Online bullying can be as mentally traumatic as physical violence: Delhi HC

Hindustan Times13 hours ago
Cyberbullying can be as mentally traumatic and scarring as physical violence, the Delhi High Court has said, while upholding the conviction of a man who sent morphed nude images and threatening messages to a minor girl studying in Class 9. The judgment, delivered on July 28 by Justice Swarana Kanta Sharma, stressed the devastating psychological impact of online harassment, particularly on children. (HT Archive)
The court rejected his appeal against a five-year sentence, describing the case as a 'textbook example of cyberbullying.'
The judgment, delivered on July 28 by Justice Swarana Kanta Sharma, stressed the devastating psychological impact of online harassment, particularly on children.
'What is deeply concerning is the use of technology to commit cyberbullying – an act that, while faceless and silent, can be as mentally traumatic and scarring as physical violence, especially when directed towards children. Such conduct, in the virtual world, has very real and devastating consequences in the real world,' justice Sharma said.
The conviction stems from a complaint filed in September 2016 by the victim's mother. The minor girl, then in Class 9, was using a tablet for studying when she received morphed obscene images of herself along with threatening messages on WhatsApp. The sender, a man known to the family, warned her that the photos would be circulated if she didn't comply with his demands.
The trial court in March last year had convicted him under various provisions of the Indian Penal Code including sexual harassment, stalking, criminial intimidation, sections 12 (sexual harassment) and 14 (using child for pornographic purposes) of Protection of Children from Sexual Offences (Pocso) Act, 2012 and section 67 (publishing or transmitting obscene material in electronic form) under the Information Technology Act.
Challenging the verdict, the man claimed he was falsely implicated and that the case was full of contradictions. The Delhi Police, however, maintained that the evidence clearly showed he had transmitted obscene material and had criminally intimidated a minor.
Justice Sharma, in her 35-page ruling, upheld the trial court's decision. She said that even the threat of circulating morphed images, without actually doing so, can cause irreparable long-term damage to a child's mental well-being and dignity. The act of morphing her face, the court added, sought to not only shame her but to coerce her by creating fear.
'A morphed image once created and circulated can have long-term consequences for a child's mental health, dignity, and reputation,' the judge observed. 'The fear of such circulation alone, even if the image is never actually published, is enough to terrorise a young mind.'
The court also highlighted the urgent need to protect children in digital spaces. With growing reliance on gadgets for education, it said, the notion of child safety must extend beyond physical environments. 'This court is of the view that creating a safe environment for children cannot be restricted to physical spaces alone. The modern world demands that equal protection be extended to digital spaces, where children are now spending considerable time,' the court said.

Tamil Nadu Pastor Who Used Home Church As Cover To Sexually Abuse Minor Schoolgirls Held

Last Updated: Victor Kamaraj, a 54-year-old preacher, was arrested for sexually assaulting over ten female students in Thiruvallur. Evidence from his phone led to his arrest under the POCSO Act In a disturbing development, a 54-year-old self-proclaimed religious preacher, identified as Victor Kamaraj, has been arrested for allegedly sexually assaulting over ten female students near Sengunram in Tamil Nadu's Thiruvallur district. The arrest comes amidst a troubling increase in sexual assault incidents reported in the region. Kamaraj, who operated a church from his home, reportedly took advantage of a tuition program run by his wife, an Anganwadi centre employee. It was during these evening classes for schoolgirls that the alleged assaults occurred. Parents of the victims filed a complaint, prompting a police investigation. Sources indicate that a crucial piece of evidence emerged from Kamaraj's cell phone, which reportedly contained information confirming the sexual harassment of the students. Following this discovery, police swiftly arrested Kamaraj under the Protection of Children from Sexual Offences (POCSO) Act. He was subsequently produced in court and is currently lodged in Puzhal jail. This arrest is the latest in a series of alarming incidents of sexual assault in the Thiruvallur area. Just recently, an Assamese youth was apprehended in a separate case involving the kidnapping and sexual assault of a girl in a neighbouring village. Adding to these concerns, another harrowing incident unfolded mere days later in the Kanakamma Chathiram area, where expansion work for the Chennai-Tirupathi National Highway is underway. A 17-year-old girl walking by was allegedly abducted and subjected to an attempted rape by a young man, reportedly working on the highway project. Her screams alerted local villagers, who bravely intervened. The assailant attempted to flee but was chased down, apprehended by the villagers, and then handed over to the police. Ex-film producer arrested for duping Delhi woman of over ₹12.85 lakh

A 25-year-old former Marathi film producer was apprehended from Maharashtra's Pune for allegedly duping a resident of Delhi of over ₹12.85 lakh through a fake cryptocurrency investment scheme, an official on Saturday said. A team from Delhi Police conducted a raid in Pune and apprehended Kale.(Unsplash/representational) The accused, identified as Akshay Ashwin Kale, posed as a financial advisor and lured unsuspecting victims into investing in fake cryptocurrency schemes, he said. Deputy Commissioner of Police (DCP), West, Vichitra Veer, said that a complaint was received on May 20 at the Cyber Police Station in which a Delhi resident alleged that he was defrauded of ₹12.85 lakh by a man posing as a crypto investment consultant. "The complainant was promised lucrative returns. He was contacted through social media and guided to invest money in what appeared to be a legitimate cryptocurrency trading platform. Trusting the process, the complainant deposited ₹12.85 lakh in multiple tranches," he added. The DCP said that access was denied when the complainant attempted to withdraw his investment. Police traced the flow of funds during investigation and found that the money had been dispersed across 29 different bank accounts, said the officer, adding that a breakthrough came when one of the accounts was found actively withdrawing funds via ATMs in Pune. A team from Delhi Police conducted a raid in Pune and apprehended Kale. Further investigation revealed that Kale, who had previously worked as a producer in the Marathi film industry, suffered significant financial setbacks and subsequently turned to cybercrime for quick money. "He created a web of fake bank accounts and used cryptocurrency as a front to collect funds. He would then siphon off the money by converting it through multiple channels to avoid detection," the DCP said. Kale reportedly exploited his background as a financial advisor to build credibility among his targets. He targeted people with promises of high returns on crypto investments, only to disappear once funds were transferred, police said. Kale had earlier produced a few Marathi films before shutting down operations due to losses, they said. Further investigation is underway to identify other victims and associates involved in the racket, said police suspecting that more people may have fallen prey to this scheme.

Man arrested for assaulting IT employee and female colleague from another faith in Hyderabad

A 24-year-old bike-taxi rider was arrested by Saifabad police for assaulting a man and a woman near the Ambedkar statue on NTR Marg in Hyderabad and circulating a video of the incident on social media in a manner intended to provoke communal hatred. The incident occurred at around 3.45 a.m. on Tuesday (July 29, 2025) when the accused, Mohammed Raheel, intercepted an IT employee and his 24-year-old female colleague from a different community as they were heading home. DCP (Central) K. Shilpavalli said that Raheel approached them on his two-wheeler, began filming without their consent, and questioned the woman about being with a man from a different religion. 'He used abusive language, issued threats, assaulted both individuals, and threw a helmet at the man in an attempt to injure him. The victims fled the scene on their bike, but Raheel followed them and continued recording until they reached the Himayatnagar area,' said the DCP. On July 30, the man lodged a complaint with Saifabad police station and a case was booked under sections 196, 74, 79, 352, 115 (1), 126 (2), 131, and 351(3) of the BNS Act and Section 67 of the Information Technology Act. The video, which was later posted on Instagram and X, attracted attention and sparked communal commentary, putting the safety of the victims and their families at risk. The DCP said that the video exposed their identities, violated their privacy, and could lead to law and order issues. Raheel was traced using CCTV footage and apprehended near Charminar. During questioning, he confessed to the offence. His mobile phone and two-wheeler were seized. 'No one has the right to moral police others or harass people for their personal choices under the guise of religion or ideology. This was not just a privacy violation but a deliberate act to stir communal sentiments,' said the officer.
