Kota Kinabalu: Familia Superstore Sdn Bhd was fined RM6,000 or a year's jail for selling Al-Qur'an materials containing errors that contravened standards set by the Qur'an Text Printing Control and Licensing Board (LPPPQ). Magistrate Wan Farrah Farriza Wan Ghazali meted out the sentence to the company after its Manager Abdul Malik Abdul Manap pleaded guilty to the charge against the company.
Advertisement The charge stated that the company had offered to sell decorative Qur'an verse frames which were found to contain textual inaccuracies at the company premises in One Borneo Hypermall, here, on March 25 this year. The act had violated Section 14(1) of the Qur'an Text Printing Act 1986 (Amendment P) 2023 (Act 326), which prohibits the sale of Qur'an materials with errors or those that deviate from officially approved writing conventions. Under the Section, it provides for a fine of up to RM50,000 or a jail term of up to five years, or both, on conviction. During mitigation, Abdul Malik asked for a lighter sentence saying that he did not know that the requirement to verify the accuracy of Quranic materials before offering them for sale. However, Prosecuting Officer Mechellister Saimon, from the Sabah branch of the Home Affairs Ministry's Enforcement and Control Division, urged the court to impose an appropriate sentence on the grounds that that ignorance of the law was not a valid defence particularly when it involves sanctity of Qur'an verses. Rejection of bid to refer questions to High Court unfair, says lawyer KUALA LUMPUR: The Sessions Court's dismissal of Toh Puan Na'imah Abdul Khalid's application to refer questions of law to the High Court was a miscarriage of justice, the High Court heard. Lawyer Datuk Dr Gurdial Singh Nijar told High Court judge Justice K. Muniandy that the dismissal had denied his client clarity on her legal position and this should be rectified by the High Court to uphold the integrity of the judicial process. Gurdial was submitting in Na'imah's application for a revision of the Sessions Court's dismissal of her application to refer eight questions regarding the validity of charges she is facing. These are for allegedly failing to declare her assets to the Malaysian Anti-Corruption Commission (MACC). In his submission, Gurdial said the present charge against Na'imah was an offence that was 'purely technical' and likely made 'in retaliation' by the MACC. He said Na'imah was asked to assist in the investigation against her late husband, Tun Daim Zainuddin, as a witness and she was never a suspect. The MACC issued a Section 36(1)(b) notice on her, requiring disclosure of information in respect of her assets and she had complied with this notice to the best of her ability, Gurdial said. 'Notwithstanding this, the MACC took the view that her compliance was insufficient... insufficient perhaps for them to formulate a charge against the late Daim for any criminal offence. 'Perhaps in retaliation, the MACC commenced the present charge against the applicant,' he said. Gurdial said the dismissal by the Sessions Court showed a clear misconception in law and procedure when the lower court judge made certain findings that misconstrued the true nature of the charge against Na'imah. 'In this case, the Sessions Court's dismissal deprived the applicant of this fundamental right, thereby failing to ensure that the legal questions, which are central to the case, were properly addressed,' he added. Justice Muniandy fixed July 11 for parties to continue their submission. On Jan 23, 2024, Na'imah was charged for failure to comply with a notice to declare her assets, which included Menara Ilham and several other properties in Kuala Lumpur and Penang. She was charged under Section 36(2) of the MACC Act 2009, which carries a maximum penalty of five years' imprisonment or a fine of RM100,000, upon conviction. On Feb 29, 2024, Na'imah filed an application to refer questions of law pertaining to Sections 30(5), 36(2) and 62 of the MACC Act 2009, as well as Section 32(3)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 to the High Court. On Feb 18, the application was dismissed by the Sessions Court on grounds that it lacked merit, as there were no constitutional issues raised in the case.

Lorry driver fined RM6,000 for reckless driving, causing property damage
JOHOR BARU: A sand lorry driver was fined RM6,000 after pleading guilty in the Johor Baru magistrate's court today to driving recklessly and causing damage to several public properties along Jalan Johor Baru–Gelang Patah Pendas, in Iskandar Puteri, last Tuesday. The accused, Chew Ah Sing, 69, entered the plea before Magistrate Nur Fatin Mohamad Farid after the charge was read out in Mandarin by the court interpreter. According to the charge sheet, Chew had driven the sand lorry on a public road without due care and attention, with the rear bucket left raised, causing it to strike overhead electrical cables. The incident resulted in damage to the cables, three electricity poles, a traffic light pole, a closed-circuit television (CCTV) camera, and a bus stop. The offence was committed at Kilometre 30.7 of Jalan Johor Baru–Gelang Patah Pendas at around 3.20pm on June 10. The charge was framed under Section 43(1) of the Road Transport Act 1987 (Amendment 2020), which carries a penalty of up to 12 months' imprisonment and a fine of not less than RM5,000 and not more than RM10,000. For a second or subsequent offence, the punishment may include up to 12 months' imprisonment and a fine of not less than RM10,000 and not more than RM15,000. In such cases, the offender's driving licence will be endorsed by the court, and a probationary licence may be revoked upon conviction. Deputy Public Prosecutor Amirah Tasnim Saleh prosecuted the case. In mitigation, the senior citizen, represented by lawyer Sharmaine Fairuz Mohd Zulkifli from the National Legal Aid Foundation (YBGK), pleaded for a minimum sentence, citing his monthly income of RM2,000 and financial responsibility for his wife, mother, and school-going child. However, Amirah Tasnim urged the court to impose a fitting sentence, as the accused's actions had caused damage to multiple public properties. The court imposed a RM6,000 fine, in default four months' imprisonment, and endorsed Chew's driving licence. On the day of the incident, media reports stated that a sand lorry with its rear bucket still raised struck overhead power lines, causing three electric poles to fall near a school. A video of the incident, recorded around 3.20pm and widely shared on social media, showed the lorry hitting the cables before the poles came crashing down. Iskandar Puteri district police chief Assistant Commissioner M. Kumarasan was quoted as saying that the driver claimed he was unaware that the rear bucket had not been lowered.

SSB Sibu appeals for public support to cover monthly operational cost
SSB Sibu Branch in urgent need of funds to support registered beneficiaries and cover operational costs of the care centre. SIBU (June 13): The Sarawak Society for the Blind (SSB) Sibu Branch is appealing for continued public support as it faces a monthly operational need of approximately RM13,000. The branch's vice-chairperson Datin Sri Judy Lau said the funds are essential to cover living allowances for its registered blind members and maintain the daily operations of its care centre. According to her, each registered blind individual currently receives a monthly living allowance of RM100 to help cover basic daily necessities. 'At present, there are about 80 registered recipients from the central region of Sarawak. At one point, the number had exceeded 100 individuals,' she told a press conference following a management meeting with the association on Thursday. The SSB care centre, which is operated by the branch, currently employs three full-time staff and houses one full-time resident. In the past, the centre also provided massage therapy training for the visually impaired. 'Today, many of them have become independent and are able to work on their own. 'Nevertheless, we continue to provide monthly living allowances,' Lau noted. She added that when the centre receives donated items such as rice or other essentials, these are distributed to eligible recipients. 'Every month, recipients will come to the centre to collect their allowances and any available aid,' she explained. Lau highlighted that anyone certified as blind by the Social Welfare Department (JKM) is eligible to register as a member of the society and receive the benefits provided. The Sarawak Society for the Blind (SSB) Sibu Division Branch will hold its 47th annual Open Day cum charity sale on October 12, from 7am to 12 noon, at the Sibu Blind Centre. According to organising committee chairperson Datin Sri Judy Lau, the fundraising target for this year remains at RM150,000 – the same as last year's benchmark. 'We hope the event will receive strong support and participation from the public, just as it has in previous years, so we can achieve our fundraising goal,' she said at a press conference, following a preparatory meeting on Thursday. Last year's event exceeded expectations by raising RM180,000, surpassing the original target, she revealed. Lau also expressed her gratitude to donors and supporters who have consistently contributed to the association's charitable efforts. This year's event will feature around 30 stalls, with the primary focus on food sales. In addition, a variety of items including daily necessities, ink paintings, decorative plants, and other goods will be available for purchase. To boost engagement, the organising committee is introducing two awards – 'Best Decorated Stall' and 'Top Fundraising Unit'. 'At the moment, charity sale tickets are being printed and will be distributed to confirmed participants and made available to the public soon,' Lau noted.
