Karate teacher sentenced to 5-year RI for sexually harassing four students

Pune: The court of Special Judge Kavita Shirbhate convicted a 44-year-old karate teacher and sentenced him to five years of rigorous imprisonment with a fine of Rs40,000 for sexually harassing four students between 2018 and 2020.
The teacher got an additional sentence of one year of imprisonment with a fine of Rs2,000 for wrongful confinement.
If the fine of Rs40,000 is not paid, the accused will have to undergo additional imprisonment from 15 days to two months. If paid, the money will be equally disbursed among the victims as compensation. The court has also directed the Pune District Legal Services Authority to grant compensation to the victims.
The teacher was, however, acquitted of charges of molestation and rape under provisions of the Indian Penal Code (IPC) and Protection of Children from Sexual Offences (Pocso) Act.
The prosecution's case was that the Sahakarnagar police arrested the teacher on June 30, 2020, after the students approached them with a complaint accusing him of sexual harassment while teaching karate. The accused has been lodged at Yerawada Central Jail since then.

Special public prosecutor Nitin Konghe relied on the evidence of four students and two other witnesses to prove the guilt of the accused. Konghe also demanded maximum punishment for him as he sexually harassed the students under the pretext of teaching them karate. The judge relied on the victims' evidence as it was cogent, reliable and corroborated with the FIR and statements recorded by them before a magisterial court.

New Delhi, The Supreme Court has said anticipatory bail in cases involving serious offences should not be given in a mechanical manner. A three-judge bench of Justices Vikram Nath, Sanjay Karol and Sandeep Mehta made the observation while setting aside an order of anticipatory bail to four accused in a murder case. "The order of the High Court does not disclose any reasoning for granting anticipatory bail in a matter involving serious offences under Sections 302 and 307 IPC," the bench said in its May 1 order. It continued, "The impugned order is cryptic and lacking in judicial analysis. In cases involving serious offences, the grant of anticipatory bail in such a mechanical manner cannot be sustained and is liable to be set aside." On a plain reading of the FIR and accompanying material, the court noted that the appellant's father was assaulted and killed in the presence of the appellant, who was also the informant. "The incident appears to have stemmed from a dispute regarding obstruction of a pathway. The specific roles attributed to the accused, as stated in the FIR, indicate that they participated in the assault even after the deceased had collapsed," the top court said. The high court, it said, "clearly failed" to appreciate the gravity and nature of the allegations in the case. The accused persons was, as a result, directed to surrender within eight weeks. The order came on a plea filed by the son of the victim, challenging the order granting them anticipatory bail. The victim was assaulted in 2023 with an iron rod and sticks during a dispute between neighbours. As a result of the head injury, he succumbed to injuries the same day and an FIR was registered on the basis of the appellant's statement against seven accused persons.

The court was hearing the appeal preferred by Anbarrasu, his father Asir David, and his mother Kasthuri, challenging the conviction and sentence imposed on them by the mahila court in Nagercoil in 2016. The prosecution's case is that Anbarrasu married Christilda Jane in 1994 in a church as per Christian rituals. A male child was born to them in 1995. Since Anbarrasu's brother married a woman from a wealthy family, he, along with his parents, ill-treated and harassed Jane, seeking more dowry. She also made a complaint in this regard to the Nagercoil All Women Police in 1999. Since Anbarrasu and Jane gave an undertaking that they would live in a separate house, the complaint was closed. Thereafter, the couple lived with their child in a rental house. Since Anbarrasu and his parents continued the harassment seeking dowry, Jane, along with her child, committed suicide by self-immolation in 2000. Challenging the same, they preferred the present appeal. During the pendency of the appeal, Asir David died, due to which the charges against him were abated. Justice K K Ramakrishnan observed that the evidence of the family members about the demand for dowry and the harassment meted out to the deceased in furtherance of the demand for dowry was cogent, clear, and without any infirmities. Hence, the court had no reason to disbelieve their testimony. They were the best persons to speak about the harassment caused to the deceased. The judge observed that in the complaint lodged in 1999, the deceased narrated all the incidents and helplessly pleaded that her family was not in a position to meet the demand for dowry. Therefore, the prosecution showed circumstances and evidence to presume the continuous dowry demand, which drove the deceased to self-immolate herself along with her child. Hence, the judge confirmed the conviction and sentence imposed on Anbarrasu and Kasthuri and dismissed the appeal preferred by them.
