Facing road construction quality issues, Centre takes away state PWD and state department's powers for bidding out NHs
The Centre has withdrawn the powers of state PWDs (public works departments) and road construction departments (RCDs) to independently issue bid documents for national highway projects in their states, according to a directive by the ministry of road transport and highways (MoRTH).
Instead, they will now consult MoRTH's regional officers (ROs), who will evaluate all state-issued bids, recommend necessary changes, and actively participate in resolving legal and arbitration disputes related to national highway works, the directive said, a copy of which was seen by Mint.
The new process will be applicable to all highway projects, including those costing less than ₹100 crore but excluding maintenance works.
Further, ROs would need to be consulted at every step in the case of contractual disputes and arbitration. MoRTH is preparing a separate, detailed standard operating procedure (SoP) for dealing with arbitration matters that will soon be issued.

Queries emailed to MoRTH remained unanswered.
The National Highways Authority of India (NHAI) is responsible for highway construction across the country. However, it often works with state-level agencies for bidding, processing, and building specific highway sections within their states, along with other agencies like NHIDCL and MoRTH's construction wing,
The ministry's directive pointed out that 'in several projects pertaining to NH works implemented by State PWDs/RCDs, critical lapses have occurred due to lack of due diligence". That has led to disputes, legal complexities and financial liabilities for the central government, the directive noted, adding that ROs are not consulted or involved during bidding or in the courts, and the disputes are dealt with mechanically without safeguarding the interests of the Centre.
The directive has been sent by the MoRTH to secretaries and chief engineers of all states and Union territory PWDs, RCDs and departments dealing with national highways.
According to Jagannarayan Padmanabhan, senior director & global head at Crisil Intelligence, scrutinising all proposals from all state governments has its merits and demerits. 'The merits of such an exercise could mean avoidance of construction of parallel and competing roads, having a uniform bid awarding process across the country, and standardization of processes and bid documents, among other things," Padmanabhan said, adding that on the flip side, an additional layer of scrutiny and capacity augmentation at the central level would be needed.
Suprio Banerjee, vice president and co-group head at rating agency Icra Ltd said that these measures are likely to increase the award timelines, but project execution is not likely to be hampered while adhering to the norms or standards stipulated by the road ministry.

'Also, the involvement of ROs in all legal contractual processes is expected to streamline the disputes adjudication process while avoiding the need for repetition," Banerjee said. 'Land acquisition being a state subject, the coordination between central and state government departments remains crucial to expedite the ROW and other associated approvals."
However, Shailesh Agarwal, partner for risk consulting (infrastructure) at EY India sounded a cautionary note when he said that uniform documents don't necessarily mean smoother highways. 'Ultimately, true quality improvement depends on regular quality controls, digitalisation, and accountability at the ground level," he said. 'Due care must be taken to ensure that the new system doesn't become a fresh bottleneck."
The disputes process
With regard to contractual disputes and arbitration, it has been decided that state PWDs/RCDs would not pursue such matters independently without consultation with ROs.
All replies, statements of defence, and written submissions intended for courts / arbitrations shall be vetted by the ROs and returned after scrutiny with comments or amendments before submission within a period of 15 days failing which the replies, statements or submissions may be deemed cleared.
The ROs would also be free to engage legal experts from NHAl-empanelled law firms for advice and support.
The highway building plan
In FY26, MoRTH proposes to construct about 10,000 km of highways, per the outcome budget 2025-26. As highway construction in the country matures, the liberal growth in construction is expected to slow and the focus will shift towards highway maintenance and enduring quality of construction.
Out of 146,195 km length of national highways (NH) network in the country, damages have been reported in about 1% of the stretch every year, according to data from MoRTH. The conditions of NHs are assessed from time to time by the MoRTH and its various executing agencies.

The maintenance works on NHs are accordingly taken up from time to time to keep the NHs in traffic-worthy condition. According to MoRTH, the ministry spent nearly ₹6,500 crore on highway repair and maintenance in FY24. A similar level of expenditure is also expected to be incurred in the current fiscal.

New Delhi: India's fiscal dynamics have improved at the aggregate level post-pandemic, with a most notable shift in the quality of spending, which is reflected in the higher capital expenditure by the government over the last five years, according to a Morgan Stanley report. The report highlights that the improving fiscal dynamics bode well for the growth mix and inflation management of the Indian economy. The faster pace of consolidation in revenue deficit is reflective of an improved spending mix, not only by the Centre but also by the states. Indeed, a key change post-pandemic has been the shift towards higher capex by the centre, with Central government capex doubling to 3.2 per cent of GDP in FY2025 from 1.6 per cent of GDP in FY2020 (pre-pandemic), the report further states. Similarly, states' capex is tracking at 2.3 per cent of GDP in F2025 from 1.9 per cent of GDP pre-pandemic. "Going forward, we expect the Central government fiscal deficit to consolidate further, albeit at a slower pace to 4.4 per cent of GDP in FY2026, while for the states, we expect the deficit to narrow to 2.6 per cent of GDP," the report states. The report highlights that prudent fiscal dynamics with a combination of consolidating deficit and improving mix of spending bode well for the growth mix and thus inflation. Further, a flexible inflation targeting framework has also been instrumental in reducing inflation volatility. Indeed, CPI inflation has averaged at 4.9 per cent since 2016, compared to 7.7 per cent in the previous four years. As such, this has positive implications for the cost of capital, especially over the medium term. The report also highlights the rising tax buoyancy in the Indian economy. The Centre's gross tax revenue stood at 11.5 per cent of GDP in F2025, up from 9.9 per cent of GDP in FY2020. It has remained range-bound between 11.3-11.7 per cent of GDP in the last four years. The improved strength in tax revenues is pivotal in facilitating the consolidation of the fiscal deficit. Indeed, the tax buoyancy has averaged at 1.2 since the pandemic and is tracking at 0.98 in F2025, from a pre-pandemic average of 0.9. The budget estimates an upturn in gross tax revenues to 12 per cent of GDP in F2026, the report points out. According to the report, the non-tax revenues are buoyed by robust dividend payouts from the RBI and other PSUs, the share of which tripled to 0.9 per cent of GDP in FY2025, from 0.3 per cent of GDP in FY2021. Indeed, dividends from the RBI have been rising in the last few years, averaging 0.4 per cent of GDP since the pandemic and rose to a record high of Rs 2.7 lakh crore (0.7 per cent of GDP) in FY2026. Moreover, the PSU dividend received by the government in FY2025 totalled to Rs 74,000 crore, up 16 per cent year-on-year, with the highest contributions coming from Coal India, followed by ONGC.

Centre to launch FASTag-based annual pass of ₹3,000 for private vehicles
Union minister for road transport and highways (MoRTH) Nitin Gadkari on Wednesday said the government will soon introduce a FASTag-based annual pass for private vehicles at a cost of ₹3,000 for hassle-free highway travel. Effective from August 15 this year, this pass will have to be renewed every year from the date of activation or after 200 trips, whichever comes first. Officials said that every exit of toll booths will be counted as one trip for all highways, except controlled access expressways, while for controlled access highways, the entire travel can be counted as one trip. According to the National Highways Authority of India (NHAI), adoption of the FASTag system has reduced the average waiting time at toll plazas from 734 seconds to 47 seconds during the financial year 2022-23. Gadkari said a dedicated link for activation and renewal will soon be made available on the Rajmarg Yatra App as well as on the official websites of NHAI and MoRTH. The minister said the policy addresses long-standing concerns regarding toll plazas located within a 60-km range and simplifies toll payments through a single, affordable transaction. The announcement comes at a time when the government has rolled out a pilot for ANPR (automatic number plate recognition)-based barrier-free tolling systems in select stretches; a satellite-based highway toll collection system is in the works.

FASTag Annual Pass: Price, Start Date, Benefits And How To Apply Online
New Delhi: The Centre is introducing a FASTag-based annual pass priced at Rs 3,000 for non-commercial private vehicles. Under the new policy, private vehicle owners can make 200 trips across national highways in a year for a one-time charge. The pass will be valid either for one year from the date of activation or up to 200 trips, whichever comes first. "The annual pass will enable seamless and cost-effective travel across National Highways throughout the country," Road Transport and Highways Minister Nitin Gadkari said. What Is FASTag? FASTag is an electronic toll collection system in India, operated by the National Highways Authority of India (NHAI). It uses Radio Frequency Identification (RFID) technology to automatically deduct toll charges from a linked bank account or wallet. How Does FASTag Work? The FASTag is a small sticker affixed to the front windshield of a vehicle. When the vehicle approaches a toll plaza, sensors scan the tag and automatically deduct the applicable toll fee from the user's account. A confirmation SMS is also sent to the registered mobile number after every transaction. When Will The FASTag Annual Pass Be Issued? The new FASTag annual pass will be available starting August 15. Mr Gadkari said, "This policy addresses long-standing concerns regarding toll plazas located within a 60 km range and simplifies toll payments through a single, affordable transaction." Once activated, within about 24 hours, you will have a full-year or 200-trip validity. In the past, the government proposed a lifetime FASTag plan at Rs 30,000 for 15 years. That plan has since been shelved. There was also talk of a distance-based toll model, where users would pay a flat Rs 50 per 100 km, but no official word has been given on that model yet.
