
Use RTI to seek reasons for public employment and policy deviations
In a compelling example of how the Right to Information (RTI) Act can be used to challenge administrative decisions, a former professor and RTI activist has raised critical questions about a recent order issued by the Department of Higher Education in Tamil Nadu, which allows re-employment of certain college-level administrative officers beyond the age of superannuation. On July 31, the department issued an order permitting the re-employment of those engaged in administrative functions, even after crossing the age of 60 years. This move, based on a request from the Commissioner of Collegiate Education, sparked concern over its legality and consistency with existing government norms.
RTI activist seeks answers:
N R Ravisankar, an RTI activist and former Head of the Mathematics Department at CBM College, Coimbatore, submitted a formal representation to the Principal Secretary, Department of Higher Education, raising a red flag on the order. He cited Government Order (G.O.) 192 dated November 12, 2024, which had categorically barred re-employment for such positions beyond the age of 60.
Prof. Ravisankar argues that the new order contradicts this amendment to G.O. 92, which states: 'Every government servant in the superior as well as basic service shall retire from service on the afternoon of the last day of the month in which they attain the age of 60 years. They shall not be retained in service after that age.'

Was the re-employment order placed before the Tamil Nadu Legislative Assembly or its relevant committee for oversight, especially in light of its policy implications?
Is there any provision under existing UGC regulations or the Tamil Nadu Government Servants' Conduct Rules that permits administrative staff to continue beyond superannuation age, specifically in aided colleges?
What was the rationale behind cancelling re-employment in an earlier instance—such as the case of a government-aided college in Coimbatore where a new principal was directed to be appointed upon the previous incumbent's retirement?
Does the July 31, 2025 G.O. apply to government-aided institutions as well? If yes, how does this comply with the statutory and financial norms applicable to such institutions?

This principle is directly relevant to the July 31, 2025 re-employment order issued by the Tamil Nadu Department of Higher Education. Based on that ruling, the following implications arise:

Kerala HC orders interim stay on proceedings in FIR against actor Shwetha Menon over obscene content
Kerala High Court on Thursday stayed the proceedings in connection with the FIR lodged against Malayalam film actor Shwetha Menon for allegedly publishing or transmitting obscene scenes of some of her past movies and advertisements. The court also issued notice to the state and the complainant on whose complaint a magisterial court had ordered lodging of the FIR. An FIR under section 67 (publishing or transmitting obscene material in electronic form) of the Information Technology (IT) Act and provisions of the Immoral Traffic (Prevention) Act was lodged against the actor. An officer of Ernakulam Central police station told PTI that no case was initially registered based on the complaint, but the activist went to court to seek registration of an FIR. About the complaint Social activist Martin Menachery filed a complaint against Shwetha. The complaint alleges that Shwetha had shot some obscene scenes in her past movies and that these were being circulated online on social media and various sites. The complaint specifically cited the actor's roles in films like Rathinirvedam, Paleri Manikyam: Oru Pathirakolapathakathinte Katha, and Kalimannu, in addition to her appearance in a condom commercial. Shwetha is currently contesting for the post of president of the Association of Malayalam Movie Artists (AMMA). Malayalam superstar Mohanlal had stepped down from the same post last year in the wake of the Justice Hema Committee Report. The election to the executive committee is scheduled for August 15. Supreme Court directs states to act on orphans missing out on free schooling rights
The Supreme Court has instructed all states to conduct a comprehensive survey to identify orphaned children who have been deprived of their right to education under the Right of Children to Free and Compulsory Education (RTE) Act, 2009.A bench comprising Justices B V Nagarathna and K V Viswanathan issued the directive while hearing a public interest plea concerning the welfare and educational rights of orphans across the country. The Court also asked the Centre to consider including data on orphans in the upcoming 2027 national gaps in existing welfare policies, the petitioner argued that both central and state government schemes for orphaned children fall short of addressing their educational and social needs. The Court echoed the concern, noting that there is currently no official nationwide record of orphaned children, a void that hampers effective policymaking. In its order, the bench directed all states to carry out a two-part survey: one, to record orphaned children who have already been admitted under provisions of the RTE Act, and two, to identify those who have been denied this right, along with the reasons behind it. The states have been given four weeks to file their respective bench further urged that, while data collection is underway, authorities must make parallel efforts to ensure that eligible orphaned children are immediately enrolled in nearby also took note that certain states, including Gujarat, Delhi, Meghalaya, and Sikkim, have already amended policies to include orphaned children within the 25 percent reservation quota for economically weaker sections and disadvantaged groups under Section 12(1)(c) of the RTE Act. The Court encouraged other states to consider issuing similar notifications and submit related affidavits before the next hearing scheduled for September the proceedings, the petitioner strongly advocated for the inclusion of orphan status as a demographic indicator in the forthcoming census. 'There should be a dedicated field for orphans,' the bench remarked, directing this request towards Solicitor General Tushar Mehta, who was present for a different positively, Mehta said, 'It should be. I will take this up. Orphans are our responsibility.'The Court acknowledged that juvenile justice committees in all High Courts and several national consultations are already addressing these concerns, suggesting that progress is being the petitioner contended that while India offers a range of benefits including reservations, scholarships, and jobs to children from Scheduled Castes, Scheduled Tribes, and Other Backward Classes, there remains a glaring absence of structured support for orphans.
