
Karnataka HC grants bail to Sosale, three more in stampede case
The Karnataka high court on Thursday granted bail to Nikhil Sosale, head of marketing at Royal Challengers Bengaluru (RCB), and three others, observing that they were all arrested illegally, without any credible evidence or investigation linking them to the June 4 crush at the Chinnaswamy Stadium in Bengaluru that killed 11 people and injured over 50 others.
Justice SR Krishna Kumar said the police 'had neither conducted any investigation nor produced any credible material' to show they had reason to believe that Sosale and the other petitioners were involved in the alleged offences at the time of their arrest.
The judge further said that merely holding top positions in the organisations was not enough to justify the petitioners' arrest, especially when they were not named in the FIRs and no material was presented to establish their direct involvement in the incident.
Besides Sosale, the court granted bail to Sunil Mathew, Kiran Kumar S, and Shamant NP Mavinakere, all employees of the event management company DNA Entertainment Networks, who were also arrested in the same case. The court directed that all four be released from judicial custody upon surrendering their passports.
Justice Kumar observed that since the mandatory conditions under Section 35(1)(c) of the BNSS, 2023 that pertain to arresting someone without a warrant, were not met in the present case, the arrests made by the CCB following directions of the city police were prima facie illegal and arbitrary.
'The impugned arrest of the petitioners is clearly contrary to law and facts and prima facie illegal and arbitrary and the petitioners are entitled to interim bail in the present petitions,' the court said.
Justice Krishna Kumar had reserved the verdict on the bail applications filed by Sosale and the others on June 11.
At the time, senior advocate Sandesh Chouta, appearing for Sosale, had argued that his client was being unfairly held responsible. Sosale was not a decision maker, but only an employee and hence, there can be no vicarious liability, Chouta had argued.
Opposing the bail plea, Advocate General (AG) Shashi Kiran Shetty had argued that RCB bore full responsibility for the stampede that killed 11 people and injured over 50 others. The AG had said the team's last-minute social media posts, including announcements about free passes and open invitations, had triggered the massive and unmanageable crowd outside the stadium that ultimately led to the deadly stampede.
When asked by the court if the government's position was that RCB was entirely responsible, the AG had replied in the affirmative.
He had then cited an agreement between RCB, BCCI, and DNA Entertainment to show that RCB and DNA were responsible for all arrangements inside the statement as well as crowd management.
Sosale and the others have also challenged the legality of their arrest, alleging it was politically motivated and violated constitutional norms.

In a letter to Siddaramaiah, Moily said, 'A lesser punishment should have been given, and the best approach would have been to transfer the officials or send them on leave. After an inquiry, based on the facts, they could have been suspended." In an unprecedented action, chief minister Siddaramaiah had announced the suspension of the city's police commissioner B Dayananda, who was scheduled to be promoted as DGP in July. Along with Dayananda, the CM had also announced the suspension of the additional police commissioner (East) Vikas Kumar Vikash and deputy police commissioner Shekhar HT. 'As a chief minister, one should have a sober approach. There is no need to react impulsively to the circumstances. As an administrator, you must make decisions with sobriety," he told News18. Moily, known to call a spade a spade, in his letter, which is with News18, has written that the chief minister's disciplinary action against several officials in a short span of time seemed a 'drastic and unwanted measure". 'It would be wise to review the administration's hasty actions regarding this incident. There is a possibility that this could bring a bad name to your administration," Moily wrote. 'Make efforts to hold all scheduled matches' The veteran Congress leader highlighted the public response to the incident and the decisions taken by the government, emphasising that 'Bengaluru's reputation, earned over decades, should not be erased by this recent accident". He noted that the city, which has contributed many talented cricketers to the national and international arenas, has now come under criticism in the cricketing world. Moily reiterated that rather than launching multiple inquiries, the situation demands a thorough investigation by a retired judge, with the report submitted at the earliest to restore public trust and confidence among cricket lovers. The onus, he said, is now on the government to act swiftly and create an organised, peaceful environment that reflects the true spirit of the occasion. 'It is imperative that you, as the Chief Minister, take special precautions in this regard. You have already arranged an inquiry by the Honourable District Magistrate, an investigation by a retired High Court judge, and a CID investigation into this incident," he stated in the letter. He also placed the onus of clearing Bengaluru's and Karnataka's names on Siddaramaiah by conducting a proper investigation, which he believes has come under scrutiny after the stampede. 'Special care must be taken for those who died and were injured in the accident—not only by providing compensation, but also by showing empathy to the families of those who lost their lives and to the injured, and by instilling confidence in them," Moily advised. Referring to reports that future cricket matches in Bengaluru may be shifted to other venues in light of the incident, Moily also stressed that the government must send out strong signals that 'appropriate steps have been taken regarding the incident and that such incidents will not happen in the future", ensuring that cricket and other matches can be conducted in a safe and proper manner. New Delhi [India], June 13 (ANI): Royal Challengers Bengaluru's senior official, Nikhil Sosale, who was arrested over the June 4 stampede during the team's maiden IPL title triumph celebrations, has been granted interim bail by the Karnataka High Court, according to ESPNcricinfo. More than a week after the incident, Sosale and two officials from DNA Networks, the event management company associated with RCB, were released on specific conditions, the most notable of which was the surrender of their passports, according to ESPNcricinfo. ESPNCricinfo also reported that Sosale and all RCB officials who are part of the management team are likely to undergo an internal investigation by the parent company, Diageo. The incident occurred when thousands of fans gathered to catch a glimpse of their favourite players. Eleven people lost their lives and several were injured in a stampede outside Bengaluru's M Chinnaswamy stadium as a huge crowd of nearly 3 lakh people had gathered to witness the victory celebration of RCB. The Karnataka Police had filed an FIR against the Karnataka Cricket Board Administrative Committee, RCB, among others, concerning the stampede incident. Last Saturday, two top Karnataka State Cricket Association (KSCA) officials, secretary A. Shankar and treasurer ES Jairam, resigned, citing 'moral responsibility.' KSCA President Raghuram Bhat confirmed the development, saying that the resignations were discussed and accepted during an emergency meeting. He assured that the cricket body will cooperate with the investigation. 'When the inquiry takes place, we have already told the government and the High Court that we will never shy away from anything that is there. We are ready to cooperate with the investigation,' Bhat told reporters. The Bengaluru Police also filed the first information report (FIR) against the popular IPL franchise last Thursday, as per ESPNCricinfo. The police have said that RCB was not given permission to conduct the event at the stadium. RCB has been listed as the first accused in the FIR, along with DNA Entertainment, the franchise's event partners, and the KSCA, which controls the stadium.
