HC gives Delhi govt 10 weeks to act on EWS fee violations

The Delhi High Court on Wednesday directed the Directorate of Education (DoE) to decide within 10 weeks on a plea seeking action against several private schools for allegedly charging fees from students admitted under the economically weaker section (EWS) and disadvantaged group (DG) quotas. A bench of chief justice DK Upadhyay and justice Tushar Rao Gedela noted that although the petitioner -- the Wazirpur JJ Colony Association -- had earlier submitted a representation to DoE on the issue, the department had not yet acted on it.
The court disposed of the petition with a direction for the association to file a fresh, comprehensive representation within four weeks. It also instructed DoE to examine the matter and take appropriate action within 10 weeks of receiving the new representation.
'Having regard to the issue raised, we permit the petitioner to take up the cause of all such students by way of a representation before DoE. The said representation shall be made within a period of four weeks… and a decision shall be taken within 10 weeks from the date of receipt, after affording an opportunity of hearing to the schools concerned,' the court said in its order.
The association had alleged in its plea that several private schools in Delhi were violating the Right to Education (RTE) Act, 2009, by demanding fees from students admitted under the EWS/DG quotas and, in some cases, expelling those unable to pay. Under the RTE Act and Article 21A of the Constitution, children aged 6 to 14 from these categories are entitled to free education up to Class 8.
The order comes just two days after Delhi education minister Ashish Sood introduced the Delhi School Education (Transparency in Fixation and Regulation of Fees) Bill, 2025, in the Assembly. The bill, which aims to regulate fee structures in 1,677 unaided private schools, proposes a three-tier grievance redressal mechanism, parental representation in fee decisions, and penalties of up to ₹10 lakh for violations.

Tagging a post by the Congress on Gandhi's press conference, in which the leader of opposition in the Lok Sabha alleged a 'huge criminal fraud' in polls, Tharoor said these are 'serious questions' which must be seriously addressed in the interest of all parties and all voters. Tharoor's remarks demanding action over Gandhi's claims assume significance as of late, he has been at odds with the party's stance on certain issues, including Operation Sindoor. The differences first emerged after the government picked Tharoor to lead a diplomatic delegation to the US and other countries to convey India's zero-tolerance stance on terrorism following the April 22 Pahalgam attack. At a press conference on Thursday, Gandhi made explosive claims of a 'huge criminal fraud' in polls through collusion between the BJP and the Election Commission. He cited an analysis in a constituency in Karnataka and said it was 'a crime against the Constitution'. Claiming the 'vote chori model' was being used in many constituencies across the country, Gandhi also said that the judiciary needs to get involved in this because 'the democracy that we love so much, does not exist anymore'. Gandhi said what his party collected through research was 'criminal evidence' and alleged that the Election Commission was busy destroying such proof across the country.

Congress leader Rahul Gandhi on Friday (August 8, 2025) reiterated his vote theft allegations and slammed the Election Commission of India (ECI) for demanding an affidavit under oath from him to support his claims. Addressing the 'Vote Adhikar Rally' in Bengaluru, Mr. Gandhi alleged that the Election Commission and BJP colluded to steal the Lok Sabha election from people. "The ECI asks me to file an affidavit and give information under oath. I have taken oath inside the Parliament holding the Constitution," he said. Today when the people are questioning the Election Commission based on data he released, the ECI has shut its website, he alleged. 'Vote Adhikar Rally' LIVE The ECI websites in Madhya Pradesh, Rajasthan and Bihar have been shut down because they knew that if people started questioning based on data, then their entire structure would collapse, Mr. Gandhi alleged. The top leader wanted his party-run government in Karnataka to investigate and act against the "crime of stealing election." Further, the former Congress president said: "In the (2024) Lok Sabha election, our alliance wins in Maharashtra. But after 4 months, the BJP wins the Maharashtra Assembly election. It was a surprising election result. When we tried to find out, we learnt that 1 crore new voters cast their votes; 1 crore new voters who had never voted in the LS polls voted in the assembly election in Maharashtra." Congress holds rally against 'Vote theft' in Bengaluru The Congress leader claimed that such new votes went to the BJP, which pointed to "wrongdoings." Wherever such new voters cast their votes, the BJP won. "The votes of our alliance did not reduce and we got exactly the same number of votes we had in the Lok Sabha election. The new voters went to the BJP in the Assembly election," he added. Mr. Gandhi claimed that in Karnataka, Congress surveys showed them winning 15 to 16 seats in the Lok Sabha election. "Our polling showed that we were ahead in 16 seats but we won nine seats. Then we started questioning. Did we really lose elections? We were demanding the EC a soft copy voter list but they were rejecting it. When we demanded video, they rejected it and changed the law. They said that they should destroy the video after 45 days," Mr. Gandhi said. Holding a copy of the Constitution, he said it has the ideology of thousands of years of history. "It has Mahatma Gandhi, Ambedkar, Nehru and Sardar Patel's voice resonates along with the sayings of Basavanna, Narayana Guru and Jyotiba Phule. Its foundation is one man one vote.' Every Indian citizen has the right of one vote each. "In the last election, Modi and its leaders made an assault on the Constitution. Indian institutions were destroyed," he alleged.
