2015 Bharuch double murder: Court orders NIA to attach 1.92 sq m property of accused

Ahmedabad: Nearly 10 years after the murder of two BJP workers in Bharuch, a special court has ordered the National Investigation Agency (NIA) to attach the share of one of the accused in his ancestral properties — a total measuring less than 2 sq m.
Mohammed Yunus, alias Manjro, was among those arrested on charges of criminal conspiracy and the murder of BJP workers Shirish Bengali and Pragnesh Mistry. The killings took place in Nov 2015, and the investigation was later handed over to the NIA. The accused were charged under the Unlawful Activities (Prevention) Act (UAPA) and relevant sections of the Indian Penal Code (IPC).
In Dec 2024, the NIA filed an application in the special court seeking permission to attach Manjro's properties under the provisions of Section 33(1) of the UAPA.

Manjro's share lies in two ancestral houses in Bharuch town — one measuring 143.96 sq m owned by 20 family members, and another measuring 29.59 sq m, also with 20 co-owners.
His share in the two properties was calculated at 1.59 sq m and 0.33 sq m respectively, totalling just 1.92 sq m. The NIA submitted that these properties were liable to be seized for forfeiture proceedings in the case.
Manjro's lawyer objected to the application, questioning the agency's move nearly a decade after the case began.

He argued that the 2013 amendment to the UAPA allows attachment only of properties intended to be used for terrorism-related activities. He opposed the seizure of what he described as a "very minimal" share in the ancestral properties.
After hearing arguments, Special Judge M P Purohit rejected the defence's objections and stated in the order, "It is ordered that the share in the immovable properties of the accused Mohammad Yunus @ Manjro (A-4) — (i) Residential House, Ward No. 3, City Survey No. 3614, Bharuch City, having a total area of 143.96 sq m, and (ii) Residential House, Ward No. 3, City Survey No. 3615, Bharuch City, having a total area of 29.59 sq m — is hereby ordered to be attached till the final disposal of this case under the provisions of Section 33(1) of the UA(P) Act, 1967.

The court further directed: "The accused Mohammad Yunus @ Manjro shall not transfer his share in these properties to anyone by sale, mortgage, gift, or in any other manner until the trial is completed."

TWO YEARS after she was allegedly raped and 'frequently blackmailed' by a sub-inspector (S-I) colleague, a woman constable with the Uttar Pradesh Police has now filed a complaint against him and one of his friends. The FIR was registered on Sunday, naming S-I Ravikant Goswami and his friend, Dikshant Sharma, accusing them of gangrape, physical assault, blackmail and repeated threats to kill her and her family. According to the police, the first assault took place in 2023, when the woman was visiting Mathura district for a function to which she had invited Goswami. He allegedly called her to a room in a hotel where he had booked a stay. In the room, he allegedly gave her juice that had been spiked. After drinking it, the woman lost consciousness, after which the S-I allegedly raped her. When she woke up, she found that she had been raped and filmed and was threatened that if she told anyone, he would leak the videos and kill her family, the woman has told the police. Months passed, she alleged, but the harassment continued. A few months later the same year, she alleged, she was again forced to meet Goswami — this time at a hotel in Moradabad, where he threatened her again and said he would release the earlier video. She found that his friend, Dikshant Sharma, was also present in the room. They once again allegedly made her drink something, which made her feel drowsy, before raping her again. Videos of the act were recorded and she was again blackmailed and threatened by the S-I and his friend, the complaint alleges. In the months that followed, the woman said that she tried to keep away and 'ignored Goswami's phone calls.' But in January this year, she alleged, he tracked her down again — in Jhansi. She alleged that Goswami, who was 'following' her, suddenly accosted her and started beating her up for not picking up his calls. 'She suffered a fracture in a finger,' said a police officer, citing the complaint. The woman's complaint has been converted into an FIR under IPC Sections 376D (gangrape), 328 (causing hurt by poison), 323 (voluntarily causing hurt), 325 (causing grievous hurt), 504 (intentional insult) and 506 (criminal intimidation), police said. 'This is a serious matter. We are verifying the allegations and collecting evidence. Appropriate legal action will be taken,' said a senior police officer.
