State home dept directs police to file chargesheets within time limit

Pune: In a bid to expedite the criminal justice process, the state home department has issued fresh directives mandating police officials to file chargesheets within fixed time limits. Police unit commanders across the state have been instructed to ensure strict compliance and avoid unnecessary delays, as per the directives issued on May 26.
According to the new guidelines, chargesheets in serious offences punishable by life imprisonment or death under relevant sections of the Bharatiya Nyaya Sanhita (BNS) must be filed within 90 days. For offences carrying a punishment of up to 10 years, the timeline has been set at 60 days. Similarly, for crimes attracting sentences between three and seven years, police must submit chargesheets within 60 days.
The department has emphasised that pending chargesheets delay justice and urged all units to adhere to the timelines without exception. Failure to file a chargesheet within the prescribed period can render the arrest illegal, potentially allowing the accused to obtain default bail.
In his communication to officers at the city police commissionerate after the directives from the home department, additional commissioner of police (Administration) Sanjay Patil pointed out that many investigators mistakenly believe that the time limit for filing chargesheets in offences punishable with up to ten years' imprisonment is 90 days, leading to confusion. He stated that all investigating officers must file chargesheets expeditiously, failing which the accused may secure default bail.
'The police officials must submit the chargesheet before the court within the deadline without any delay,' his note to police stations read.
The home department has cited the Supreme Court's ruling in Rakesh Kumar Paul vs State of Assam, where the court held that in cases where punishment extends up to 10 years, for the purpose of default bail, the matter falls under Section 167(2)(a)(ii) of the CrPC. In such cases, if the chargesheet is not filed within 60 days, the accused is entitled to be released on bail.
Advocate Milind Pawar said there was an urgent need for police reforms and a clear consensus on the importance of separating investigation from law and order duties. He noted that this would help conclude investigations more swiftly and prevent prolonged custody of individuals who may ultimately be found innocent.
'Default bail is an indefeasible right, which means it cannot be lost, annulled, or overturned. The court order clearly states that default by the investigating agency in not filing the chargesheet within 60 days entitles the accused to be released under Section 167(2) of the Code,' he said.
A chargesheet is the final report prepared by investigating officers after completing their probe in a cognisable or non-cognisable offence. Also referred to as the police report or final report, it records the sequence of events from the filing of the first information report (FIR) to the conclusion of the investigation and the preparation of the report. It must be submitted to the court before proceedings against the accused can commence. Once the chargesheet is filed, prosecution in the case officially begins.

Sanjeev Kumar, alias Sanjeev Mukhiya, a key accused in the NEET 2024 question paper leak case, has been granted bail. The CBI special court, located within the civil court premises, has ordered his release from judicial custody. This decision was made according to Section 167 of the Code of Criminal Procedure (CrPC), which stipulates that a charge sheet must be filed within 90 days of arrest. Regarding the NEET-2024 exam question paper leak, conducted by the National Testing Agency, the special CBI court at Patna Civil Court has granted bail to Mukhiya. He had submitted an application to Judge Sunil Kumar Singh, stating that he had been in judicial custody for 90 days, but the CBI had not yet filed a charge sheet against him. After hearing arguments from both sides, the court applied Section 167 of the CrPC and ordered Mukhiya's release on bail. It is noteworthy that the NEET exam was held nationwide on May 5, 2024. Amar Kumar, the in-charge of Shastrinagar police station in Patna, arrested several individuals for tampering. The case was later transferred to the Economic Offenses Unit. When the question paper leak came to light, the central government handed the investigation over to the CBI, which registered its FIR on June 23, 2024. Since then, the investigation has been ongoing. To date, 49 individuals have been arrested in connection with the NEET question paper leak case. The CBI filed the initial charge sheet against 13 accused on July 1, 2024. Subsequently, the first charge sheet against 6 individuals was filed on September 19, 2024. The second supplementary charge sheet was filed on October 7, 2024 against 21 accused in jail, followed by a third supplementary charge sheet against one individual on November 7, 2024. The fourth supplementary charge sheet was filed against four individuals on November 22, 2024. The National Testing Agency conducts the National Eligibility cum Entrance Test-Undergraduate (NEET-UG) for admissions to MBBS, BDS, AYUSH, and other related courses in both government and private institutions nationwide. The petitioner's counsel argued that the three questions were incorrect, citing two expert opinions that supported this claim. He stated that these questions affected the petitioner's score by 13 marks. 'These (three) questions were absolutely wrong. I have taken two expert opinions and those experts also concur with my views. They have certified my views," the counsel of the petitioner argued. The bench noted that the exam had already concluded. 'You withdraw this and go to the high court," the bench suggested, emphasising not wanting to deny the petitioner any remedy. The counsel requested that the Supreme Court appoint a panel of experts to review the questions within three days and consider their opinions. After the bench expressed unwillingness to entertain the plea, the petitioner's counsel decided to withdraw it. Tractor driver dies while unloading cement blocks in Udupi; police register case

UDUPI: A tractor driver from Udupi died in a accident while unloading cement blocks on Friday The deceased is Sangappa Kirasur, 54. In a complaint, his son Maruti Kirasur stated that his father was employed by Mandavi Builders and was operating a tractor-trolley to transport cement blocks from the Manipal Industrial Area to various construction sites of the said builders in the Udupi-Manipal region. As usual, on August 1, Sangappa left for work, loaded the vehicle with cement blocks at the Manipal Industrial Area, and drove the tractor. Around 4 pm, while reversing the tractor down the ramp into the basement parking area of a building near the Moodanidambur service bus stand in Udupi taluk, the front of the tractor lifted off the ground. In the process, Sangappa slipped and fell between the tractor and trolley, suffering a severe head injury. Ganesh, the supervisor at the building, informed the complainant that Sangappa was immediately rushed to Adarsha Hospital for treatment. However, upon reaching the hospital, doctors informed the complainant that Sangappa died on the way. According to the complaint, the accident was caused due to Sangappa's negligence, as he operated the tractor-trolley in reverse without following proper safety and precautionary measures. Based on the complaint, Udupi Town Police have registered a case under Section 106(1) of the Bharatiya Nyaya Sanhita (BNS).
