
78% of Pinoys want VP Sara Duterte to face impeachment trial —OCTA survey
Majority of Filipinos believe Vice President Sara Duterte should face a Senate trial or impeachment court, according to survey results released Monday.
Based on OCTA Research's Tugon ng Masa (TNM) survey, 78% of Pinoys want Duterte to face a Senate trial or impeachment court to respond to the charges and formally clear her name.
Only 13% disagreed while 9% said they did not know the answer or have no answer.
'These findings reflect strong public support for accountability and due process in addressing the allegations against the Vice President,' OCTA said.
The non-commissioned survey was conducted from April 20 to 24 through face-to-face interviews with 1,200 male and female respondents aged 18 and above.
According to OCTA, the survey has a margin of error of ±3 % at a 95% confidence level. "Subnational estimates for the geographic areas covered in the survey have the following margins of error at a 95% confidence level: ±6% for Metro Manila, Balance Luzon, Visayas, and Mindanao," OCTA said.
The House impeached Duterte on February 5, with over 200 lawmakers endorsing the complaint.
On the same day, the Articles of Impeachment were transmitted to the Senate but the upper chamber adjourned without addressing the case.
On February 25, Senate President Francis 'Chiz' Escudero said the processes related to Duterte's impeachment trial would start on June 2.
However, Escudero on May 29 said the presentation of the Articles of Impeachment before the Senate was moved to June 11 to prioritize the passage of the items in the administration's legislative agenda before the end of 19th Congress.
Senator Ronald "Bato" dela Rosa recently said that he and other senators are working on their drafts of a Senate resolution seeking to dismiss the impeachment case against Duterte.
Duterte was accused of betrayal of public trust, culpable violation of the Constitution, graft and corruption, and other high crimes.

Philconsa: Return order for Sara impeach case raises constitutional concerns
The Philippine Constitution Association (Philconsa) has called out the Senate, sitting as an impeachment court, for returning the impeachment complaint against Vice President Sara Duterte back to the House of Representatives. In a statement, Philconsa chairperson and former Supreme Court chief justice Reynato Puno said the impeachment court's move raises constitutional concerns. 'This action raises grave constitutional questions and challenges the integrity of the impeachment process. PhilConsa warns that it may constitute grave abuse of discretion and risks undermining the most fundamental principle of our constitutional democracy: that Public Office is a Public Trust,' he said. 'The Accountability of Public Officials cannot be overstressed — and must never be evaded through procedural artifice,' he added. Puno said the constitutional concerns from court's order are the following: Grave Abuse of Discretion — Whether the Senate unlawfully suspended its jurisdiction already validly acquired as an Impeachment Court. Encroachment on the House's Exclusive Power — Whether requiring the House to certify compliance with the one-year ban infringes upon the House's sole prerogative under Article XI, Section 3 of the Constitution. Circumlocutory Delay — Whether imposing novel requirements not found in the Constitution or Senate Rules constitutes a circumlocutory device designed to delay or defeat the trial. Due Process and Impartiality — Whether raising possible defenses on behalf of the Respondent compromises the impartiality of the Senate as an Impeachment Court. Fundamental Question of Law — Is the mere lack of certification from the House of Representatives sufficient to justify remand of the case and suspension of trial? PhilConsa submits that no such requirement exists under the Constitution or established impeachment practice. To create such a requirement ex post facto undermines both the separation of powers and the rule of law. Puno pointed out that the Senate cannot lose or suspend its jurisdiction as an impeachment court by mere procedural acts. 'As the Supreme Court held: 'Jurisdiction, once validly acquired, is not lost by subsequent happenings. It continues until the case is finally resolved or dismissed (Republic v. Sandiganbayan, G.R. No. 115748, Feb. 3, 1997),' Puno said. 'This principle of continuing jurisdiction applies with full force to the Impeachment Court — a doctrine reinforced by established practice, including the Clinton Impeachment trial before the US Senate, whose model our own impeachment process follows,' he added. Puno said that impeachment, as the people's mechanism to enforce accountability of public officials, must not be thwarted by 'procedural invention' or 'partisan maneuver.' 'PhilConsa calls upon the Senate to uphold its constitutional duty and proceed with the impeachment trial in accordance with the Constitution and the rule of law. Any act or device that circumvents this duty gravely imperils our democratic institutions,' Puno said. 'The Filipino people are watching. The Constitution commands it,' he added. On Tuesday evening, the Senate as an impeachment court voted to return to the House of Representatives the Articles of Impeachment against Duterte without dismissing or terminating them. The motion was approved with 18 affirmative, five negative votes, and zero abstentions. Duterte was impeached by the House on February 5 with more than 200 congressmen endorsing the verified complaint against her. The Vice President stands accused of betrayal of public trust, culpable violation of the Constitution, graft and corruption, and other high crimes. Romualdez: Impeachment court's move to return raps to House 'deeply concerning'
'Deeply concerning.' That's how House Speaker Martin Romualdez described the Senate impeachment court's move to return the articles of impeachment against Vice President Sara Duterte to the House. "I rise, not in defiance, but with resolve, guided by duty, grounded in principle. The decision of the Senate, sitting as an impeachment court, to return the articles of impeachment is deeply concerning,' Romualdez said in his speech Wednesday night. Romualdez, however, said that they "will comply with the requirements of the impeachment court" to ensure that the process continues. "In matters of truth and accountability, the House does not back down,' said Romualdez. The House of Representatives, meanwhile, has certified that the impeachment of Vice President Sara Duterte complied with the 1987 Constitution. On a motion by Isabela Rep. Inno Dy, the House plenary deferred acceptance of the articles of impeachment until the Senate Impeachment Court has responded to the queries sought by the House prosecution panel regarding the remanding of the articles of impeachment. With no objections, the motion was carried. In a voice vote, the House plenary adopted House Resolution No. 2346, which certified that the impeachment initiated on February 5, 2025, against Sara Duterte fully complied with the constitution, including the circumstances on the filing of the first three impeachment complaints. The Senate sitting as an impeachment court on Tuesday voted for the articles of impeachment to be returned to the House of Representatives without dismissing or terminating the case until such time that: The House of Representatives certified to the non-violation of Article XI, Section 3, paragraph 5 of the Constitution, which provides that 'No impeachment proceedings shall be initiated against the same official more than once within one year; include the circumstances on the filing of the first three impeachment complaints"; and The House of Representatives of the 20th Congress communicated to the Senate that it was willing and ready to pursue the impeachment complaint against the Vice President. Those who voted yes include Senate President Chiz Escudero and Senators Ronald 'Bato' Dela Rosa, Robin Padilla, Christopher Lawrence "Bong" Go, Francis Tolentino, Imee Marcos, Cynthia Villar, Mark Villar, Jinggoy Estrada, JV Ejercito, Ramon Revilla Jr., Joel Villanueva, Lito Lapid, Alan Peter Cayetano, Pia Cayetano, Loren Legarda, Raffy Tulfo, and Juan Miguel Zubiri.
