Indian Express2 days ago

The Kolkata police on Friday afternoon arrested a 22-year-old law student from her Gurgaon residence over an allegedly objectionable social media post. The woman, Sharmistha Panoli, is a student of Symbiosis, Pune, and has a sizeable social media following – almost 85,000 followers on X and 90,000 on Instagram.
On May 14, the AIMIM's national spokesperson, Waris Pathan, had shared a video purportedly posted by her and alleged that she had insulted the Prophet and tried to spread communal disharmony. In his post, Pathan tagged the Home Minister and sought her arrest.
On May 15, Patoli posted on X, 'I do hereby tender my unconditional apology. Whatever was put are my personal feelings and I never intentionally wanted to hurt anybody, so if anybody is hurt, I'm sorry for the same. I expect co-operation and understanding. Henceforth, I will be cautious in my public post. Again, please accept my apologies.'
On Saturday, she was produced in a court in Alipore and remanded in judicial custody until 13 June. According to the FIR, police received a complaint at Garden Reach police station on May 14 from one Wajahat Khan.
Chief Public Prosecutor, Alipore Police Court, Sourin Ghoshal said, 'She knew about the consequences of her actions, being a law student. Several police stations have complaints against her, so we need to question her thoroughly.'
In a statement, the Kolkata Police said, 'Certain social media narratives suggesting an unlawful arrest of a law student are factually incorrect and misleading. All legal procedures were duly adhered to. All attempts were made to serve notice, but she was found absconding on every occasion. Consequently, a warrant of arrest was issued by the competent court, following which she was apprehended lawfully from Gurgaon. She was thereafter produced before the appropriate magistrate and granted transit remand as per due process of law. We urge all concerned to refrain from spreading unverified or speculative content and to rely on authentic sources for information.'
Sources said that while her family is in Gurgaon, they have property in Anandapur, Kolkata.
She has been charged under sections of promoting enmity between different groups, acts intended to outrage religious feelings, insult with intent to provoke breach of peace, and statements that incite public mischief.

Hate speech and abusive language should not be misconstrued as freedom of speech & expression as enshrined in Article 19(1)(a) of the Constitution." Referring to the timing of the post, police said, "At a time when the whole country stood united and our brave citizens were fighting at the frontier, posting such content. .. is most abominable act... The accused was not arrested for expressing patriotism or personal belief; legal actions were taken for sharing offensive content, which promotes hatred among communities." "We will discuss the legal course of action on Monday. My client already accepted her mistake and sought an apology, but cops arrested her. We said that she gave her confessional statement and submitted her devices to cops. The magistrate acknowledged it and sent her to judicial custody," said the girl's advocate, Mohammad Shamim, who questioned the manner of arrest. He claimed they could have sent her summons on mail and WhatsApp when they could not find her or her family at their Anandapur high-rise. "The family was away and so they couldn't receive the summons. It gave cops the chance to get an arrest warrant and pick her up from her Gurgaon place, where she was with her mother." Police said, "The case was filed under appropriate BNS sections. The case was duly probed and adhering to legal procedures, several attempts were made to serve notice u/s 35 of BNSS to the accused but every time, she was found absconding. So, a warrant of arrest was issued by the court. She was apprehended lawfully from Gurgaon during day time."

BCI chairman seeks release, fair trial for arrested Instagram influencer Sharmishta Panoli

Bar Council of India (BCI) chairman Manan Kumar Mishra on Sunday called for immediate release and fair trial for Sharmishta Panoli, the Instagram influencer who was arrested by Kolkata Police for allegedly making a post claiming the Hindi film actors were silent on Operation Sindoor. The senior advocate and Rajya Sabha member said that he was standing firmly with Panoli, whose arrest and judicial custody for a now-deleted social media video despite her immediate apology represented "an absolute failure of justice and a blatant assault on freedom of expression". The 22-year-old influencer, a resident of Kolkata and enrolled in Pune's Law University, was arrested from Gurugram on Friday night. She was on Saturday produced before a Kolkata court, which sent her in judicial custody till June 13. "It is deeply troubling that the same government that opposed Operation Sindoor -- a decisive counter-terror operation -- meant to avenge the brutal killing of innocents, now seeks to silence a young law student for questioning such similar double standards," said Mishra in a statement. A mere wrong choice of words cannot be called blasphemous and a young law student being made a scapegoat and subjected to harsh legal action, while past atrocities on particular communities by the government-sponsored persons and entities remained unaddressed was "unconscionable", the statement added. "True democracy demands impartiality, restraint and the equal protection of rights, not selective outrage and vendetta," the statement said. "I call upon the Bengal government and its police to abandon this dangerous path of targeting select voices and to uphold the rule of law for all. I demand Sharmishta's immediate release, a fair trial, and an end to the double standards that have long plagued the state's administration of justice," said Mishra.
