
Delhi Court Convicts Man For Using Vulgar Language, Outraging Woman's Modesty
In a verdict reinforcing the right of women to live with dignity and without fear, a Delhi court has convicted a man under Sections 506 (Part II) and 509 of the Indian Penal Code for criminal intimidation and using obscene and abusive language intended to outrage a woman's modesty.
The incident involved the accused sending a series of highly vulgar and threatening messages to the complainant. Some of the messages included: "Darwaza khol de mujhe tere saath s** karna hai", "R** tujhe main bataunga, bahut samajhdar apne aap ko samajhti hai", and "R* darwaza khol de, nahi to main tujhe chhodunga nahi".
The court observed that such language goes far beyond casual abuse and directly targets the woman's character and dignity. "The word 'R**' is not a simple insult; it is loaded with sexual connotations, casting aspersions on the woman's morality and loyalty. These words are capable of shocking the conscience of any reasonable person," the court noted.
Citing multiple precedents, including Rupan Deol Bajaj v. KPS Gill and State of Punjab v. Major Singh, the court reiterated that the modesty of a woman is intrinsically linked to her gender, and words or acts that degrade her in this regard are punishable under law. "To constitute an offence under Section 509 IPC, it must be shown that the act or speech was intended to insult the modesty of a woman. In this case, that threshold is clearly met," the judge ruled.
The complainant had also alleged that the accused threatened her with rape and murder if she didn't comply with his demands. Statements such as "Darwaza nahi khola toh goli maar dunga" were held to constitute criminal intimidation under Section 503 IPC. The court held that these were not hollow threats but grave intimidations that created fear and terror in the mind of the woman.
The court noted that the accused, while testifying in his own defence, admitted that the messages originated from his mobile number. Although he claimed the messages stemmed from a rent dispute, he did not deny their vulgar content. His admission was taken on record under Section 58 of the Indian Evidence Act, which states that admitted facts need not be further proved.
The defence raised procedural objections, such as the absence of a Call Detail Record (CDR) analysis or IMEI number verification.
However, the court rejected these arguments, noting that the WhatsApp messages -- the main evidence -- had already been admitted by the accused himself. "Minor lapses in investigation do not affect the core of the prosecution's case, especially when the evidence is independently corroborated by the victim's testimony and the accused's own admission," the court said.
The court further discussed the legal contours of Section 509 IPC, clarifying that not all insults amount to an insult to modesty. However, when the words used are capable of "shocking the sense of decency of a woman," they fall squarely within the purview of this section. The court also explained that "modesty" as envisaged under law is not defined in the IPC but is broadly understood as "womanly propriety of behaviour."
Quoting Rupan Deol Bajaj, the court held that, "The ultimate test is whether the words or actions of the accused could be perceived as capable of outraging the modesty of a woman." Given the nature and content of the language used, the court held that this legal standard was clearly met.
The Court held that the prosecution had proven its case beyond a reasonable doubt, and the court convicted the accused under Section 506 (Part II) for criminal intimidation and Section 509 IPC for using words intended to insult the modesty of a woman.

Gujarat govt terminates services of APP in POCSO case after victim says he asked her to testify in favour of accused
The Gujarat government has terminated the services of an additional public prosecutor in Navsari for allegedly trying to protect a man booked under Protection of Children from Sexual Offences (POCSO) Act for the alleged rape of a minor. The State Home Department issued orders on August 14 terminating the services of Additional Public Prosecutor of Navsari Ajay Tailor with immediate effect, who was handling the POCSO case of 2024. The case has since been handed over to another APP of Navsari District Court, Bhavesh Gupta. The termination came after the victim wrote a letter to Minister of State for Home Harsh Sanghavi, the Navsari Superintendent of Police, and Additional District and Sessions Judge D K Dave on August 5 claiming that the APP had tutored her to testify in favour of the accused, who was charged of raping her some two years ago. The case is currently at the stage of recording testimonies of the complainant and witnesses in the Navsari court. The case goes back to May 22, 2023 when a teenage girl and resident of a town in Navsari district, left her house to attend her private classes and failed to return in the evening. Her parents searched for her but could not find her. They suspected the accused, an alleged bootlegger and lodged a missing complaint, naming him. The following day, the missing girl's father received a call from his daughter where she told him that she had 'married' a person (not the alleged bootlegger) That evening, the girl arrived at the local police station with her 'husband' and showed photos and their marriage affidavit to the officers. As per her wishes, the girl returned home with her parents. On June 24, 2023, the victim lodged a rape case and claimed threat to her life and named the accused (the alleged bootlegger) and six others including her 'husband' and an advocate. In her complaint, she said that her marriage was fake. Police booked the accused under IPC Sections 376 (2) (n)(rape committed repeatedly on the same woman), 323 (Punishment for voluntarily causing hurt), 504 (Intentional insult to provoke breach of trust), 506(2) (Punishment for criminal intimidation). In the FIR, the girl had alleged that the accused, a notorious criminal, started sending proposals to her in 2019. She stated, 'After my rejection, he chased me at different locations. Fed up with such harassment, my father got my admissions in a Diploma course in dairy management at a private university in Vadodara in 2021. The accused turned up at the college in August 2021 and threatened me that he would kill me and also die by suicide'. The accused, who is already married, allegedly took her to his friend's flat in Vadodara where he allegedly raped her. The victim learnt that he was already married and broke up with him and told her parents the whole story. On her parents' instructions, the victim quit studies and returned to her home in 2022. According to police, the girl's parents fixed her marriage in February 2023. The accused learnt of it and sent videos of them to the mother of the boy and they decided against going ahead with the marriage plan. The accused then forced her to marry his friend, who, he said, would 'divorce' her to facilitate their marriage. Thus the victim married the friend and appeared before the Navsari police and on her wish she was handed over to her parents after which she filed a complaint against the accused, charging him of rape. In her letter to the MoS (Home) and other officials, as seen by The Indian Express, she has alleged that the APP, Ajay Tailor, spoke to her on a ' WhatsApp call from the accused's mobile phone and instructed me to respond with 'yes' and 'no' during my testimony before the court. 'He (Tailor) also said that all the necessary papers for getting the accused let off from the case are ready. As per his instruction, I testified in favour of the accused before the court (on July 25, 2025). The accused also had threatened me to act on the instructions of Tailor and threatened that if I failed to do so, he) would post viral videos of them on social media and also threatened to kill my parents,' the victim alleged in her letter. She further alleged that the accused had called her and pressured her to meet the APP in his official chambers, before her testimony on July 25, 2025. 'I testified as tutored by the APP before the court, and he also told me about the consequences if I failed to act as per his directions,' she says in the letter. On finding that she was declared 'hostile', the victim filed another application before the Navsari Court a few days ago to allow her to testify again, against the APP. The second application of the victim was heard on Monday in the Court of the Additional District and Session Judge D K Dave. The new APP, Gupta, moved an application in the court and asked for more time as he wanted some days to study the case and get all the case documents. The Judge, D K Dave, had fixed a hearing on September 18. Navsari Superintendent of Police Sushil Agrawal said, 'Based on the application, after primary inquiry, APP Ajay Tailor's services as APP was terminated. The case was in hearing stage and the rape victim testified before the court on July 25, 2025.' Meanwhile, speaking to The Indian Express, Tailor denied the allegations of tutoring the victim. 'I have been practising as APP with Navsari district court since 2020, and till date I have fought and got convictions in 29 criminal cases. My track record shows how honestly I worked, and now my services have been terminated,' Tailor claimed. He added that he would accept the order and will continue practising as a lawyer in the Navsari district court. 'The victim had testified before the court last month and she replied according to the questions posed to her. I have not tutored her, nor have I met the accused before the hearing,' Tailor claimed. In 2024, the accused was booked under GUJCTOC (Gujarat Control of Terrorism and Organised Crime) Act. The Navsari district police also arrested and booked six of his family members including his father and brothers, in the GUJCTOC case for their alleged involvement in bootlegging and criminal activities. Presently, all the GUJCTOC accused are out on bail, and they are staying in the neighbouring Valsad district, acting on the conditions of the Gujarat High Court's bail order.

EOW apprehends 2 of land mafia for selling reserved land worth Rs3cr
Nagpur: The Economic Offences Wing (EOW) of Nagpur City Police apprehended two key members of a land mafia gang, Zafarullah Khan and Shadab Khan, for selling reserved land worth more than Rs 3 crores to gullible buyers. The arrests followed a complaint by Shahnawaz Ansari, who, along with another friend, was deceived into purchasing plots on land reserved by the Nagpur Improvement Trust (NIT) since 1961 for a sewerage and disposal plant. NMC also jointly held some portions of the reserved land. The accused, along with advocate Ahmed Abdul Karim Sheikh from Bhandara, allegedly conspired to sell plots in Bhandewadi, using forged sale deeds and fake land records. Ansari, who initially bought a plot in 2010, was misled in 2017 into purchasing additional plots after being told the land expanded in a survey. He paid Rs53 lakhs via cheque and cash for three additional plots on Chandmari Road, stated the complaint. On January 6, NIT's encroachment team revealed the land's actual status, exposing the fraud. EOW arrests former officer of minority finance corp for fraud
Lucknow: The EOW on Tuesday arrested a former field officer of the UP minority financial and development corporation, Khurshid Ahmed, in connection with embezzlement of margin money loans. Ahmed was arrested from his residence in Wazirganj following a detailed probe into fraudulent activities that occurred between 1996 and 2000 in Ghazipur. The case, registered under FIR number 1001/2000 at Kotwali police station, Ghazipur, involves charges under multiple sections of the IPC, including 419 (cheating by personation), 420 (cheating and dishonestly inducing delivery of property), 467 (forgery of valuable security), 468 (forgery for purpose of cheating), and others. The investigation revealed that Ahmed, along with 12 other accused, orchestrated a scheme to embezzle govt funds by creating fake documents and colluding with officials from the corporation's headquarters and local banks. During his tenure as a field officer at the Jawahar Bhawan, Lucknow, Ahmed allegedly conspired with co-accused individuals to fabricate identities and addresses, thereby fraudulently completing formalities to obtain margin money loans. This resulted in the misappropriation of Rs 6.42 lakh. The probe was on, with efforts underway to apprehend the remaining eight accused individuals who are still at large.
