
3 cops get jail for sexual harassment of woman, minor niece in neighbourhood

"The convicts are none other than the police officials who are responsible for maintaining law and order in society. Furthermore, they were the neighbours of the complainant and the child victim and were fully aware and conscious of their offensive acts towards them. It is not a case where a restorative or rehabilitative approach would be justified while sentencing," Justice Neena Bansal Krishna observed in her order.
Convicts Jaidev, his brother Jagmal, and son Suraj Bhan were acquitted by the trial court earlier, but the high court found enough material to set aside the verdict and hold them guilty under provisions of IPC and
Pocso Act
after it found that they indulged in sexual harassment and public obscenity against the victims in 2013. While Jaidev was sentenced to 2 years in prison, the remaining three will have to serve one year in jail.

The high court noted that Jaidev's conduct "was persistent, who would regularly stand in the street and strip himself naked on seeing the complainant and her niece. Such an act of the convict, who was in Delhi Police, cannot be forgiven or overlooked. He, being a police official, was duty-bound to abide by the law and to ensure the maintenance of law and order. However, he instead indulged in sexual offences, not only towards the complainant but also a little child of about 6 years of age.

It cannot be overlooked that all the three convicts belong to the same family and they all together on the date of the incident, misconducted themselves and persisted in committing the offence, the court added, highlighting that the victims were also kin of a cop.
Deciding their punishment, the court on Thursday stressed that it is a case "where there is no other choice but to adopt the punitive approach, which may also send a signal to society and act as a deterrent for the convicts like them in society."
The punishment came for offences under sections 509 and 354A IPC for sexual harassment and using vulgar language, words, gestures, and acts to insult the modesty of the woman, obscene acts done in a public place, and under the Pocso Act vis-a-vis Jaidev.
Citing the "consistent testimony of the child about being a victim to such exposure by Jaidev," the court stated that evidence could not have been discarded, overlooked, or disbelieved. "There is overwhelming evidence confirming the alleged obscenity on the part of Jaidev towards the child victim and there was no reason to disbelieve the testimony of the child," it added.

Passport case against businessman Sushil Ansal: Delhi court allows AVUT to assist prosecution
NEW DELHI: A Delhi court has allowed the Association of the Victims of Uphaar Tragedy (AVUT) to assist the prosecution in a fraud case against businessman Sushil Ansal. Ansal was convicted in the 1997 Uphaar cinema fire , which killed 59 people. The AVUTs chairperson, Neelam Krishnamoorthy, had filed an application to assist the prosecution in the case, raising certain objections in the investigation and filing of the chargesheet. Ansal was booked by Delhi Police's crime branch in 2019 under Section 12 of the Passport Act, which deals with obtaining a passport by suppressing information about nationality. The FIR was also registered under IPC Sections 177 (knowingly furnishing false information to a public servant) and 181 (false statement on oath or affirmation to public servant or person authorised to administer oath) 192 (fabricating false evidence), 197 (issuing or signing false certificate) and 420 (cheating). In an order on August 4, chief judicial magistrate Shriya Agarwal said, "The Association at the instance of which the law was set into motion in the present case ought to get a right of assisting the prosecution, to which there is no bar in law." AVUT, the judge said, was at liberty to assist the prosecution in the present case and no prejudice would be caused to the accused. Senior advocate Vikas Pahwa said the present case was registered through a Delhi High Court order in a writ petition filed by AVUT, and so effective right of participation could be given to the association. Earlier, in its 8-page final report, police claimed Ansal misled the government authority on oath that he has not been convicted in any criminal proceedings by any court. The case was lodged on the direction of the Delhi High Court while hearing a petition by Krishnamoorthy, alleging that Ansal concealed or gave false information to the authorities for renewal of his passport. Ansal, however, surrendered his passport on August 14, 2017 "because he knew that adverse orders against him may well be passed", the final report said. Krishnamoorthy, who lost two children in the tragedy, has been fighting a legal battle on behalf of the victims' families for over two decades. Rules stipulate for a new or a re-issue or a replacement of lost or damaged passport issued by the Ministry of External Affairs, the applicant has to disclose whether he is involved in any criminal case or not and to produce an no-objection certificate from the court concerned in case they are involved in any criminal prosecution. A fire at the Uphaar cinema during the screening of Hindi film 'Border' on June 13, 1997 had claimed 59 lives.

West Bengal man sentenced to death for raping, murdering 14-year-old daughter
Kolkata: A court in Bengal's West Burdwan district sentenced a 42-year-old man to death on Wednesday for raping and murdering his 14-year-old daughter in May last year, lawyers who attended the hearing said. The death sentence follows a series of similar verdicts passed by district judges in West Bengal in recent months. (Representative photo) 'The accused was sentenced by judge Suparna Bandopadhyay under multiple sections of the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences Act (Pocso),' Somnath Chattoraj, the public prosecutor, said. The girl was strangled to death at her home on May 13 last year. Her mother, who discovered the body the next morning, lodged a police complaint. The same Jalpaiguri court on June 11 sentenced a 31-year-old man to death for raping and murdering an 11-year-old girl in the Dhupguri area in 2023. The victim went missing in September 2023. Days later, her body was found floating in the Dudwa river. In this case, too, the convict knew the victim and her parents.

Old cartridges, circuit board found during check at Red Fort ahead of Independence Day
The Delhi Police Wednesday found old cartridges and a circuit board during a routine check inside the Red Fort, amid heightened security days ahead of Independence Day. According to the Delhi Police, the cartridges, which appeared to be old, have been sent for forensic examination to determine their origin. The circuit board has also been sent for a check; however, prima facie, it seems it was used for lighting during some event at the Red Fort, a police officer said. In the run-up to the 79th Independence Day, the Delhi Police have stepped up the security arrangements at the Red Fort. Officers from the rank of deputy commissioners of police (DCPs) on senior deployment, a two-layered ring security system has been put in place, starting Sunday. Around 15,000 personnel of the Delhi Police will be deployed at the Red Fort and the surrounding precinct, officers said. Snipers, Special Weapons and Tactics (SWAT) commandos, drones, and 700 AI-enabled CCTV cameras with facial recognition facility will also be a part of the security arrangements. On Saturday, the Special Cell team of Delhi Police managed to get inside the Red Fort's vicinity with a fake bomb — despite layers of security ahead of the Independence Day — during a mock drill to check the robustness of the arrangements. Seven police personnel stationed at the Red Fort at that time who could not intercept the dummy bomb were suspended for negligence, and a departmental inquiry was also initiated against them. Senior police officers said they would review all the security arrangements from scratch, and implement an improved and revised plan. The mock drill, which exposed the security lapse, was just one among the many that would be conducted in the run-up to the Independence Day gathering.
