital age,' he said. Separately, Fahmi said Malaysia's digital progress must go hand-in-hand with ethical responsibility, adding that technology must always be used in ways that serve humanity. He said emerging technologies such as artificial intelligence (AI), quantum communications and direct-to-cell satellite connectivity present many possibilities, but also raise questions around ethics. He cautioned against treating AI systems as if they possess human-like decision-making power, calling it a dangerous misconception that could undermine human agency. Fahmi also announced that Malaysia is set to launch its first large language model – an AI model trained on massive amounts of text data to understand, generate and manipulate human language – at the Asean AI Summit this year, a move aimed at enhancing national control over AI development and ensuring responsible use of technology.

Wee slams higher education ministry's ‘general' reply on varsity admissions

(Bernama pic) PETALING JAYA : MCA president Wee Ka Siong has criticised the higher education ministry for what he describes as a vague and inadequate response to his question in the Dewan Rakyat regarding the intake trend of top-performing STPM students and the expansion of open admission channels in public universities. In a Facebook post, Wee said the ministry's written parliamentary reply required further clarification with detailed data. 'The ministry responded that the number of admissions for STPM or equivalent graduates for the 2018/2019 academic session was 4,530, while for the 2024/2025 academic session, it was 8,612, indicating an almost twofold increase (90.1%),' he said. 'The statement that the number of offers to STPM graduates has nearly doubled must be clearly broken down, as it does not distinguish between qualification categories and critical study programmes. 'Why was the data not detailed according to the qualification types as asked, namely STPM, matriculation, and foundation, as well as according to the programmes offered?' Wee had asked the ministry to explain the trend in student intake through the UPUOnline system, in which the number of top-performing STPM students admitted has been significantly lower than matriculation and foundation students since 2018. He also requested clarification on the lack of government funding that has forced public universities to cover the shortfall through open admission channels with higher tuition fees. He questioned the ministry's explanation, that admissions through the open channel were based on the 'over and above' principle, and did not impact the UPUOnline mainstream intake. 'This is a general reply that also does not answer the question specifically,' he said. 'What is the actual number of seats allocated via the open channel for each academic session?' Wee said the government needed to explain its claim that there was 'no compromise' in admission standards for the open channel system. He took issue with the ministry's claim that the open channel reflected the financial independence of public universities, calling it a 'pro-elite policy'. He said raising student fees through the open channel to boost revenue was neither sustainable nor fair, and that universities should instead focus on commercialising research and development outputs. Wee said public concerns over the transparency and fairness of the intake system would continue if the ministry and public universities failed to disclose detailed admission data. Last month, MCA urged the government to set up a royal commission of inquiry to review and reform the admission channels of all public universities. Wee had then pointed out that several public universities had followed Universiti Malaya's lead in offering two enrolment options for undergraduate students – through the UPUOnline system managed by the higher education ministry, and an alternative open channel.

Myanmar junta mandates prison sentences for election critics
Myanmar's junta has touted elections at the end of this year as a path to peace. (Reuters pic) YANGON : Myanmar's junta said today it has enacted a new law dictating prison sentences for critics or protesters of their planned election, which is being boycotted by opposition groups. The junta seized power in a 2021 coup, sparking a many-sided civil war, and has touted elections at the end of this year as a path to peace. Opposition groups – including democratic lawmakers ousted by the military takeover – and international monitors have called the poll a ploy to legitimise the junta's rule. State newspaper The Global New Light of Myanmar said the 'Law on the Protection of Multiparty Democratic Elections from Obstruction, Disruption and Destruction' was enacted yesterday. Its 14-page text forbids 'any speech, organising, inciting, protesting or distributing leaflets in order to destroy a part of the electoral process'. Individuals convicted face between three and seven years behind bars, while offences committed in groups can result in sentences between five and 10 years. The legislation also outlaws damaging ballot papers and polling stations, as well as the intimidation or harm of voters, candidates and election workers, with a maximum punishment of 20 years in prison. If anyone is killed during an attempt to disrupt the election 'everyone involved in the crime faces the death penalty', the law says. Swathes of Myanmar are beyond the control of the junta and some government census workers deployed last year to gather data ahead of the poll faced resistance and security threats. Data could not be collected from an estimated 19 million of the country's 51 million people, provisional results said, in part because of 'significant security constraints'. Analysts have predicted the myriad of anti-coup guerrillas and ethnic armed groups the junta is battling may stage offensives in the run-up to the vote as a sign of their opposition. A UN expert called on the international community last month to reject the election plan as 'a fraud'. Tom Andrews, the UN special rapporteur on the rights situation in Myanmar, said the junta is 'trying to create this mirage of an election exercise that will create a legitimate civilian government'.
