'When right to health is a fundamental right, the state must ensure that prohibition is slowly implemented in a phased manner to reduce harm to public health,' a bench comprising justices SM Subramaniam and AD Maria Clete observed while allowing a petition by K Kannan, seeking closure of a Tasmac shop located on Tiruchy Road in Dindigul district. Kannan said two schools are located within 50 metres from the Tasmac shop. A church and a government hospital are also situated nearby, he added.
Counsel for Tasmac said the distance restriction of 50 metres under the Tamil Nadu Liquor Retail Vending (in Shops and Bars) Rules, 2003, would not apply to the shop, as it is situated in a commercial area.

RHO, staff nurse suspended after negligence during delivery
Raipur: A Rural Health Officer (RHO) and a staff nurse at Bhatgaon Community Health Centre in Surajpur district were suspended for negligence after a woman gave birth without any medical staff present. The incident occurred on Aug 9 when Kunti Pando, a woman from Odgi development block, was in the labour room. A district-level committee was formed to investigate the matter. The committee also recommended action against the medical officer and staff nurse on duty at the time. A report was sent to the state govt. The probe confirmed negligence by female RHO Victoria Kerketta, who was suspended under the Chhattisgarh Civil Services (Classification, Control, and Appeal) Rules, 1966. The inquiry report found that staff nurse Sheela Soren was absent from duty without obtaining prior approval for leave. Upon confirmation of negligence, she was suspended. The incident came to the notice of Health minister Shyam Bihari Jaiswal, who instructed senior health department officials to investigate and act against the staff responsible. Agenda to revise Schedule H of Drug Rules considered: Govt
Last Updated: New Delhi, Aug 12 (PTI) The Drugs Technical Advisory Board (DTAB) considered the agenda to revise the Schedule H of the Drug Rules, 1945 at its 92nd meeting held in April, the government told Parliament on Tuesday. In a written reply to a question in the Rajya Sabha, Minister of State for Health Anupriya Patel said the DTAB is a statutory body constituted under section 5 of the Drugs and Cosmetics Act, 1940 and the Rules thereunder to advise the Centre and state governments on technical matters arising out of the administration of the Act and to carry out the other functions assigned to it by the Act. The minister was responding to a question on whether the Centre is planning an overhaul of the medicines listed under Schedule H of the Drugs and Cosmetics Act. Patel said the sale and distribution of drugs, including Schedule H drugs, are regulated by state licensing authorities (SLAs) under the Drugs Rules, 1945. Further, the sale of Schedule H drugs without the prescription of a registered medical practitioner is a punishable offence and the SLAs are empowered to take action for the same. The minister said the state drugs controllers and other stakeholders have been sensitised about concerns regarding the sale of prescription drugs by retail without prescriptions of registered medical practitioners. Various notices, advisories and letters have been issued to the state drugs controllers and other stakeholders for strict compliance with the requirements of the Drugs and Cosmetics Act and Rules. Responding to a question on whether the government is considering implementing any digital tools to track the sale of Schedule H drugs, Patel said presently, there is no such proposal under consideration regarding this. However, on November 17, 2022, the Drugs Rules, 1945 that came into force on August 1, 2023 were amended, providing that the manufacturers of the top 300 brands of drug-formulation products, as specified in Schedule H2, shall print or affix a bar code or quick response code on its primary packaging label or, in case of inadequate space on the primary package label, on the secondary package label that stores data or information legible with software application to facilitate authentication, she said. 6 suspended after four patients go missing from Pune mental hospital
In a major security lapse, four patients went missing from the Regional Mental Hospital (RMH) in Yerawada over the past two weeks, prompting immediate disciplinary action. Six staff members have been suspended with immediate effect, and show cause notices have been issued to four others, including two senior doctors who were on night duty, officials said, adding that a proposal seeking administrative approval for the suspensions has been sent to the deputy director of health services.. Yerawada police have registered a missing complaint and are conducting a parallel probe.(HT File Photo) According to the hospital records, the first incident occurred on July 29, when a 37-year-old male patient from Nanded went missing from the male informatory ward. The trio was admitted in recent months for alcohol use disorder (AUD). Following the incidents, RMH authorities on August 8 suspended two male attendants from the ward that reported the trio missing, two male attendants from the male informatory ward, and two hawaldars. All were on night duty at the time. Show cause notices were issued to two senior doctors and two ward assistants, also brothers, responsible for night supervision. Three of the missing patients from Solapur have returned home, but there is no information yet on the patient from Nanded,' said Dr Shrinivas Kolod, RMH medical superintendent. Yerawada police have registered a missing complaint and are conducting a parallel probe. Sources said preliminary findings point to lapses in monitoring, inadequate night staffing, and possible negligence in following security protocols. The fact that patients went missing from different wards in a short period has raised serious concerns about surveillance and safety of both patients and the community. Officials said the current action has been taken under the Maharashtra Civil Services (Discipline and Appeal) Rules, 1979.
