Valparaiso officials: City can keep ARPA funds used to buy land for now-defunct plans for sports complex

As part of the sweeping controversy over a now-defunct proposal for a data center on Valparaiso's north side, one question that remained after the brouhaha seems to have subsided is whether the city has to pay back the funds from the American Rescue Plan Act that were used for what was initially proposed as a sports and park complex.
City officials say no, a point they emphasized during Monday's City Council meeting, which stretched almost five hours and drew hundreds of people to City Hall with concerns about the potential data center.
Council President Ellen Kapitan, D-At-large, called the issue a 'red flag' during the council meeting, adding it led to a lot of questions, including whether the city would be on the hook for repaying the funds.
'Is this legal?' she asked Patrick Lyp, the city attorney.
'The simple answer is yes,' he said, adding an outside law firm from Indianapolis helped the city work through the details.
If the Redevelopment Commission sells the property, he said, 'there would be no prohibition or covenant on the money.' The funds, he added, would return to the RDC.
The tenets of ARPA funding offer exemptions for paybacks of funds under $10 million, as long as they are used for public purposes, Lyp said. There also is no prohibition on the sale or use of the property.
'There's no obligation that would be tied to ARPA funds,' said Councilman Robert Cotton, D-2nd.
The city received $7,681,979.52, according to an amended resolution for ARPA spending passed by the City Council on July 25, 2022.
That included $4,717,278.92 for land acquisition 'for future Park related activities,' according to the resolution, and includes the parcels for the proposed sports complex.
The breakdown on the use of the rest of the funding, according to the resolution, included $1 million for the demolition of the former Whispering Pines facility and two adjacent residential structures on North Calumet Avenue, as well as site remediation, for a then-proposed adult enrichment center; $663,147.68 in premium pay for eligible city employees; $575,000 for several nonprofit agencies; $500,000 for the replacement of sidewalks, walking paths and other infrastructure; $40,000 for consultant fees and reserve funds for future audits, all related to disbursement of the ARPA funds; and $25,000 each to the police and fire departments, for various upgrades.
The brunt of the spending, including the parkland purchase, fell under ARPA's 'Provision of Governmental Services using Revenue Loss Funds,' per the council's resolution, which is the most flexible of categories for ARPA spending.
In emails to the Post-Tribune before the City Council meeting and Mayor Jon Costas' statement that the city would no longer pursue the data center proposal because of the public outcry, Lyp and George Douglas, the city's development director, offered further insight into the transfer of funds before the 248 acres, comprised of four parcels between County Roads 500 North and 400 North east of Indiana 49, was purchased for parkland.
According to the option agreement signed in January between the RDC and the data center developer, Agincourt Investments LLC, the RDC would have sold 180 acres of that property for just over $9 million, almost twice what the RDC paid for the land.
'The Valparaiso Redevelopment purchased the properties in 2022 with available cash funds. The City Council did approve the use of ARPA funds to reimburse the RDC for the full purchase price in August of 2022,' Douglas said in his email.
He added he didn't believe anything happens to the ARPA funds once they have been used to reimburse the RDC for the land purchase and if the RDC were to sell the property, the commission could use the proceeds for any of its permissible expenditures.
'The ARPA funds were used for an allowed purpose when the City reimbursed the RDC,' Lyp said in his email. 'If the land is sold, the proceeds would be paid to the RDC and used by the RDC consistent with Indiana law.'
Jennifer Hora, a political science professor at Valparaiso University who focuses on state and local government, agreed that the ARPA funds come with flexibility but said that flexibility is supposed to come with accountability and responsibility.
She summed up her concerns as 'the spirit of the law vs. the letter of the law.'
City officials dropped the plans for the park when, according to then-Mayor Matt Murphy, bids for the project, slated for $30 million, came in $7 million over budget. Costas said in an interview with the Post-Tribune last month that the city was going to invest more in its current parks instead and scuttle the plans for the sports complex.
City officials, Hora said, 'threw their hands up' and walked away from the sports complex proposal when it came in over budget and proposed using that land for the data center.
The future of the land purchased with those funds is unknown.
'This is not transparency,' she said. 'This is definitely not the spirit of ARPA law.'

The sanitation fee resolution, which caused many conversations and criticisms within Lebanon, was passed by the City Council in a 4-2 vote during Tuesday's meeting. The structure of the fee will be $20 for residential customers and $40 for business customers. The city's sanitation department does not pick up dumpsters used by businesses, only bins specifically used for the city service. Geri Ashley and Camille Burdine, Councilors for Ward 2 and 3 respectively, stuck to their votes against the fee for the second reading. Both raised concerns of how residents at or below the poverty line or seniors on fixed incomes may be impacted by the $20 per month fee. Questions regarding how the sanitation department is funded were asked as confusion rippled through the community. 'This was an unadvertised discussion in a work session. It was a 15-minute discussion,' Ashley said. 'I still don't have all my questions answered. I don't feel like I have the economic information.' 'I think that we should, as a City Council, have spent more time talking about it and seeing if we could come up with any other solutions,' Ashley added. 'If in fact we are paying for garbage in our city's taxes, and now we're incorporating a fee, then what happens next year when we get our taxes? Are our taxes going to be reduced at that point, because that is a double dip.' On Wednesday, Burdine reiterated her thoughts that the city should be more proactive in studying the impact on the citizens before a fee was implemented. She said the response to rising costs caused the city to be 'reactive instead of proactive.' Burdine said she is not opposed to a sanitation fee, but feels that more time should have been spent researching it. Also on Wednesday, Ashley called the fee a 'knee-jerk reaction' and likewise felt that not enough research was done. She also said instead of a flat fee, a property tax increase would take into account the property values and Wards 1, 2 and 3 would not have to deal with a monthly fee which might be a burden. Ashley said she wants to see if the sanitation fee will disappear from the property taxes. Ward 1 Councilor Joey Carmack said he supported the fee because it's a flat fee that all residents pay, which doesn't fluctuate. 'I do not feel it's fair for the sanitation fee to be a property tax,' Carmack said. 'A property tax would be unfair, because for example, person one has a $1 million house, and [may] only have one can of trash. They would pay more taxes than person two [who has] a $350,000 home.' 'We dump the trash from the city at Walter Hill (in Murfreesboro), which has been in the news about closing soon,' Carmack added. 'When that does happen, we will be paying even more to dump trash.' Middle Point Landfill has been working with Rutherford County to increase fees for 'out-of-county' tipping fees, as well as downsizing the number of counties allowed to dump there. During a meeting earlier this year, it was proposed to double the fees for non-Rutherford County clients from $1.20 per ton to $2.50 per ton to generate more revenue for that county. The town meeting hall had more residents in attendance than usual, which was commented on by the Councilors, who expressed gratitude for the increased attendance. Burdine, Chris Crowell, Councilor for Ward 4 and Phil Morehead, Councilor for Ward 6, particularly welcomed the attendance and interest in city business. During the public comment period, nearly a dozen people spoke to the City Council. One resident, Stephen Lawson, said he and others should have the option to opt out of the fee, and that he would rather pay a private company $30 to support that business than give the city $20. He also asked if there were other landfills which could be used. 'I thought there was a landfill in Wilson County. Is that one full?' Lawson asked. 'That's owned by the Wilson County government, and it's just open to construction materials,' Mayor Bell responded. 'It's not open to us.' Alex Buhler, former Ward 1 Councilor who stepped-down in 2012, also spoke. 'They should have that option to opt out,' Buhler said. 'If a thousand people opt out, that's a thousand houses you don't have to go to.' Bell responded by saying that wouldn't save as much money as people think because the sanitation trucks will still be driving by those houses anyway. Some of the Councilors said they don't know if private companies would have the same quality of work that the city does, as officials believe sanitation is a public health matter which the Council 'takes seriously.' Another resident wondered if the sanitation fee would lead to the start of 'nickel and diming' the residents of the city. Glenn Denton, County Commissioner for District 20, which covers the downtown Lebanon region of the county, criticized the growth of the city, which he thinks sparked the need for growing services and the fees to pay for them. 'Enough is enough. We have overbuilt in our city beyond what our infrastructure can handle,' Denton said. 'When do we stop building to where we cannot service and when we cannot pay for the infrastructure around it?' Nearly an hour and a half was spent discussing the sanitation fee and budget for the next year. With the passing of the resolution, the sanitation fee goes into effect July 1.

Fiscal Court approves tornado cleanup oversight, several new hires

At its regular meeting Thursday morning, the Laurel County Fiscal Court approved several items related to tornado recovery and county operations for the upcoming fiscal year. Judge-Executive David Westerfield received approval to bring in DRC Emergency Services to oversee remaining tornado debris cleanup through local subcontractors. He was also authorized to hire a company to handle FEMA documentation related to the cleanup, as well as a monitoring company to meet FEMA requirements for debris removal tracking. As for personnel matters, multiple new hires were approved. Jordan Dalrymple, who will serve as retirement clerk, will enter her role on June 16. Dalrymple will earn $21 per hour for the position. Following the retirement of two road department employees, the department saw two new hires — William Antrim and Billy Goforth. Antrim will earn $15 per hour, whereas Goforth will make $14 an hour due to not having his CDL (commercial driver's license). Further, six temporary employees will be hired to haul debris, each earning $30 an hour. In new business, the court approved bids for materials to be used during the 2025–2026 fiscal year. During the county treasurer's report, several transfers and approvals were made, including: — Approval of May claims with no discussion. — An intra-fund transfer, also approved without discussion. — The adoption of standing orders for the 2025–2026 fiscal year. — The closure of the county's ARPA (American Rescue Plan Act) account after funds were fully allocated and spent. The cash transfer report included $500,000 from the occupational tax fund to the road fund, $299,848.67 from the ARPA fund to general fund, and $800,000 from the occupational tax fund to general fund. Judge Westerfield closed Thursday's meeting by thanking those involved with tornado relief efforts. 'I just appreciate everybody in the county for pulling together and trying to help these people,' Westerfield stated. The Laurel County Fiscal Court regularly meets at 8:45 a.m. on the second Monday and 9:30 a.m. on the final Thursday of each month. The fiscal court's next meeting will take place Monday, June 9.
