Supreme Court seeks issues for consideration in review of 2022 PMLA ruling, final hearing on August 6-7

The Supreme Court on Wednesday (May 7, 2025) gave petitioners seeking a review of a nearly three-year-old top court judgment, which confirmed amendments to the Prevention of Money Laundering Act 2002 (PMLA) giving extensive powers of arrest, summon and raid to the Directorate of Enforcement (ED), liberty to propose issues in consultation with the Centre's top law officers, who raised objections.

Appearing before a three-judge Bench of Justices Surya Kant, Ujjal Bhuyan and N Kotiswar Singh, Solicitor General Tushar Mehta, for the Centre, said the review must be limited to only two aspects of the July 27, 2022, judgment.
Mr. Mehta said the Supreme Court itself had, while issuing formal notice to the Centre on August 25, 2022, in the review, restricted the ambit of the review to the dual aspects of depriving accused a copy of the Enforcement Case Information Report (ECIR) and transferral of the burden of proof of innocence onto shoulders of the accused instead of the prosecution. He said the Justice Kant Bench should limit the review to only these two issues. The Centre had also filed an affidavit the very next day confirming this arrangement. The petitioners had not objected to the affidavit.
However, senior advocate Kapil Sibal, for the petitioners including Karti Chidambaram, informed the Bench that a coordinate Bench of the court headed by Justice AS Oka has, in the meanwhile, pronounced a judgment that ECIR copies must be shared with the accused.

The July 2022 verdict giving the ED unbridled powers under the PMLA had been delivered by a three-judge Bench headed by Justice A.M. Khanwilkar (now retired).
Mr. Sibal said the review, in the light of Justice Oka's conflicting judgment must go to a Constitution Bench for an authoritative pronouncement.
Justice Kant remarked that Mr. Sibal's submissions suggested a complete recall of the 2022 judgment. The Bench asked him to instead to broadly suggest issues in consultation with Mr. Mehta and Additional Solicitor General S.V. Raju and place it before the court first for its consideration.
The court fixed the case for firming up the issues on July 16 at 2 p.m. It then scheduled the case for final hearing of arguments on August 6, and if necessary, on August 7.
The review petitioners have alleged that the top court's 2022 judgment deprived an accused person basic rights, which include even a copy of the Enforcement Case Information Report (ECIR). The core amendments to which the judgment gave its stamp of approval had virtually transferred the burden of proof of innocence onto the shoulders of the accused instead of the prosecution.
The 545-page judgment, authored by Justice (now retired) A.M. Khanwilkar, had upheld the PMLA's controversial 'twin conditions' for bail.
These conditions provided that a PMLA-designated trial court was required to give bail only if the accused could prove his innocence against money laundering charges. On the slim chance the accused did get bail, he had to establish that he was 'not likely to commit any offence while on bail'.
For an undertrial, who is under incarceration and with whom the ED has not shared the Enforcement Case Information Report, to prove that he is not guilty, to say the least, may prove to be a herculean if not an impossible task, the review petitions had argued.
The 2022 verdict was based on an elaborate challenge raised against the amendments introduced to the 2002 Act by way of a Finance Act in 2019.
Over 240 petitions were filed against the amendments which the challengers claimed to violate personal liberty, procedures of law and the constitutional mandate. The petitioners had claimed that the 'process itself was the punishment' under the PMLA.

The Supreme Court's Justice Surya Kant has said that the collegium system of appointing judges, despite its imperfections, serves as a 'crucial institutional safeguard' and preserves the judiciary's autonomy, The Indian Express reported on Sunday. Kant, who is slated to become the next chief justice of India, said that the collegium system 'significantly limits interference by the Executive and Legislature, thereby preserving the Judiciary's autonomy and insulating judges from extraneous pressures that could otherwise compromise their impartiality,' the newspaper reported. Under the collegium system, the five most senior judges of the Supreme Court, including the chief justice, decide on the appointments and transfers of judges to the top court and the High Courts. Speaking at Seattle University in the United States on June 4, Kant acknowledged that the system has faced criticism, especially on the lack of publicly articulated criteria for selecting judges. However, he said that 'recent efforts by the Supreme Court signal a growing commitment to enhancing transparency and public confidence in it'. In 2022, the Supreme Court Collegium had published detailed documentation of its deliberations on selecting five judges. Since October 2017, the Collegium has also been publishing its resolution on the court's official website. Kant also said that the 'the judiciary's evolving relationship with its own independence, lies at the very heart of how India's vast, pluralistic democracy continues to function with remarkable cohesion'. He also said that some phases of institutional strain 'particularly during the Emergency' eventually 'gave way to renewed judicial consciousness'. In recent years, the Bharatiya Janata Party government at the Centre has been selectively appointing judges recommended for elevation to the bench by the Supreme Court collegium, which has allowed the Union government to exercise a veto over judicial appointments. The executive and the judiciary have been in a tug-of-war regarding appointments to higher judiciary in recent years. Former Law Minister Kiren Rijiju and Vice President Jagdeep Dhankhar have repeatedly criticised the collegium system of appointing judges, contending that it is opaque. In 2014, the BJP-led government had introduced the National Judicial Appointments Commission Act with the objective of making appointments to the Supreme Court and High Courts 'more broad-based, transparent, accountable and bringing objectivity in the system'. The National Judicial Appointments Commission Act had proposed to make judicial appointments through a body consisting of the chief justice, two senior Supreme Court judges, the Union law minister and two other eminent persons nominated by the chief justice, the prime minister and the Leader of the Opposition. In 2015, the Supreme Court struck down the Act, ruling that it was unconstitutional.

The Congress on Monday (June 9, 2025) released a booklet to mark Narendra Modi's 11 years at the Centre, highlighting stagnated growth rate, rising hunger, and his "unfulfilled promises". Congress general secretary Jairam Ramesh, in a post on X, said that the booklet, '11 Saal, Jhoothe Vikaas ke vade', commemorates "some of the biggest lies of this Government." Addressing a press conference, AICC research department head Rajeev Gowda, who prepared the booklet, alleged, "This government is very good at fake news and propaganda. It is our job as the Opposition to get people to know this grim reality." He said that to expose the BJP's on its promises the party was releasing two sets of documents. The booklet, 'Ek Aur Baar Jumla Sarkar', he said, looks at the promises made by the BJP in its 2024 manifesto, and has since made. The other one, he said, is '11 Saal Jhoote Vikaas Ke Vaade', which is a "detailed exposé" of the "hollow promises" of the BJP. "In the 11-Saal document, one of the first themes that they (BJP) highlight is taking care of the poor and the marginalised. They are very happy that 81 crore people are getting free food grains under the Pradhan Mantri Garib Kalyan Anna Yojana (PMGKAY). But the basic problem of hunger is a much larger crisis in India, and it puts us at 105th out of 127 countries in the World Hunger Index. "Its implications: malnutrition is affecting our children in a horrible way, crippling their growth. Stunting is at 35.5%; Wasting is at 19.3%; Underweight is at 32.1%," Mr. Gowda said. He said that nearly a third of Indian children are suffering from malnutrition, even as the BJP insists on Viksit Bharat. "Let's remind our PM that he has a duty to our children and their future. They (BJP) claim that they have created 4 times the Eklavya residential schools since 2014. They have announced 700+ schools, out of which 300 are still non-functional. Is it rocket science to set up and run a school?" he wondered. The Congress leader also alleged that the Centre's claim that India added over 5,000 defence items to the indigenisation list was also not true. "Sadly, 40% of the items listed for indigenisation have not been indigenized as of now. India remains one of the top importers of defence rather than a producer and exporter. "If you look at 'mission mode DRDO projects', 23 out of 55 have been delayed, and the share of R&D in our defence budget is only 5.45%," he said. Neither is the claim that India was the fastest-growing large economy was true, he said. "This is true, but what rate are we growing? Are we able to encash our demographic dividend? Any economist will tell you that if we grow below 8.5% a year, we are sacrificing the future of crores and crores of our youngsters because we will not have enough growth, jobs and opportunities that are required to just fulfil the target—the great jumla — 2 crores jobs per year," he claimed. He said India's growth is 6.5% over the last year, which is the lowest rate after the COVID period. "So, what is happening in this 11th year of your Sarkaar, PM Modi? What is happening is reflected in the response of the private sector. Is the Indian private sector investing in India? If you look at the investment figures, after you have given the bonanza tax cut, nothing has changed. They still don't have confidence in the management of your economy to invest," the Congress leader said. He said the fixed capital formation has come down to 32.4%, which was an 11-year low. "There is another legacy: the glaring inequality. The share of wealth in India's top 1% of people is 40%. And the bottom 50% have to make do with just over 3%," the former Congress MP said, adding that this is not the economy the country wants. Mr. Gowda said that at top universities, 5,000 teaching posts were vacant as of November 2024 and 35% of faculty posts at AIIMS-Delhi and the new AIIMS had over 40% faculty vacancy. He sought to blow a hole also into the Centre's UDAN Scheme and the ease of living standards for middle-class India in tier 2 and tier 3 cities. "More than 50% of approved routes never took off by 2023. Of the 619 routes under the UDAN Scheme, only 323 are operational. After ₹4,500 crore spent, UDAN is still struggling to fly," he said. Mr. Gowda said 142 crore trees were planted under the 'Ek Ped Maa Ke Naam', but the highest tree cover loss has been recorded under the BJP government. Congress leader Mahima Singh said in the last 11 years there have been only 'jumlas'. She said that though the BJP claimed that the government distributed ₹3.7 lakh crore to PM Kisan beneficiaries between April 2022 and November 2023, about 2.25 crore beneficiaries were removed from the list.
