Perak Labour Dept rescues 55 foreign workers from exploitation at Lahat furniture company

IPOH: About 55 foreign workers, believed to be victims of exploitation, were rescued from a furniture company in Lahat.
Perak Labour Department director Mohd Nizar Zakaria said the victims, which included 32 from Bangladesh, 14 Myanmar nationals, and nine Nepalese, aged between 19 and 45, were rescued during an Ops Mega Pintas operation on Thursday (May 8).
Mohd Nizar said the victims' employer failed to provide appropriate accommodation, violating Section 24(D) of the Workers Minimum Standards of Housing and Amenities Act.
"The employer has also committed multiple offences under the Employment Act, including Section 19 for late salary payment, Section 60K for failure to report foreign workers' employment, and Section 24 for unauthorised salary deductions.
"Other offences included Regulation 8 for absence of employment contracts and Section 90B for forced labour practices," he told reporters after the raid on May 8.
"Apart from the foreigners, we also rescued six locals aged between 35 and 60," he added.
Nizar said the workers have not received their salaries for the past five months, and the foreign workers have had their passports withheld by the employer.
Authorities are now gathering statements from all the workers to determine the duration of exploitation and whether the employer complied with the minimum wage of RM1,700.
"The police have opened an investigation under the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act 2007 (Act 670).
"The Environment Department will also take necessary action regarding the unsafe factory conditions," he added.
Meanwhile, Perak police chief Comm Datuk Noor Hisam Nordin said the raid was carried out based on public information about the workers' struggles.
He said the company's 58-year-old managing director has been arrested.
"The foreign workers will be transferred to a protection centre in Melaka within 24 hours.
"We urge all employers not to mistreat their employees and to uphold their responsibilities while adhering to the law," he added.

PUTRAJAYA : A couple, who worked as cooks at a factory canteen in Johor, was awarded a total of RM162,420 in unpaid overtime claims after the Court of Appeal overturned a High Court ruling earlier this year. A three-member Court of Appeal bench, chaired by Justice Lim Chong Fong, said the Employment Act limited a person's shift to eight hours a day but the couple's contract stipulated that they should work from 5am to 8pm. Despite siding with the couple, the appellate court allowed only one-third of the total amount demanded by Ee Yueh Horng and Tan Ei Guan as it said part of the claims were already factored into the overall calculation. Sinppa Industries Sdn Bhd will now have to pay the wife RM96,732 and the husband RM65,688. The amount is inclusive of 5% interest, calculated from the date the complaint was filed in the Labour Court on March 12, 2023. Ee and Tan were employed from 2019 to 2023 by the aluminium manufacturer based in Ayer Hitam. The wife's monthly salary was RM3,000 while the husband, who doubled as a part-time security guard, earned RM2,000. The factory had paid termination benefits and other outstanding amounts owed to them. Ee subsequently filed a claim for RM290,196 and Tan for RM197,066. These were dismissed outright by the labour tribunal and later affirmed by the High Court in Muar. Today, lawyer T Vijaya Sandran told the Court of Appeal that the couple was responsible for preparing three meals a day, cleaning the canteen and grocery shopping. He said they were allowed only two days off in a month. Lawyer Ina Shafina Sahima, who represented the company, submitted that the couple had enjoyed flexible working hours although their contract stated it was from 5am to 8pm. Lim, who sat with Justices Azhahari Kamal Ramli and Ahmad Kamal Shahid, rejected the argument. Lawyer Abraham Mathews also represented the couple. Ina was assisted by Nur Syarah Syazwan Amad Saturi.

KUALA LUMPUR: Police raided 22 entertainment outlets and restaurants that had been illegally converted into pubs and karaoke rooms, allegedly operated by foreigners, during Op Mega Pusat Hiburan in Selangor and Kuala Lumpur last night. Bukit Aman Criminal Investigation Department (CID) director Datuk M. Kumar said the operation involved the department's Anti-Vice, Gambling and Secret Societies Division (D7), along with the Selangor and Kuala Lumpur D7 units, local authorities, and the Fire and Rescue Department. "A total of 16 premises in Selangor and six in Kuala Lumpur were raided. They are all believed to be operating without licences and employing illegal foreign workers," he said in a statement today. Kumar said the raids led to the arrest of 288 individuals aged between 18 and 51, comprising Myanmar, Nepalese and Bangladeshi nationals. He said the detainees are being investigated under multiple laws, including Section 186 of the Penal Code, Entertainment Act, Excise Act 1976, Customs Act 1976 and Immigration Act 1959/63. Cash, entertainment equipment, various brands of alcohol and several operational documents were also seized. – BERNAMA

BUKIT MERTAJAM: The Immigration Department (JIM) is prepared to work with the Malaysian Border Control and Protection Agency (AKPS) to resolve misconduct issues among its personnel. JIM Director-General Datuk Zakaria Shaaban stated that discussions will be held with AKPS if problematic officers at major entry points need reassignment. He clarified that AKPS now fully manages 22 key entry points, including KLIA, Johor's Sultan Iskandar Building, and Penang International Airport. JIM officers continue to oversee daily airport operations, with AKPS handling counter arrangements while immigration staff assist in intelligence and monitoring. Zakaria assured full cooperation with AKPS to remove officers linked to misconduct if reshuffles are necessary. He spoke to reporters after leading an operation at a Simpang Ampat factory, where 307 foreign nationals were detained for immigration violations. The operation's success stemmed from joint intelligence efforts between JIM and AKPS, with continuous disciplinary actions against errant officers. Since 2022, 147 disciplinary cases involving immigration officers have been recorded, resulting in 55 dismissals. To curb power abuse, JIM is expanding digital solutions like autogates at entry points to minimise officer-traveller interaction. During the raid, 749 foreigners were screened, with 306 Bangladeshis and one Nepalese detained for pass violations. All detainees will undergo further investigation before being transferred to the Jawi Immigration Detention Depot. – Bernama
