Court of Appeal reserves decision in Indira Gandhi's lawsuit against IGP
The case concerns the failure to locate her ex-husband, who took their daughter away years ago.
Justice Datuk Mohamed Zaini Mazlan stated the court needed time to deliberate on submissions from both parties.
The bench, which included Justices Datuk Faizah Jamaludin and Datuk Mohd Radzi Abdul Hamid, set Aug 25 for case management.
Indira is appealing the Kuala Lumpur High Court's dismissal of her lawsuit against the IGP for alleged nonfeasance in public office.
She seeks a declaration that the IGP failed to execute a committal warrant against her ex-husband, Muhammad Riduan Abdullah.
Additionally, she wants the other respondents held vicariously liable and compensation for damages.
Prasana Diksa, now 17, was taken by Muhammad Riduan when she was 11 months old after he converted to Islam.
Indira's lawyer, Rajesh Nagarajan, argued that Muhammad Riduan has not complied with a mandamus order to return the child.
He also claimed the police failed to locate Muhammad Riduan despite knowing his whereabouts.
Rajesh mentioned that Muhammad Riduan had settled several traffic summonses, suggesting authorities could have tracked him.
Senior federal counsel Nur Ezdiani Roleb countered that Indira failed to prove negligence by the respondents.
She stated the police made efforts, including using the Special Task Force on Organised Crime (STAFOC).
Nur Ezdiani also noted Indira never filed a discovery application to verify the traffic summonses claim.
In 2009, Muhammad Riduan unilaterally converted his three children to Islam without Indira's consent.
The Federal Court later ruled the conversions null and void in 2018.
The Ipoh High Court granted Indira full custody of the children in 2010.
A 2014 committal order directed Muhammad Riduan's arrest for contempt of court.
Indira obtained a mandamus order in 2014 compelling the IGP to enforce the arrest and recovery orders.
The Federal Court restored the mandamus order in 2016 after the Court of Appeal dismissed it.
The case remains unresolved as the Court of Appeal prepares its decision. - Bernama

Forced to covert by boyfriend, Kerala woman commits suicide
NEW DELHI: The family of a 23-year-old woman from Kothamangalam in Kerala, who committed suicide, alleging sexual abuse and forced religious conversion by her boyfriend on the promise of marriage, has sought an NIA probe into the incident. The Kothamangalam police on Monday (Aug 11) detained Rameez Mohammad for alleged abetment of suicide of his partner, Sona Eldhose. He and his family have been accused of harassing the deceased to convert her before marriage. The woman's mother has written to the chief minister and the state police chief, demanding an NIA probe into the suicide of her daughter. She stated in the letter that her daughter committed suicide due to an attempt to convert her to Islam. The family also accused the police of registering a case under weak sections. It has stated that they suspect the involvement of religious extremist terrorist organisations in the attempts of forced conversion. Her mother points out in the letter that their daughter met Rameez while studying in a college and was later subjected to physical torture, detention, and mental torture on the pretext of a marriage promise. The girl was told to convert if she wanted to get married and live in the family house of the accused. The family points out in the letter that the girl's suicide note clearly states that she was locked in a room at Rameez's house in Panayikulam, Aluva, and that he, his family, and many others forced her to convert and tortured her mentally and physically. Sona Eldhose, a resident of Puthupady in Kothamangalam and a TTC student at an institute in Muvattupuzha, was found dead at her residence at around 2pm on Saturday. Initially, the Kothamangalam Police registered a case of unnatural death. However, the police stumbled upon a suicide note, reportedly written by the deceased during the preparation of mahazar on Sunday. The suicide note reportedly revealed that the deceased was allegedly harassed to undergo religious conversion by Rameez and his family. Sona was also allegedly physically assaulted, according to the suicide note. Meanwhile, a 10-member team has been appointed to investigate the suicide of Sona. The investigation will be led by the Muvattupuzha DySP. The police have reportedly concluded that the young woman committed suicide due to severe neglect from her boyfriend Ramees after she refused to convert to Islam. The BJP has claimed that the death of the 23-year-old woman is a case of 'love jihad'. BJP Kerala vice-president Shone George alleged that similar incidents are occurring across Kerala and urged Chief Minister Pinarayi Vijayan to order an impartial investigation into the incident. - The Statesman/ANN

13MP debate descends into shouting match once again over "kafir harbi" remark
KUALA LUMPUR: The Dewan Rakyat debate on the 13th Malaysia Plan was once again thrown into a shouting match this afternoon when an opposition member of parliament called RSN Rayer (PH-Jelutong) "kafir harbi" (non-believers who are against Islam). It all started when Datuk Awang Solahuddin Hashim (PN-Pendang) accused the Malaysian Indian Transformation Unit (Mitra) of failing to deliver aid. He claimed that despite RM100 million being allocated for Mitra, "not a single cent" had been released and accused some board members of doing nothing for the Indian community. Following Awang's allegations, Rayer rose and interjected, citing the standing order and accusing him of making a malicious assumption regarding Mitra's allocations. "How does he, or Batu and Segamat, together with Indian MPs and other non-Indian MPs, know that this matter has not been brought to the prime minister's attention? "How does he know the prime minister does not care about this matter? Don't make accusations or malicious assumptions. I don't want to waste time with Pendang... I am fed up with him," he said. The heated exchange between the two continued before being stopped by Syahredzan Johan, who was presiding over the session. Awang later resumed his debate and took a jab at Rayer, saying that Pas had remained calm even when the party was previously labelled "Parti Ajaran Sesat." "They even called Pas 'Parti Ajaran Sesat,' but we stayed calm. One of them is a kafir harbi who called us that. He said it just now in Parliament. But we stayed calm," he said. Tensions escalated further after Chong Zemin (PH-Kampar) interjected in defence of Rayer before being muted by Syahredzan.
