MA63: Sarawak outlines two top priorities in negotiations

KUCHING: The Sarawak government has outlined two key demands under the Malaysia Agreement 1963 (MA63) as its top priorities in negotiations with the federal government.
Deputy Minister in the Sarawak Premier's Department (Law, MA63 and State-Federal Relations), Datuk Sharifah Hasidah Sayeed Aman Ghazali, said among the current top priorities is the need to expedite discussions on the Special Grant formula under Article 112D of the Federal Constitution.
She said Sarawak is also looking into the matter of increasing the number of parliamentary seats of Sarawak in the House of Representatives, to better reflect the spirit and intent of the MA63.
'These issues have been brought up regularly by the Sarawak government through official meetings and negotiation platforms, including the Mesyuarat Majlis Tindakan Pelaksanaan Perjanjian Malaysia 1963.
'The Sarawak government remains committed to ensuring that the rights and entitlements of the State are fully upheld in accordance with the Federal Constitution, MA63 and the Inter-Governmental Committee (IGC) Report,' she said during the question-and-answer session at the Sarawak State Assembly sitting today.
Sharifah Hasidah was responding to a question from Lidam Assan (GPS-Katibas) on the current negotiation status of MA63 for Sarawak.
Meanwhile, Sharifah Hasidah said the Sarawak government has partially resolved matters in respect of the Financial Review under Article 112D of the Federal Constitution.
She said in this regard, as an interim arrangement, the federal government has agreed to increase the amount of the Special Grant for Sarawak from RM300 million to RM600 million for a period of five years.
'Nevertheless, the Sarawak Government strongly urges that negotiations on the Special Grant formula be expedited, in the spirit of partnership and in recognition of Sarawak's constitutional rights under the Federal Constitution and the MA63,' she added.

KUALA LUMPUR: The High Court has rejected Prime Minister Datuk Seri Anwar Ibrahim's attempt to refer eight legal questions to the Federal Court, including whether he is immune from lawsuits. The questions were tied to a lawsuit filed by his former research assistant, Muhammed Yusoff Rawther, over an alleged sexual assault in 2018. Justice Roz Mawar Rozain ruled that the questions did not raise any substantial constitutional issues, stating that they failed to meet the threshold for referral under the Federal Constitution and the Courts of Judicature Act. Meanwhile, Anwar's lawyer Datuk Seri K. Raja Segaran told reporters after the judgement was handed down that they respectfully disagreed with the court's judgement and would file an immediate appeal to the Court of Appeal. In her judgement earlier, Justice Roz Mawar said none of the Articles of the Federal Constitution cited by Anwar's legal team gave rise to any real, substantial or justiciable question of constitutional law requiring determination by the Federal Court under Article 128(2) of the FC or Section 84 of the Courts of Judicature Act 1964. 'From a judicial perspective, the proposed questions do not appear to meet the threshold of genuine constitutional controversy,' she said, Bernama reported. Anwar filed the application on May 23, seeking the High Court, which is hearing the suit, to refer the legal questions to the apex court. The questions include whether, under Articles 39, 40 and 43 of the Federal Constitution, a sitting prime minister enjoys limited immunity from lawsuits involving allegations of personal conduct that occurred before his appointment. In her brief grounds, Justice Roz Mawar said the questions are speculative, not needed for the disposal of the case, and do not concern the interpretation or validity of any constitutional provision. Regarding the question of immunity, she said Articles 39, 40, and 43 on Executive Authority, which Anwar applied to refer to, are structural provisions that allocate executive powers but do not confer personal immunity. 'No express or implied protection against civil liability exists. Constitutional silence on immunity must be interpreted in favour of equal legal accountability. 'The articles cited by the defendant's legal team are inoperative in the context of his application for constitutional reference,' she said. The judge also ruled as flawed the defendant's contention that allowing the civil suit to go on may undermine the Prime Minister's ability to discharge executive functions. She explained that this was because no immunity is implied in Article 43, as the provision deals solely with tenure and does not prescribe or imply immunity from judicial proceedings. The judge also said there was no clause in Article 43 which shields a sitting prime minister from accountability in respect of private acts committed prior to assuming office. 'One, no immunity is implied in Article 43; the provision deals solely with appointments and tenure and does not prescribe or imply immunity from judicial proceedings,' she said. Justice Roz Mawar said Anwar had also affirmed readiness to proceed with the trial, and there was no evidence that the suit would impair his ability to perform constitutional duties. She said the court finds no special circumstances warranting a stay of proceedings. The court also dismissed Anwar's application to stay the hearing of the suit and ordered the trial to commence on June 16 as fixed earlier. She then ordered Anwar to pay RM20,000 in costs to Muhammed Yusoff. Apart from Raja Segaran, lawyers Datuk Megat Abdul Munir Megat Abdullah Rafaie and Alan Wong Teck Wei represented Anwar, while lawyers Muhammad Rafique Rashid Ali, Nurmustanir Md Nor and Muhammad Amirul Ar-Rasyid Azman acted for Muhammed Yusoff. Muhammed Yusoff filed the suit on July 14, 2021, and Anwar, in his defence, contended that the former had lied under oath to authorities regarding the alleged sexual assault incident. The PKR president, who filed a counterclaim on Sept 28, 2021, alleged that Muhammed Yusoff had fabricated the story about the sexual assault to tarnish his political career and prevent him from becoming prime minister.

KUALA LUMPUR: Prime Minister Datuk Seri Anwar Ibrahim has failed in his bid to refer eight constitutional questions to the Federal Court regarding the legal provisions on the immunity of a sitting prime minister. High Court Judge Roz Mawar Rozain dismissed the application, ruling that it did not meet the requirements under Section 84 of the Courts of Judicature Act (CJA). "Having considered the affidavits, the eight proposed questions, and submissions of all parties (both written and oral), this court is not satisfied that the statutory threshold under Section 84 of the CJA is met. "The questions posed are speculative, not necessary to the disposal of this case, and do not concern the interpretation or validity of any constitutional provision," she said in her decision. Anwar's application is linked to a sexual assault lawsuit filed against him four years ago by his former research officer, Muhammed Yusoff Rawther. The trial is scheduled to begin on June 16. Roz Mawar said the proposed constitutional questions failed to meet the statutory threshold under the section, and that not every question referencing the Federal Constitution warrants referral. "The Federal Court is not a forum for speculative advisory opinions. "Furthermore, the defendant (Anwar) has affirmed readiness to proceed with trial and there is no evidence that the suit impairs his ability to perform constitutional duties. "This court finds no special circumstances warranting a stay of proceedings," she said. Roz Mawar awarded RM20,000 in costs to Yusoff Rawther. She also ruled that the June 16 trial will proceed. After the proceedings, Anwar's lawyer Datuk Seri Rajasegaran Krishnan said they will file a notice of appeal at the Court of Appeal. On May 23, Anwar applied to the High Court to refer eight legal questions to the Federal Court, which included whether he possesses immunity from a civil suit filed by Yusoff. Anwar had sought the apex court to rule whether Articles 5,8, 39,40 and 43 of the constitution grant him qualified immunity from Yusoff's suit. Yusoff had filed the suit before Anwar became prime minister on Nov 24, 2022. Anwar had asked the court to decide whether Yusoff's suit would impair the effective discharge of his executive duties and undermine the constitutional separation of powers. Anwar had also requested the court to consider whether the lawsuit impacts his ability to carry out executive duties and undermines the principle of separation of powers guaranteed by the constitution. Previously, Anwar's senior political secretary Datuk Seri Shamsul Iskandar Mohd Akin had said there was no attempt in the application to seek absolute immunity. He said Anwar's application to the Federal Court is a lawful process to seek clarity from the court on his position in carrying out official duties when facing a civil suit based on claims that precede his appointment as prime minister. Shamsul Iskandar had said the issue is whether such civil action could interfere with the efficiency of a prime minister in carrying out the executive functions of the state. He had said it is a legitimate and lawful matter to be referred to the Federal Court, the highest judicial institution in the country, with the jurisdiction to interpret the constitution fairly and objectively.
