Waqf Act designed to 'capture Waqf properties' through a process which is non-judicial, petitioners tell SC

New Delhi [India], May 20 (ANI): The Supreme Court on Tuesday was told by petitioners challenging the Constitutional validity of the Waqf (Amendment) Act, 2025, that the Act has been framed to protect Waqfs but in reality, it is designed to 'capture Waqfs' through a process which is non judicial.
Senior advocate Kapil Sibal, appearing for petitioners, objected to the provision empowering a government Officer to decide disputes about whether Waqf properties have encroached on government land.
He said that private properties are being taken away only because of dispute. 'A officer above Collector is appointed to see the dispute, and meanwhile till the dispute is decided, the property is taken away and loses its character as a Waqf property,' Sibal argued.
A bench of Chief Justice of India BR Gavai and Justice Augustine George Masih was hearing the arguments on interim relief in the case.
The senior advocate further told the bench that the 2025 amendments nullified the principle 'once a Waqf, always a Waqf.'
Sibal contended that earlier, though the property was preserved as an ancient monument the identity of the property did not change from being a Waqf and get transferred to the government.
'Now such Waqf property shall be void, and once Waqf is void, people will be stopped from going to pray. The right to freely practice religious activity is curtailed,' contended Sibal.
To this, CJI said that people still go and pray at Khajurao temple though it is preserved as an ancient monument.
He further argued that under the previous law, non-registration of the Waqf properties did not affect the validity of the Waqfs and the only consequence was that the Muttawalli would have to pay some penalty.
'However, the 2025 amendment makes a complete departure to state that if there was no registration, the Waqf will no longer be recognised,' he added.
Next, Sibal objected to the provisions allowing the nomination of non-Muslims to the Central Waqf Council and the state Waqf Boards.
He further pointed out that in none of the laws relating to Hindu endowments, persons from other religions are allowed.
On the Centre's stand that the 2025 amendments are to regulate the secular aspects of property administration, Sibal said the creation of Waqf is not a secular activity. 'It is a Muslim's property which he dedicates to God,' he added.
Senior advocates Rajeev Dhawan, Abhishek Manu Singhvi, CU Singh also argued for the petitioners.
The bench will continue hearing the arguments of Centre.
The previous bench headed by the then CJI Sanjiv khanna had said it will consider three issues for interim relief -- de-notifying Waqf properties whether they are Waqf by deed or Waqf by user, nomination of non-Muslims to the Waqf Council and State Waqf Boards and identification of government land under Waqf.
Solicitor General Tushar Mehta, representing the Centre, had earlier assured the apex court that the three key provisions of the Waqf Act will not be given effect to for some time.
Solicitor General of India had also given an assurance that no appointments will be made to the Waqf Council or Waqf boards.
A batch of petitions challenging the Act was filed before the apex court contending that it was discriminatory towards Muslim community and violates their fundamental rights.
Six Bhartiya Janta Party-ruled states had also moved the apex court in the matter, in support of the amendment.
President Droupadi Murmu on April 5 gave her assent to the Waqf (Amendment) Bill, 2025, which was earlier passed by Parliament after heated debates in both Houses.
Central government had filed its preliminary affidavit in the Supreme Court while seeking dismissal of petitions challenging constitutional validity of Waqf (Amendment) Act, 2025 as it said law was not violative of the fundamental rights guaranteed under the Constitution.
The Centre in its affidavit had said the amendments are only for the regulation of the secular aspect regarding the management of the properties and hence, there was no violation of the religious freedoms guaranteed under Articles 25 and 26 of the Constitution.
The Central government had urged the court not to stay any provisions of the Act said that it is a settled position in law that constitutional courts would not stay a statutory provision, either directly or indirectly, and will decide the matter finally. (ANI)

The Tripura police arrested Congress youth leader Shahjahan Islam's father and brother on Monday, hours after Islam's home in Agartala came under attack following his criticism of the government and police over incidents related to animal sacrifice for Eid al-Azha. The BJP filed a police complaint against the Congress leader over his comments about Chief Minister Manik Saha and BJP minority wing leader and state minority board chairman Jashim Uddin, among others, on social media. In a social media video, Shahjahan Islam was seen lashing out at the police and the state government for purportedly failing to stand up to miscreants who allegedly interrupted the customary animal slaughter on Bakrid and was seen spitting, expressing disgust for the police. The Congress leader also allegedly used derogatory language for Saha and called BJP minority leaders cheats, urging Muslims to 'socially boycott' community members who are leaders in the saffron party. 'He made obscene comments about the chief minister and the state government on social media. He also made comments on minority morcha leaders and myself. On one hand, there has been an attempt to malign the state government and on the other hand, there is a conspiracy to create unrest among communities. All these are found in his Facebook post,' said BJP minority wing state president Billal Miah, the complainant in the case. Islam's comments sparked a controversy online. Meanwhile, the Congress protested in Unakoti district against the attack on Islam's house in Agartala's Shantipara area, while the BJP held a protest rally in the capital condemning his remarks. In his statement to the police, Islam said he was attacked by a band of goons as soon as he returned home from the state Congress office on Sunday night. He also alleged that the goons, who were brandishing firearms, wanted to murder him but failed since he had locked himself inside a room and later assaulted his parents and wife. There were clashes related to animal sacrifice in different places in Gomati district's Udaipur area. Four people were arrested for allegedly slaughtering a cow in public near a waterbody in the Chhanban area on Saturday. Opposition political parties condemned the attack on Islam's home and demanded action. Leader of the Opposition Jitendra Chaudhury said, 'This incident is deeply worrisome and condemnable. The youth who made a video, if he said such things about the CM, I don't support it. It should not be done. But the incident that happened as a reaction was even more wrong.' The CPM leader said Congress MLA Sudip Roy Barman and state president Ashish Kumar Saha, who visited the site of the violence, might also have come under attack if the police were not present there. He further alleged that some locals were threatened that their houses would be ransacked if they did not leave the locality by Monday evening. Chaudhary added that he called up the DGP over the issue. 'The state government should take steps so that law and order does not deteriorate. Or else, they won't be able to contain the outrage,' he said. Congress leader Birajit Sinha also condemned the attack and said the culture of attacking houses started after the BJP came to power.

Rashtriya Janata Dal (RJD) leader and Rajya Sabha member Manoj Jha on Monday (June 9, 2025) raised serious concerns over the Centre's intentions for the caste census. Mr. Jha said the policies of Bharatiya Janata Party (BJP) were not only anti-reservation, but also conspiring to mislead the Backward Classes (BC) and Extremely Backward Classes (EBC). He alleged that the government was pretending in the name of a caste census, and there was a lack of transparency in the entire process. 'After the painful incident of Pahalgam, suddenly the Prime Minister realised that it is necessary to conduct a caste census as per the demand of most of the people, so he announced it in a hurry. But the move, character and face of the BJP, which has always been anti-Bahujan and against reservation, is now visible,' Mr. Jha said while addressing the press at the party office in Patna. 'Our national president Lalu Prasad ji has been warning that those who follow Bunch of Thoughts politics on the ideas of Guru Golwalkar can never be serious about reservation, which is now clearly visible,' he added. Mr. Jha asserted that the Centre wanted to create confusion in the name of the caste census and questioned the reason behind the government announcing that population figures for OBCs would not be released. He added that such figures were necessary as per Article 340 of the Constitution, he added. 'When the castes are counted and the figures are not revealed, then which policy will be implemented towards reservation and increasing the reservation in the private sector? NITI Aayog and other agencies can work on planning, social, economic upliftment and increasing reservation on the basis of data only when the data comes from the government level,' Mr. Jha said. Accompanied by the party's chief spokesperson Shakti Singh Yadav and national vice-president of the party Uday Narayan Choudhary at the press briefing, Mr. Jha pointed said that besides party leader Tejashwi Yadav, leaders from the Congress, Samajwadi Party and Dravida Munnetra Kazhagam (DMK) were also in favour of the figures being published. Mr. Choudhary, on the other hand, said that the caste census was a hoax and nothing had been disclosed in this regard. He explained that the caste survey was conducted in Bihar under pressure from Mr. Yadav. Still, the 65% reservation benefit was not being given because the intention of the BJP and the Nitish Kumar government was not right, he charged. Tejashwi's demands Earlier in the day, in a post on X, Mr. Yadav addressed Chief Miniser Kumar about responding to his letter dated June 5 on increasing the reservation to 85% for all deprived classes in Bihar. 'Nitish ji you did not respond to my letter, is it because you have no answer or your officials do not show you the letters? The parties that beat the drum of social justice, on whose strength the Modi government is running, why are they failing to include the 65% reservation limit increased by our government in the 9th Schedule of the Constitution?' Mr. Yadav asked. 'The Chief Minister Nitish Kumar, Union Minister Chirag Paswan, Jitan Ram Manjhi, Upendra Kushwaha should speak out on the issue of reservation against this injustice faced by Dalit, Adivasi, backward, and extremely backward classes. Politics is not just about clinging to power,' he added. Mr. Yadav further said, 'If all these people cannot even get this small demand fulfilled by the Prime Minister, then their politics and staying in such an alliance is shameful. If Nitish Ji is unable to speak on this issue in front of the Prime Minister and Home Minister, then he should call a special one-day session of the Assembly, and then see how we get it implemented.'
