No witness testimony that Zayn Rayyan's parents neglected him, court hears

PETALING JAYA: None of the 27 prosecution witnesses said that the parents of Zayn Rayyan Abdul Matin had neflected the child, a police officer told the Sessions Court here Wednesday (April 23).
Asst Supt Mohd Hafizee Ismail, 38, the senior investigating officer at police headquarters here at the time of the case, was being cross-examined by defence counsel Haresh Mahadevan on the 19th day of the trial of Ismanira Abdul Manaf and Zaim Ikhwan Zahari.
They were charged with child neglect before Sessions judge Dr Syahliza Warnoh.

ASP Hafizee, who is now with the Operations Intelligence Unit at the South Klang Criminal Investigation Division, also agreed with counsel's suggestion that, based on the medical report, Zayn Rayyan was neither abused nor neglected.
Haresh: ASP, are you aware that out of the 27 prosecution witnesses who have testified, not a single one stated in court that they saw either the first accused (Zaim Ikhwan) or the second accused (Ismanira), or both, neglecting Zayn Rayyan on Dec 5 and 6, 2023?
ASP Hafizee: I am not sure.
Haresh: Based on your investigation, which witness stated this? Do you know?
ASP Hafizee: None.
The 28th prosecution witness also agreed that none of the 27 others who had testified had seen either of the accused by the stream near Block R of the Idaman Apartment in Damansara Damai, the site where Zayn Rayyan's body was found.

Haresh: Of the 27 prosecution witnesses who have testified, which witness saw both accused near the stream?
ASP Hafizee: None.
On June 13 last year, Zaim Ikhwan and Ismanira, both 30, pleaded not guilty to a charge of neglecting their six-year-old autistic son in a manner likely to cause physical harm.
The offence allegedly occurred in PJU Damansara Damai between noon on Dec 5 and 9.55pm on Dec 6, 2023.
They were charged under Section 31(1)(a) of the Child Act 2001, which is punishable by a maximum fine of RM50,000, imprisonment of up to 20 years, or both upon conviction.
Zayn Rayyan was reported missing on Dec 5, 202 and his body was discovered in a stream near his home at Apartment Idaman, Damansara Damai, the following day.
He was believed to have been murdered, and an autopsy revealed injuries to his neck and body, consistent with self-defence. – Bernama

Maran police chief Superintendent Wong Kim Wai said both the bus and lorry were travelling in the same direction towards Kuantan. "The bus ferrying 28 passengers from Kuala Lumpur to TSK was travelling on the slow lane when it crashed into the rear of the trailer. "All the 28 passengers did not sustain any injuries. They were transferred to another bus to continue their journey to TSK," he said in a statement today. Wong said the crash is being investigated under Section 43(1) of the Road Transport Act 1987 for careless and inconsiderate driving, which carries a penalty of up to RM10,000 and a jail term of up to 12 months. This crash involving university students comes after Monday's bus tragedy in Gerik, Perak, where 15 undergraduates were killed.

SIBU (June 10): The Magistrates' Court here today sentenced a Chinese national to five years imprisonment and fined him RM20,000 in default three months' jail for dangerous driving that resulted in the death of former Sabah State Court director Marutin Pagan. Magistrate Rosli Ahmad convicted Sun Xue Song, 42, on his own guilty plea to an amended charge under Section 41(1) of the Road Transport Act 1987, which carries a maximum jail term of 10 years and a fine of up to RM50,000 upon conviction. Rosli also ordered for Sun's jail sentence to run from the date of his arrest on March 30 and disqualified him from holding a driving licence for five years. Sun committed the offence on March 30 at around 1pm at the Kanowit roundabout here. According to the facts of the case, Sun, who was driving a Proton X70, deliberately ignored the give-way road markings leading to the roundabout as he proceeded to drive dangerously before colliding with a Toyota Fortuner. Marutin, 56, and three other passengers were travelling in the Toyota Fortuner driven by his daughter, which was heading towards the Sibu exit. Sun's act of dangerous driving resulted in a collision between the two vehicles, which caused the Toyota Fortuner to roll several times before ending up on its side off the roundabout. Marutin, who sustained several injuries due to the incident, was taken to Kanowit Hospital where he later died. A post-mortem result determined his cause of death as head and chest injuries due to a road traffic crash. In mitigation, Sun, represented by defence counsel Terence Tiong, requested the court to consider his clean record, full cooperation with authorities, genuine remorse, financial assistance to the victim's family, dependents' plight, and the unintentional nature of the tragedy. Tiong said Sun is supporting his seven-year-old son and 70-year-old mother, who rely entirely on his income, care, and support for their survival and well-being. The first-time offender with no previous convictions in Malaysia or his home country had given RM70,000 to Marutin's widow as a bereavement payment to express deep remorse and sorrow. Tiong said Sun had also entered a guilty plea at the earliest opportunity. He added another mitigating factor was that the scene of the accident at Jalan Kanowit-Durin is known as an accident-prone area. In her submission, deputy public prosecutor Cynthia Emmelda Jerry requested the court to consider the degree of culpability where Sun had deliberately ignored the road markings before dangerously driving into the roundabout. She also submitted that the sentence to be imposed must have a deterrent effect on other potential road users as well as for public interest.

SIBU: A Chinese national has been sentenced to five years' jail for causing the death of Sabah State Courts director Marutin Pagan, 56, in an accident. Sessions Court judge Rosli Ahmad ordered on Tuesday (June 10) that Sun Xue Song, 42, was to serve the prison term from March 30, the date of his arrest. Sun had initially entered a not guilty plea when the charge was first read to him by a court interpreter before Magistrate Romario Jonoi. On May 16, he changed his plea to guilty during pre-trial case management before Magistrate Oon Kork Chern. ALSO READ: Foreigner remanded a further three days over fatal accident in Sibu Oon then recused himself from hearing the case further because of his acquaintance with the victim, and it was then scheduled for reassignment before Sessions judge Rosli. According to the facts of the case, the engineer was accused of driving a sports utility vehicle dangerously, causing Marutin's death at the Kanowit roundabout near Sibu at around 1pm on March 30. He was charged under Section 41(1) of the Road Transport Act 1987 for causing death by dangerous or reckless driving, which carries a maximum penalty of 10 years' imprisonment and a fine of up to RM50,000 upon conviction. Sun's counsel Terrence Tiong said in mitigation that his client was a first-time offender with no previous convictions in Malaysia or his home country. Tiong said the accused had also taken steps to help the victim's family. "Despite his limited financial means, he made a bereavement payment to the deceased's wife, not in the hope of leniency or forgiveness, but out of compassion and a sense of moral duty," he said. He contended that a long custodial sentence would also hurt Sun's innocent dependents, including his mother, 79, and his seven-year-old son, who is still in primary school and would be left without a means of support or a caregiver. DPP Cynthia Emmelda Jerry urged the court to impose a deterrent sentence as the accused had caused emotional trauma to the victim's family. She also said public interest had to be taken into consideration.
