YouTuber Ethan Klein Loses Anti-SLAPP Appeal in Producer Ryan Kavanaugh Defamation Case
Klein — who is famous for his H3H3 podcast and Internet troll persona — filed an anti-SLAPP motion to try to get the former Relativity Media CEO and film financier's initial complaint stricken, claiming his comments fall under free speech after Kavanaugh accused the influencer of defamation.
'Ryan Kavanaugh brought an action against Ethan Klein and Ted Entertainment, Inc. (TEI) for defamation and defamation by implication alleging they falsely accused him of running a Ponzi scheme,' the court explained in summary in documents obtained by TheWrap. 'The trial court denied defendants' anti-SLAPP motion to strike Kavanaugh's complaint. We affirm.'
According to the filings, the case started when Variety published a June 2019 article entitled, 'Ryan Kavanaugh Accused by Ex-Partner of Running a Ponzi Scheme.' In it, the trade wrote that 'Elon Spar filed a lawsuit against Kavanaugh in Los Angeles Superior Court on June 6, 2019, alleging Kavanaugh persuadedhim to go into business with Kavanaugh under false pretenses. Spar had developed an idea for a stock exchange in which buyers could purchase equity in film projects.'
However, the outlet later updated its coverage to include a statement from Kavanaugh's team that he and Spar had 'satisfactorily resolved all of their issues.'
Then in April 2021, Triller Fight Club II sued Klein and his podcast company for copyright infringement after they used footage of their pay-per-view fight and music event without permission. At the time, Klein alleged that Kavanaugh was behind the lawsuit despite not being directly involved (the former Relativity Media producer was also the founder of Proxima Media, which had a controlling stake in Triller from 2019-2022).
'Kavanaugh's complaint alleges that beginning on June 11, 2021, Klein launched a campaign to harass and defame him in retaliation for Triller Fight Club II's copyright action,' the court docs detailed. 'Klein used his YouTube channels and other social media platforms to disseminate the defamatory accusation in the Variety article that Kavanaugh ran a Ponzi scheme. Within hours of its publication in Variety, that accusation had been retracted and the article had been corrected. Klein knew of the retraction and correction but repeatedly republished the false accusation over the following months.'
Ultimately, Kavanaugh's lawyer Amy McCann Roller issued the following statement: 'This is an important case about the growth of online and professional trolling, which required a real analysis of when free speech is no longer a harmless opinion.'
According to the court, Kavanaugh will now be allowed to pursue damages.

In her first video showcasing the property, Jana entered the 2,152-square-foot home, revealing a spacious floor plan with bedrooms on every story, as well as a basement and a sizable living area. The reasonably priced, ranch-style home is in northwest Lincoln. It has a main living room with super shiny flooring and two windows, and it flows to the dining area and galley-style kitchen. There are three bedrooms on the first level, while the other two are on the lower floor, along with a rec room and second bath. The yard is fully fenced, and there's also a storage shed and a two-car garage. Their first project involved combining two of the first-floor bedrooms into a primary suite, which would include an en suite bathroom, Jana explained. Meanwhile, the duo carried out a full gut renovation of the kitchen, with the newly pregnant reality star turned YouTuber admitting that they'd had to set up a temporary cooking space in another room while they completed the work. In her most recent video about the renovation, which was posted in April, Jana revealed that work on the property was essentially complete, with just a few additional design details left to finish off. Among these were the addition of a ventilation system in the kitchen, which the former TLC star showed herself completing with relative ease—before she moved on to cutting wood that would serve as new shelves inside one of their cupboards. While Jana ran into a slight complication when she realized that she had failed to cut the wood to the right size for the space, she managed to trim it down to be the perfect fit after a few more tries. "As the saying goes, 'Measure twice, cut once,'" she joked as she set about trimming the wood yet again. She and Stephen were also seen putting together furniture for various spaces in the home, before unboxing some larger items, like a new swivel chair for the living room. Trial of Hong Kong press mogul Jimmy Lai resumes closing arguments
Aug. 18 (UPI) -- A court in Hong Kong resumed closing arguments in the criminal trial of media mogul Jimmy Lai on charges of sedition and collusion with foreign powers. The trial had paused Friday because Lai, 77, was having heart issues. Lai was given medication and a Holter monitor, which tracks the heart's electrical activity. The trial had also been delayed Thursday because of torrential rain in the city. Judge Esther Toh said extra breaks could be allowed for Lai if needed. Lai, a citizen of the United Kingdom, founded Apple Daily, a Chinese-language newspaper published in Hong Kong from 1995 to 2021. The tabloid has been described as anti-government, pro-democracy and anti-China. He is accused of collusion with foreign forces and sedition. He has been in solitary confinement since December 2020. He faces life in prison. Prosecutors have accused Lai of requesting foreign countries to engage in "hostile activities," such as imposing sanctions, against authorities in Hong Kong and mainland China. He allegedly conspired with senior editorial staff of Apple Daily and was the "mastermind and financial supporter" of the Fight for Freedom; Stand with Hong Kong advocacy group, which lobbied for international sanctions against Hong Kong and China. Lai denied in court that he had ever sought to influence the Hong Kong policies of other countries via his high-level contacts overseas, including former U.S. Vice President Mike Pence and former Taiwan President Tsai Ing-wen. Questioned about meetings with Pence and then-U.S. Secretary of State Mike Pompeo in 2019, Lai said the meeting with Pence was more of a briefing where he updated him and answered questions about what was going on in Hong Kong Lai, who was noticeably thinner Monday than when the trial began in late 2023, was dressed in a white jacket in the glass dock and pressed his palms together in a prayer gesture several times to his family and supporters, the Independent reported. The prosecutor discussed the security law concerning the collusion charges, arguing that the request to impose sanctions must include officials and not just states. He planned to lay out other issues in the afternoon and make his closing statement on Tuesday. Lai is among hundreds of people who have been detained and charged under the controversial National Security Law, which critics say have silenced dissent in Hong Kong.
