Karnataka HC criticises transport strike; protest suspended till August 7

With public transport services disrupted across Karnataka on Tuesday, the high court issued a stern warning to protesting transport employees, criticising the continuation of their agitation despite a court directive and the invocation of the Essential Services Maintenance Act (ESMA). The court's strong response prompted the Karnataka State Road Transport Corporation (KSRTC) Staff and Workers' Federation to suspend the strike until Thursday, when the matter is scheduled to be heard again. A division bench of chief justice Vibhu Bakhru and justice CM Joshi, while hearing a public interest litigation (PIL), expressed serious displeasure over the trade unions' defiance of its interim order. The judges made it clear that the court would not tolerate ongoing disruption and warned of potential contempt proceedings if the strike continued.
'If you have grievances, resolve them through dialogue with the government. You cannot inconvenience the public. Continuing the strike even after ESMA has been invoked is illegal,' the bench observed during the hearing.
The PIL, filed by Sunil J and four others and represented by advocate Deeksha N Amrutesh, sought the court's intervention to prevent hardship to commuters. The court had earlier instructed the unions to postpone the proposed indefinite strike, initially planned to begin on Tuesday. However, the strike still went ahead, prompting the court to extend its interim stay on the agitation for two more days and demand an affidavit confirming the strike's suspension.
The ongoing agitation was driven by employee demands for a 25% hike on a base pay of ₹1,124, along with 38 months' worth of arrears, amounting to an estimated ₹1,800 crore. While chief minister Siddaramaiah offered to release arrears for 14 months and called upon the unions to end the strike, the unions rejected the proposal, insisting they deserved full payment for all 38 months.
The court on Tuesday orally cautioned that leaders of the Joint Action Committee (JAC), which represents employees from all four state-run transport corporations — KSRTC, BMTC, NWKRTC and KKRTC — could face arrest under ESMA provisions if the strike resumed. Notices were also issued to the unions, and the court reiterated that the public must not be held hostage by such protests.
'Has the strike been suspended today? The strike is illegal. Police have already arrested anybody who is supporting the strike? Whatever you (trade unions) do (do it) in accordance with the law. As of now, the strike is illegal. If you have issues, you can negotiate with the government. You can't hold the public for ransom, but that is exactly what the unions are doing. The public can't be inconvenienced in this manner,' the court remarked.
Responding to the court's observations, JAC's legal counsel assured that the strike would not continue on Wednesday and that workers would resume duties. Shortly after the hearing, KSRTC Staff and Workers' Federation president HV Anantha Subbarao addressed a press conference to announce the suspension of the agitation. 'After receiving clear directions from the Hon'ble Court, we have withdrawn the strike and appealed to all workers to resume duty,' he said.
Subbarao also urged management not to punish employees who had participated in the protest. 'We urge the management not to resort to any form of victimisation,' he added.
On the ground, public transport in Karnataka remained patchy on Tuesday. In Bengaluru, the state government claimed that BMTC services were operational, but ridership in districts was reportedly at 50%. In Bengaluru Shivajinagar Bus Stand showed limited services, and there was heavy commuter rush at Majestic Metro Station due to increased reliance on the Namma Metro. Areas in Kalyana Karnataka and North-West Karnataka bore the brunt of the strike.

Thereafter, he will inaugurate the Yellow Line of the Bengaluru Metro and undertake a metro ride from RV Road (Ragigudda) to the Electronic City metro station. The Bengaluru Metro Phase-2 project (RV Road to Bommasandra) spans over 19 km with 16 stations and was built at a cost of Rs 7,160 crore. With the opening of this yellow line, the operational metro network in Bengaluru will increase to over 96 km. At around 1 pm, the prime minister will inaugurate and lay the foundation stone of several urban connectivity projects in Bengaluru. He will also address a public function. PM Modi will also lay the foundation stone of the Bengaluru Metro Phase-3 project worth over Rs 15,610 crore. The total route length of the project will be more than 44 km with 31 elevated stations. In view of PM Modi's visit, traffic restrictions will be enforced on the following roads between 9 am and 1 pm on Sunday. Restriction: All types of vehicles are restricted from KSR Railway Platform No. 7 and 8 via Khode Underpass and from Khode Circle to Maharani Bridge. Diversion: Commuters may use LTP Road, Cottonpet Main Road, Mysore Road, and Magadi Main Road. ——- Restriction: All vehicles coming from Shantala Junction towards Khode Junction. Restriction: All vehicles going towards Khode Junction from the BMTC and KSRTC exit side. Diversion: Should move via LTP Road and Cottonpet Main Road. ——- Restriction: All vehicles coming from Mysore Bank towards Chalukya Circle. Diversion: Should move via KG Road, Mysore Bank Junction, Sagar Junction, K.G Junction, Elite, TB Road, Rajiv Gandhi Circle. ——- Restriction: All vehicles coming from Kanakadasa Junction on Kalidasa Road towards Freedom Park. The Karnataka High Court Thursday disposed of a Public Interest Litigation (PIL) against a strike by the Karnataka State Road Transport Corporation (KSRTC) and other transport corporation employees after receiving a resolution stating that it has been called off. A bench of Chief Justice Vibhu Bakhru and Justice CM Joshi heard the matter. The resolution submitted to the bench stated, 'After taking into account the advice of legal consultants and with due deference to Hon'ble High Court of Karnataka…. decides unanimously to call off the indefinite strike of the Road Transport Corporations Employees, as per the Hon'ble Court's direction, all over the state with immediate effect.' The petitioner's counsel had requested that a time frame be set to decide the disputed issues to prevent such a situation from arising again. A Joint Action Committee of the four state transport corporations has been demanding a 25 per cent pay hike, dated January 1, 2024, settlement of 38 months of payment arrears starting from January 2020, and wage revisions. The PIL against the strike, filed by several commuters relying on the transportation services, had argued that the strike would result in grave harm to vulnerable sections of the public, especially the economically weaker section. When the matter was initially heard by a division bench of the High Court this Monday, a direction was issued not to conduct the strike for a day pending the negotiations with the Karnataka Government, in light of the hardship to the public. However, there was a considerable reduction in services Tuesday. As reported by the Indian Express, Kalyana Karnataka Road Transport Corporation (KKRTC) operated at just 29 per cent of its capacity, KSRTC at 43 per cent, and North Western Karnataka Road Transport Corporation (NWKRTC) at 59 per cent. Only Bengaluru Metropolitan Transport Corporation (BMTC) maintained near-normal operations, reporting 99 per cent of scheduled services. The Chief Justice's bench took exception to this, warning of possible contempt proceedings while directing the strike to be called off until the next day of hearing. The bench had also made an oral observation that the public could not be held to ransom.

The Karnataka High Court on Monday continued hearing appeals filed by bike taxi aggregators Ola, Uber and Rapido, along with others, challenging a single judge's April 2025 decision. The ruling stated that bike taxi services could not operate in the state unless the state government notified specific guidelines and rules under the Motor Vehicles Act. A Division Bench comprising Chief Justice Vibhu Bakhru and Justice CM Joshi addressed the matter, specifically questioning the state govt on whether it had intentionally decided to disallow bike taxis. The state's counsel argued that the Motor Vehicles Act does not permit bikes to be used as taxis. However, the Court dismissed this argument as 'thin', noting that several states allow bike taxis under the same statute applicable across India. During the hearing, Senior Advocate Uday Holla, representing Roppen Transportation Services (Rapido), contended that the single judge assumed, though not pleaded, that the state govt had a policy against bike taxis. He argued that if such a policy exists, it contravenes the statute, which permits motorbikes as taxis. Holla further highlighted that various states, including Rajasthan, Bihar, Uttar Pradesh, Uttarakhand, Madhya Pradesh, West Bengal, Haryana and Orissa, permit bike taxis. Addressing the convenience of bike taxis, Holla stated, 'Today, Bangalore Metro has just two lines (in Bangalore)...Bike taxis help commuters and are a matter of easy convenience. The single judge has also said that the State government must be alive to the changes coming in society. Now, how will commuters access motorbikes? Without aggregators, motorbikes will just be running all around. But if there is an aggregator, bikes can be made accessible. You see how convenient bike taxis are, you get one in a minute or two.' He also mentioned that earlier whiteboards were issued to bike taxis and suggested that establishing guidelines would create a regulatory framework. Emphasising the role of aggregators in ensuring commuter safety, Holla added, 'If aggregators are not there, who will check the background of the drivers? Aggregators add to the entire mechanism... They check the antecedents of the drivers.' He also claimed that bike taxis reduce traffic congestion, citing media reports indicating increased traffic following the disallowance of bike taxis in the state.
