Gujarat high court orders bank to defreeze account not linked to offence
Ahmedabad: After a bank froze the account of an Ahmedabad company at the request of Andhra Pradesh police during the investigation of a cheating case, the Gujarat high court ordered the bank to de-freeze the account. The court found that the transaction involving the account was unrelated to the offence under investigation. The case involved Capital Engraving, a company manufacturing advanced gravure cylinders. It had supplied goods worth Rs 9.65 lakh to Melancia Foods Pvt Ltd from Tirupati in Andhra Pradesh last year. Melancia transferred Rs 4.54 lakh as part payment in Sept last year. Around then, an individual named Gnana Prasad, proprietor of Latha Priya Enterprise and a regular customer of Melancia, filed a complaint with the Cyber Crime Cell in Tirupati, alleging cheating of Rs 2.01 lakh. Investigating sleuths found that Melancia had transferred money to Capital Engraving's account at the Science City branch of Kalupur Commercial Co-Operative Bank Ltd. Police issued a notice to the bank, asking it to freeze the account under the provisions of Sections 94 and 106 of BNS. The bank complied with police's directions. Upon reviewing the bank statement, the high court stated that the money transferred was related to a business transaction. "Considering all the aforesaid, since there is nothing on record to show the connection between the account of the petitioner and the offence under investigation at Alipiri police station, the present petition deserves consideration… The present petition is allowed."
