Delhi HC seeks response on challenge to Delhi Police's online content takedown powers
New Delhi [India], May 29 (ANI): The Delhi High Court has issued a notice in response to a plea challenging a notification by Lieutenant Governor (LG) Vinai Kumar Saxena that grants the Delhi Police authority to issue takedown orders for online content on social media platforms.
A division bench, comprising Chief Justice DK Upadhyaya and Justice Tushar Rao Gedela, on Wednesday acknowledged the submission made by the Software Freedom Law Centre (SFLC.in) and sought responses from the LG Office and the Ministry of Electronics and Information Technology (MeitY), directing that they be submitted within six weeks.
SFLC has contested the constitutional validity of the notification, which designates the Delhi Police as the Nodal Agency under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (IT Rules, 2021), enabling it to issue takedown orders for online content.
The petition argues that allowing police officers to independently direct content removal, without judicial or external oversight, risks enabling unchecked censorship and arbitrary limitations on constitutionally protected free speech.
It was argued that neither the IT Rules, 2021, nor Section 79(3)(b) of the IT Act confer any authority for the establishment of a Nodal Agency, Nodal Officer, or any other positions specified in the contested Notification. Section 79 solely provides conditional immunity to intermediaries and delineates their due diligence responsibilities; it does not grant executive power to the State or Union to institute a mechanism for speech regulation or restriction.
It was also contended that the authority to restrict access to online content falls exclusively within the purview of Section 69A, alongside the Information Technology (Procedure and Safeguards for Blocking for Access of Information by Public) Rules, 2009 (referred to as the 'Blocking Rules, 2009').
The Central Government has already exercised its authority to appoint a designated officer for issuing blocking orders through the formal implementation of these rules. The statutory framework does not envisage the establishment of any parallel or supplementary authority, particularly at the direction of a state-level executive. The plea stated that the IT Act does not provide for the creation or operation of a Nodal Agency in the manner proposed by the contested Notification. (ANI)

Delhi HC bins plea against demolition of tenements of Hindu refugees from Pakistan
The Delhi High Court has rejected a plea seeking a stay on the proposed demolition of an illegal colony set up by Hindu refugees from Pakistan along the Yamuna river in north Delhi till an alternative plot of land is allotted to the affected people. The court also vacated an interim stay it had granted on March 12 against the demolition. Justice Dharmesh Sharma on Friday rejected the plea filed by a man named Ravi Ranjan Singh, seeking orders to the Delhi Development Authority (DDA) to allot the refugees a different spot in the city as per the provisions in the Delhi Slum & JJ Rehabilitation and Relocation Policy, 2015, before demolishing their tenements. Mr. Singh argued that the Citizenship (Amendment) Act (CAA) was framed with the idea of providing Indian citizenship to non-Muslim refugees from the neighbouring countries, to help them escape religious persecution. 'Must be a citizen' However, the court said that it 'has no hesitation in holding that the petitioner is not entitled to the reliefs sought by way of the present petition' because to be eligible to avail of the provisions of the Delhi government policy, the person seeking relief 'must first and foremost be a citizen of India'. 'On account of their nationality, the Pakistani refugees cannot be rehabilitated under the DUSIB policy,' it added. The court asked the petitioner, as well as the other refugees, to first acquire Indian citizenship, adding that it could 'be done online with ease' and asked the Delhi State Legal Service Authority to help the refugees to comply with the necessary legal formalities. Remarks against Centre The court added that 'even Indian citizens cannot claim alternate allotment as an absolute right, particularly in cases where the land they occupy falls under specially prohibited areas like Zone 'O' of Delhi, i.e., the Yamuna floodplains'. Justice Sharma also made observations regarding the court's attempts to engage with the concerned authorities to facilitate the rehabilitation and relocation of the refugees, saying all its 'efforts have been unfruitful, seemingly due to the classic case of bureaucratic buck-passing, particularly on the part of the Union of India'. The judge added, 'Nevertheless, this court cannot undertake the exercise of framing a policy to ameliorate the plight of the refugees.'

The Delhi Chief Minister could be seen offering prayers at the ghat alongwith the other party members. Addressing the gathering, Delhi CM Rekha Gupta said, 'The Delhi government and the city's residents have taken the decision to clean the River Yamuna. Social workers also will be part of this.' Taking a swipe at the previous AAP government, Rekha Gupta said, 'The previous governments used to lie about Yamuna cleaning. They did not take a single step towards Yamuna cleaning...' Rekha Gupta participated in the '100 Din Seva Ke' program earlier in the day. The Chief Minister slammed her predecessor, saying they had claimed to be ordinary people who became greedy for power, while her government is working on the streets among the people. 'When the movement started from Ramlila Maidan, thousands and lakhs of people joined it, I joined too, others also supported it, thinking something better would happen in Delhi and the country. "Law should be formulated against such people": SP MLA Abu Azmi reacts on influencer Sharmishta Panoli's arrest
Mumbai (Maharashtra) [India], May 31 (ANI): After Kolkata Police arrested social media influencer Sharmishta Panoli for allegedly hurting religious sentiments, Samajwadi Party MLA Abu Asim Azmi demanded stringent legal action against such people. Speaking to ANI, Azmi said, 'I have said it in the Parliament also 50 times, when someone hurts religious sentiments or disrespects important people of this country, like Chhatrapati Shivaji Maharaj, Mahatama Gandhi, or Dr Bhimrao Ambedkar, then it worsens law and order... But our Maharashtra government is different. When MF Hussain drew pictures of gods and goddesses, which hurt the religious sentiments of Hindus, so many FIRs were filed against him that he had to run from India...' 'But the Congress and the BJP, pleased by the runaway woman Taslima Nasrin hurting religious sentiments, are keeping her in our country when no other country wants to keep her. A law should be formulated against such people which gives a punishment of at least 10 years,' he added. Earlier today, a court in Kolkata remanded social media influencer Sharmishta Panoli, arrested for allegedly hurting religious sentiments, in judicial custody for 14 days. Kolkata Police has arrested Panoli from Gurugram, Haryana on Friday night. She is a law student in Pune, Maharashtra. On Saturday, Panoli was produced before Alipore Court in Kolkata, which remanded her in judicial custody for 14 days. According to the Kolkata Police, several attempts were made to serve legal notices to Panoli and her family, but the attempts were unsuccessful because Panoli and her family absconded. Subsequently, an arrest warrant was issued by the court, based on which she was arrested from Gurugram on Friday. 'The case relates to an Instagram video by a lady named Sharmishta Panoli that hurt the religious sentiments of a particular community. FIR was lodged in Garden Reach Police Station. Attempts to serve notice as per law couldn't be successful since the accused, with her family absconded. Subsequently, warrant of arrest was issued by the court of law, based on which she was arrested from Gurgaon yesterday,' as per the Kolkata Police. However, Panoli had deleted the video and issued an apology on May 15. Speaking to ANI, influencer Sharmishta Panoli's advocate, Md Samimuddin stated that they have moved her bail application before the court. 'We moved our bail application before the court, citing that the articles that have been allegedly stated by the prosecution to have been used, the mobile phone and the laptop, have already been seized. Subsequently, the court heard our prayer. The police custody prayer was sought by the prosecution, which was turned down and rejected. The accused has been remanded to judicial custody till 13th of June, 2025...' Sharmishta's advocate said. Meanwhile, in a social media post on X, Kolkata Police trashed the 'factually incorrect' and 'misleading' certain social media narratives suggesting that the arrest of the law student is 'unlawful.' Authorities urged the people to refrain from sharing unverified or speculative content. (ANI)
