
Najib gets nod to attend addendum hearing
A three-member bench led by Chief Judge of Malaya Tan Sri Hasnah Mohammed Hashim made the ruling after allowing Najib's lawyer Tan Sri Muhammad Shafee Abdullah's application today.
Other members of the bench were Federal Court judges Datuk Zabariah Mohd Yusof and Datuk Hanipah Farikullah.
Federal Counsel Ainna Sherina Saipolamin, who appeared for the Attorney-General's Chambers, did not object to the former prime minister's application.
The A-GC filed the appeal after the Court of Appeal granted Najib permission to initiate a legal bid to review the existence of an addendum order and to adduce additional affidavits in support of his application.
On April 28, the same court unanimously granted the A-GC's leave (permission) application to present its arguments to overturn the Court of Appeal's ruling.
The top court said the proposed questions raised by Attorney-General (A-G) Datuk Mohd Dusuki Mokhtar had passed the threshold requirements for leave to be granted under Section 96 of the Courts of Judicature Act (CJA) 1964.
"The questions posed are novel and raise issues of public importance, which should be further ventilated before this court.
"The questions are of public importance and can provide guidance to the courts on the correct approach to adopt when dealing with the admission of or the addition of evidence.
"The questions also pertain to the role of the A-G in judicial review proceedings, particularly whether the A-G is duty-bound under the law to confirm the existence of and supply copies of the impugned documents.
"The applicant also seeks to argue whether the A-G has an obligation to defend or verify the evidence at the leave stage of judicial review proceedings, in light of the provisions of Order 53 of the Rules of Court 2012," said the court.
The hearing is scheduled to begin on July 1.
On Jan 6, a three-bench Court of Appeal panel led by Datuk Azizah Nawawi, in a split decision, also allowed Najib to adduce additional affidavits to support his application.
Other members of the bench were Datuk Azhahari Kamal Ramli and Datuk Seri Mohd Firuz Jaffril.
Firuz, when reading the majority decision, said the evidence concerned was not available when they (the appellant) initially filed the leave to initiate a judicial review before the High Court last year.
Meanwhile, Azizah, in her minority decision, said there was no appealable error made by the lower court in ruling that the evidence presented in the hearing was hearsay.
Najib claims that a royal addendum allows him to serve the remainder of his jail term under house arrest.
He is seeking a mandamus order compelling the respondents to confirm and disclose the existence of the alleged additional document dated Jan 29, 2024.
Najib is currently serving a six-year prison sentence after being convicted of misappropriating RM42 million from SRC International Sdn Bhd.
The High Court had sentenced him to 12 years in prison with a fine of RM210 million, and the verdict was subsequently upheld by the Court of Appeal and the Federal Court.
However, his prison sentence was halved to six years and his fine was reduced to RM50 million following his petition for a royal pardon.
Najib later filed an application on an alleged addendum order signed by the 16th Yang di-Pertuan Agong, allowing him to serve the remainder of his prison sentence under house arrest.
Previously, the High Court had dismissed his application.

Court of Appeal reserves decision in Indira Gandhi's lawsuit against IGP
PUTRAJAYA: The Court of Appeal has reserved its decision on an appeal by M. Indira Gandhi regarding her lawsuit against the Inspector-General of Police (IGP) and three others. The case concerns the failure to locate her ex-husband, who took their daughter away years ago. Justice Datuk Mohamed Zaini Mazlan stated the court needed time to deliberate on submissions from both parties. The bench, which included Justices Datuk Faizah Jamaludin and Datuk Mohd Radzi Abdul Hamid, set Aug 25 for case management. Indira is appealing the Kuala Lumpur High Court's dismissal of her lawsuit against the IGP for alleged nonfeasance in public office. She seeks a declaration that the IGP failed to execute a committal warrant against her ex-husband, Muhammad Riduan Abdullah. Additionally, she wants the other respondents held vicariously liable and compensation for damages. Prasana Diksa, now 17, was taken by Muhammad Riduan when she was 11 months old after he converted to Islam. Indira's lawyer, Rajesh Nagarajan, argued that Muhammad Riduan has not complied with a mandamus order to return the child. He also claimed the police failed to locate Muhammad Riduan despite knowing his whereabouts. Rajesh mentioned that Muhammad Riduan had settled several traffic summonses, suggesting authorities could have tracked him. Senior federal counsel Nur Ezdiani Roleb countered that Indira failed to prove negligence by the respondents. She stated the police made efforts, including using the Special Task Force on Organised Crime (STAFOC). Nur Ezdiani also noted Indira never filed a discovery application to verify the traffic summonses claim. In 2009, Muhammad Riduan unilaterally converted his three children to Islam without Indira's consent. The Federal Court later ruled the conversions null and void in 2018. The Ipoh High Court granted Indira full custody of the children in 2010. A 2014 committal order directed Muhammad Riduan's arrest for contempt of court. Indira obtained a mandamus order in 2014 compelling the IGP to enforce the arrest and recovery orders. The Federal Court restored the mandamus order in 2016 after the Court of Appeal dismissed it. Court of Appeal reserves decision in Indira Gandhi's suit against IGP, three others over missing daughter
PUTRAJAYA, Aug 11 — The Court of Appeal today reserved its decision on an appeal by kindergarten teacher M. Indira Gandhi relating to her lawsuit against the Inspector-General of Police (IGP) and three others over their failure to locate her ex-husband, who took their daughter away. Justice Datuk Mohamed Zaini Mazlan, who chaired the three-judge bench, said due to the nature of the case, the court needed some time to deliberate on the submissions presented by Indira's lawyer Rajesh Nagarajan and senior federal counsel Nur Ezdiani Roleb, who represented the IGP, the Royal Malaysia Police, the Home Ministry and the Malaysian Government. The court set August 25 for case management. The other judges presiding on the bench were Justices Datuk Faizah Jamaludin and Datuk Mohd Radzi Abdul Hamid. Indira is appealing against the decision of the Kuala Lumpur High Court that dismissed her lawsuit seeking a declaration that the IGP has committed the tort of nonfeasance in public office over the failure to execute the committal warrant against her ex-husband Muhammad Riduan Abdullah as ordered by the Ipoh High Court. She also wants a declaration that the other three respondents are vicariously liable for the tort of nonfeasance committed by the IGP, and for compensation in the form of general damages, aggravated damages and exemplary damages. Prasana Diksa was taken away by Muhammad Riduan when she was 11 months old, shortly after he converted to Islam. She is now 17. In today's proceeding, Rajesh argued in court that Muhammad Riduan had still not complied with a mandamus order issued by the Ipoh High Court requiring him to return Prasana Diksa to Indira, who holds legal custody of the child. He also said the police failed in their duty by not locating Muhammad Riduan, despite the former IGP knowing his whereabouts, but still not enforcing the court's committal order to apprehend him. He said he was informed that Muhammad Riduan, previously known as had several outstanding summonses for traffic offences and was believed to have settled the summonses. Nur Ezdiani countered by saying Indira failed to prove that all the respondents had neglected to take appropriate action in locating and arresting Muhammad Riduan. She said that the police had made various efforts to track him down, including using the Special Task Force on Organised Crime (Stafoc) at the time. On the traffic summonses claim, Nur Ezdiani said Indira had never filed any discovery application to verify the matter. In 2009, Muhammad Riduan unilaterally converted his three children to Islam without Indira's consent before going to the Syariah Court to obtain custody of the children, but in 2018, the Federal Court ruled the unilateral conversion of the three children null and void. In 2010, the Ipoh High Court granted full custody of the children to Indira. In May 2014, the civil High Court in Ipoh issued a committal order for Muhammad Riduan to be arrested for contempt of court over his failure to return Prasana Diksa to Indira, and also issued a recovery order by directing the police to find the child. Indira subsequently obtained in the High Court in September 2014 a mandamus order which compelled the IGP to enforce the two court orders, with the Court of Appeal later dismissing the mandamus order and the Federal Court in April 2016 restoring the mandamus order for the arrest of Muhammad Riduan. — Bernama
