Supreme Court allows Telangana MLA to seek salary recovery from disqualified predecessor

Hyderabad: The
Supreme Court
has granted Vemulawada MLA and govt whip Adi Srinivas the liberty to initiate salary recovery proceedings against former MLA Chennamaneni Ramesh, following the Union home ministry's declaration that Ramesh is a German citizen.
A bench comprising Justice MM Sundresh and Justice NK Singh issued the order while disposing of Srinivas's appeal, in which he sought to be declared the rightful winner for all Vemulawada assembly polls held in 2009, 2010, 2014, and 2018.
Srinivas argued that, since he consistently secured the second highest number of valid votes in all four elections, the Telangana high court—having already ruled Ramesh ineligible—should have declared him the lawfully elected legislator for the 2018–2023 term.

The apex court rejected this plea, noting that the high court had already examined the matter in detail and pronounced its verdict against Ramesh. It declined to interfere with those findings.
In its March 2025 judgment, the high court had imposed a ₹25 lakh penalty on Ramesh, which he subsequently paid. However, the Supreme Court observed that the Centre's decision on Ramesh's citizenship would still carry legal consequences. Accordingly, it left Srinivas free to pursue "appropriate remedies" arising from the declaration.
Legal sources indicated that one such possible remedy is the recovery of salary, allowances, and other perks drawn by Ramesh during his tenure as an MLA, on the grounds that he held the post unlawfully after being deemed ineligible.

He also said Russia must accept land swaps, although it was unclear what Putin might be expected to surrender. The Europeans and Ukraine are wary that Putin, who has waged the biggest land war in Europe since 1945 and used Russia's energy might to try to intimidate the EU, might secure favorable concessions and set the outlines of a peace deal without them. European countries' overarching fear is that Putin will set his sights on one of them next if he wins in Ukraine.

The Union Environment Ministry has issued an order appointing two judicial members and four expert members to the National Green Tribunal (NGT), which is currently functioning below its sanctioned strength. The Centre's order, dated August 11, also ended with immediate effect the extended tenure of two judicial members – Justice Sudhir Agarwal and Justice Sthalekar, and two expert members, K Satyagopal and Arun Kumar Verma. Justice Sudhir Kumar Jain, former judge, Delhi High Court, and presently a member of the National Consumer Disputes Redressal Commission (NCDRC); and Justice Umesh Chandra Sharma, former judge of Allahabad High Court and currently a member of the Armed Forces Tribunal, Chandigarh, are the two new judicial members. Out of the four new expert members, two are Indian Forest Service Officers – Sudhir Kumar Chaturvedi, retired principal chief conservator of forest, Gujarat, and Ishwar Singh, retired principal chief conservator of forest, Delhi. The other two are Sujit Kumar Bajpayee, currently a member of the Commission for Air Quality Management and former joint secretary, Environment Ministry, and Prashant Gargava, former member secretary, Central Pollution Control Board. It has not been specified when the new judicial and expert members will take charge, and their exact place of assignment is also not clear. S Vineeta, Registrar General, NGT, was not available for a comment on the appointments. Section 4(1) of the NGT Act, 2010, states that the Tribunal shall consist of not less than 10 but a maximum of 20 full-time judicial members and the same number of expert members. Until the Centre's latest order, NGT had only five expert members and six judicial members. Now, a strength of six judicial members will continue, and there will be seven expert members. The NGT has five benches – Principal bench (Delhi), Eastern zone (Kolkata), Western Zone (Pune), Southern Zone (Chennai) and Central Zone (Bhopal). Since Monday, August 12, chairperson Justice Prakash Shrivastava has been virtually hearing cases listed before the Kolkata bench, along with expert member Senthil Vel. The Supreme Court has, in previous orders, granted tenure extension to three judicial members and two expert members of NGT, given the vacancies and continuing search and selection process. On January 16, 2023, a bench headed by former Chief Justice DY Chandrachud ordered that Justice Sheo Kumar Singh, judicial member of the Bhopal bench of NGT, will continue until the selection process for new judicial members is completed. Justice Singh's tenure in Bhopal will end immediately after a newly appointed judicial member assumes charge. Similarly, on April 3, a bench of Justice Surya Kant and Justice Nongmeikapam Kotiswar Singh ordered the extension of tenure for two judicial members and two expert members of the NGT. This allowed judicial members Justice Agarwal and Justice Sthalekar, and expert members K Satyagopal and Verma to continue. All were due to retire in April. Under the NGT Act and as per appointment norms, a judicial member is appointed for five years or till he attains the age of 67 years, whichever is earlier. Justice Singh was due to demit office in 2023; however, he was granted an extension and was also briefly acting chairperson of the NGT until the present chairperson, Justice Prakash Shrivastava, was appointed. A judicial member should be a former judge of the High Court, or a district or additional district judge for 10 years or an advocate with substantial experience in environmental litigation matters before NGT, HC, or SC. Meanwhile, expert members are supposed to have a degree or a Master's in science with 25 years of experience in the relevant field, and five years of practical experience in the field of environment and forests in a reputed national institution. Former state or Central Government officials are eligible for this role.

The Supreme Court on Wednesday said the 11 documents required to be submitted by an elector for Bihar's special intensive revision (SIR) of electoral roll as opposed to seven documents in summary revision conducted previously showed the exercise was "voter friendly". A bench of Justices Surya Kant and Joymalya Bagchi, which resumed hearing on a batch of pleas challenging the June 24 decision of Election Commission to conduct SIR in poll bound Bihar, said despite petitioners' arguments that non-acceptance of Aadhaar was exclusionary, it appeared the large number of documents was "actually inclusionary". "The number of documents in summary revision conducted earlier in the state was seven and in SIR it is 11, which shows it is voter friendly. We understand your arguments that non-acceptance of Aadhaar is exclusionary but a high number of documents is actually inclusionary," the bench said. The top court noted electors were required to submit any one of the 11 documents in the list. Senior advocate Abhishek Singhvi, appearing for the petitioners, disagreed and submitted the number of documents may be high but they had the least coverage. Giving an example of passport availability with the electors, Singhvi said it was only one to two per cent in Bihar and they have no provision for permanent resident certificates given in the state. "If we see the availability of documents with the population in Bihar it can be seen the coverage is very low," he said. The bench said the coverage of 3.6 million of passport holders in the state appears to be good. "The list of documents is prepared normally after taking feedback from various government departments to ensure maximum coverage," Justice Bagchi pointed out. On August 12, the top court said inclusion and exclusion of citizens or non-citizens from the electoral rolls was within the remit of the Election Commission and backed its stand to not accept Aadhaar and voter cards as conclusive proof of citizenship in the SIR of voters' list in Bihar. As the row over the ongoing SIR escalated inside and outside Parliament, the top court also observed that the dispute was "largely a trust deficit issue since the Election Commission(EC) has claimed that roughly 6.5 crore people of the total 7.9 crore voting population in poll-bound Bihar didn't have to file any documents for them or their parents featured in the 2003 electoral rolls.
